Also separation of judiciary from the executive is enshrined in DPSP which is only a guiding principal not enforceable in a court of law. Independence of judiciary has been clearly defined and made by making the appointments, salary and other things related to judges independent of the executive. So by common understanding I would infer that separation of judiciary is a fundamental part of the constituition instead of it being dependent on DPSP.
