Sneaky Surveillance Tactics Used by Insurance Companies

- Surveillance in workers' compensation cases is nothing new. I advise all of my Georgia workers' compensation clients to be alert to the likelihood that their employer will hire a private detective to follow and videotape their activities.
More recently I have seen cases where private investigators are using new, minuaturized cameras hidden in traffic cones and tree stumps. We are seeing investigators using drones. No longer should you assume that insurance company surviellance requires a live cameraperson.
Your employer and their insurance company want to catch you engaging in activities that are inconsistent with your work restrictions. For example, if your doctor has limited you to lifting 10 lbs. or less, and the private eye hired by the insurance company videotapes you lifting your 25 lb. grandchild, they can use that videotape as evidence that you are not as hurt as you claim to be.
You have probably heard the expression "a picture is worth a thousand words" and this is especially true in workers' compensation surveillance.
Your otherwise strong case can be damaged because you were having a good day and decided to push yourself. The videotape does not, of course, show the two days you spent in bed after overdoing it.
You would be wise to always limit your activities to the lifting, carrying and standing limits set out by your doctor. You may not see the private eye, but his camera will see you. #surveillance #privateinvestigator #workerscompensationsurveillance #denyworkinjuryclaim #insurancecompanysneakytricks

I don’t understand why it is so hard to listen to your lawyer! A lawyer knows the bullshit that goes on and have your best interests at heart. They are there to (obviously make money- and rightfully so) and to make sure you don’t get screwed by insurance and/or company. Don’t give insurance/company ammunition to take you down!

I have to get not one spinal fusion but 2 surgeries one for my neck then I’m going shortly one for my lower back and now I have to worry if I got into my car to fast I took my garbage out I brought in a package for my car even a person in a wheelchair can do all those things
If a state work comp agency, investigated a work comp company. Are there any benefits by getting this to happen, or is it just a waste of time?
Can you lift 25 lbs in your yard, if the Dr says you can lift 25 lbs at work?

My insurance company made me do supervised physio, 1 hour, 3x/week for 1 year while I was investigated for heart, lungs issues. They were pushing me to find my limits until my cardiologist stopped me. What is the difference of physio and carrying 6 bags of groceries (I am being 100% honest with my insurance company but I'm now under surveillance...) Even though I'm 100% honest, can they use this against me even though they made me do physio for a year?
Yes they can use it against you. WC is extremely adversarial.

I get all this but how often is it done? Are there certain types of cases that cause video investigations? Is your average WC case subject to this?

Hi Jodi, I just have a question what do I do if during my 9 hour surgery the insurance company put a pacemaker in me then they deleted the video for the surgery and xrays that showed it my doctor gave me a ekg and put a heartmoniter on me for 2 days and both results came back that I have a pacemaker.

What about if it's a bulging disk in lower back but I can put groceries in car it's fine what hurts is when I'm at work repeatedly lifting heavy stuff a certain way that's when it hurts
If you are not able to perform the duties of your job, you would have a claim. Has your employer made light duty available?
@@GeorgiaWorkersComp yes I'm going around sweeping floors i was working with loading trucks with furniture how long can my employee have me on light duty seems to me my back is going to take forever to heal it's been three months and it still hurts

Will they watch you will going to the doctor or hospitals.
Insurance companies have been known to videotape your daily activities. When you have an active workers's compensation case.
If the surveillance have any videos so what they can do.?Just show it to the doctor or they can take any other step?
They can use it against you in a mediation or they could ask the doctor if your activities as shown in the video are consistent with your injuries and stated restrictions.
