Just because the Founders desired, and contemporary scholars are willing to reiterate the Founders ideas, that does not mean the ideas are deployed correctly in the composition of the government charter system. As Benjamin Franklin declared; emerging information has the ability to change one's understanding of (technology). It is not that difficult to recognize that the separation and balance of government powers is corrupted by partisan alignment.
Political Science scholars still have not figured out what causes the partisan problems that we endure.

The only thing that "ensures" a just government, is a moral people controlling it.

The principle of separation of powers might be theoretically feasible, but practically decaying, in a sense of dissension to which the constituents have suffered enormously as to the confusion over the proper dictation of duty and responsibility within the assembly of representatives, directorial body of enforcers, and tribunal of magistrates.
In my opinion, the only circumstance when the separation of powers has been lapsed sickly is when the institutions of the presidency and the judiciary are slowly bent on popular will, and steadily becoming centrally independent in nature by the violent transition towards unsupervised discretion.
