    Hi Darian, I have a question. My mom came to the US in 1992 with a tourist visa from Mexico. I am her daughter and am a US citizen now. What would be the best way to petition her to get her green card here in the US.

    Hi Darian, there is a part in your video that I want to ask: Once they got approved and visa to enter the US, after they got into the US with Visa, what do we need to do to pay 220$ fee for their green cards? By the way, your video did answer 90% of all my curiosity. Thank you very much

    When can one file for Naturalization if he/she married in 2018 and get conditional greencard in 2019, having applied for i-751 in 2021 he was given 1 year extension and in 2022, he was sent another 4 years extension again, the marriage is already 6 years, can one file for Naturalization or needs to wait till the expiration of the 4 years conditional greencard extension?

      Could have filed the naturalization application in 2022 after being a conditional resident for 3 years. The process will sometimes take longer if you file the N-400 while the I-751 is still pending, but you are allowed to file the application before the I-751 is approved.

    Hello Atty. I am a US Citizen.My parents are holders of B1B2 Visa.They come to US every year and go back to their country after staying in US for 5months.I plan to petition them. Can my parents stay in US while i file their petition and also file for their change of status? Thank you Atty.

      Good question. Yes, you can petition for them and apply for adjustment of status and the entire process can be done simultaneously while your parents are in the US. However are 2 general warnings before you submit any USCIS applications after entering the US as a tourist: (1) immigrant intent issues, and (2) they won't be able to leave/re-enter the US until they receive their green card or advance parole document. If your parents need to be able to travel freely then it might be better to file the I-130 followed by consular processing (instead of adjustment of status). Schedule a consultation with me if you'd like to discuss the details so that we can figure out the best option for your parents.

    So I’m a US CITIZEN. I want to get my mother to come visit me from Brazil, she will only come to visit. So by what I saw on your videos the best thing would be a tourist visa???

      If she only wants to visit, then yes, a tourist visa would probably be most appropriate.

    Hello sir i have question
    I am married us citizen since 2017 i got green card from 2017and i left her over 3 years i met another woman overseas and we got 2 son from new woman and us woman she not divorced yet and i dont know anything about her question
    N400 i have to mention i married or seperated
    Also my sons i have to put them in n400

      If your green card was conditional then you probably need to file form I-751. You are legally married so you must mention that you are married on the N-400. You must include all children, including your sons.

      Maybe. Driving privileges are different in each state. Some states will recognize out-of-country drivers licenses for a period of time. For example, in New York you can drive with a valid driver license from another country and you do not need to apply for a New York State driver license unless you become a New York State resident.
