We used to sell a variant of the potato/tomato hybrid at the garden center I worked at. The variant was named 'fries and ketchup'. Plants can in fact get diseases and thus get sick. The disease that comes immediately to mind is fire blight but there are many others. If the birds having the right of way on the highway in Utah is true it is pretty much never enforced. I lived there for a few years and never once saw anyone yield to a bird.
