    If one Ben won’t sign, and trustee needs to file accounting with court, can he distribute to the other bens that agreed, and hold back on the one who won’t sign? Or, are all beneficiaries distributions on hold?

      @@AlDavLaw Trustee never provided accounting which is the least of it but now since I won’t sign dist agreement/assent to account/release paperwork, etc, the trustee is filing for court accounting approval. Am I notified of that process before court approval? I think you said it’s a done deal after court approves. My issues with bad trustee is 10 fold, not just accounting, so does that mean I can’t address those other issues after court approves?

    What can one do if a trust gets amended only after their spouse dies... Would the heirs be able to revert back to when both parents had their ideas of how they wanted their trust to be distributed ..?

      That all depends on the Trust terms. Some joint trusts made by married couples require half of the assets to be held in an irrevocable trust, called a bypass trust. But some joint trusts allow the surviving spouse to have control over everything, including making amendments. You have to read the original trust document and see what it provides. If half of the assets were not required to be placed into an irrevocable bypass trust (or something similar), then the trust will NOT revert to what both your parents wanted.
