The thief on the cross was saved because Jesus forgave his sins. Mark 2:10 "I want you to know that the Son of Man has authority on earth to forgive sins." Jesus had not yet given the command to baptize in His name (Which He did after His resurrection: Matthew 28:19 "Therefore go and make disciples of all nations, baptizing them in the name of the Father and of the Son and of the Holy Spirit"). How could a man be baptized into Christ if Christ had not yet died and resurrected: "We were therefore buried with him through baptism into death in order that, just as Christ was raised from the dead through the glory of the Father, we too may live a new life." Romans 6:4.
Christopher Elwell Sure, sin comes where there is commandment. The commandment that, "He who believes and is baptized shall be saved" (Mk. 16:15-16) came after the resurrection of our Lord. "for sin indeed was in the world before the law was given, but sin is not counted where there is no law." (Rom. 4:15; 5:13; 1 Cor. 15:56; cf. John 14:15, 21, 23-24).
Tertullian best explained that verse,there was a custom among christian to baptize (ritual washing) as a sign of declaring the body will be clean before God , this profession of Resurrection still followed in many christian societies ,for example as i raised a Coptic i learned that when we prey the dead there feet must point to east referring to second coming of Christ and therefore the dead will resurrect facing to him .

The lord knows the hearts of those that have died without baptism and without the gospel. The dead dont need baptism. They need resurrection.

This verse is quote from Maccabees. Which says prayer for dead which was a practice of judiasm was doing. Here paul replaces prayer with baptism.

5:23 "spiritual death"???? that is heresy. Jesus didnt die spiritually, He died in the flesh. That which is life, which is spirit, cannot die.

Spiritual death is not heresy. Spiritual death is the separation from God on a permanent basis.
He doesn't say Christ died spiritually. He says we die spiritually through identification with Christ, which is not heretical, but biblical.
