SLAMABAD: Pakistan Tehreek-e-Insaf (PTI) lost “bat” as an election symbol after Supreme Court of Pakistan (SC) declared Peshawar High Court verdict null and void, ARY News reported.
Announcing the verdict reserved earlier, the three-judge bench of Supreme Court comprised of Chief Justice of Pakistan (CJP) Qazi Faez Isa and Justices Muhammad Ali Mazhar and Musarrat Hilali declared the Peshawar High Court (PHC) verdict null and void.
CJP Faez Isa stated that the plea in Peshawar High Court was inadmissible as a single case cannot proceed in two High Courts at the same time.
The verdict said Pakistan Tehreek-e-Insaf (PTI) failed to present evidence of holding transparent intra-party elections as all political parties are bound to hold free and fair intra-party elections
Earlier, during the hearing, a senior Supreme Court judge on Saturday remarked that for a level playing field, PTI should extend it internally, adding that conducting intra-party elections according to the constitution would have made it the most transparent in Pakistan.
The SC judge’s remarks came during the hearing of the Election Commission of Pakistan’s (ECP) petition challenging the Peshawar High Court’s (PHC) decision to restore the PTI’s ‘bat’ election symbol.
“You ask for a level playing field, you must also give one to your members,” Justice Muhammad Ali Mazhar remarked.
The proceedings of the case are being broadcast live on the SC website and TH-cam channel.
Barrister Ali Zafar is representing the PTI in the case, while Makhdoom Ali Khan is ECP’s counsel.
At the outset of the hearing today, Chief Justice Isa said that the Peshawar High Court had issued a detailed order restoring PTI’s electoral symbol. “The party’s counsel hailed it as an excellent decision,” he said.
Hamid then came to the rostrum, noting that today was the last day to submit the party tickets to the ECP so he would try to wrap up his arguments soon
Justice Mazhar raised two crucial questions whether the court’s jurisdiction and the ECP’s authority to investigate intra-party polls.
PTI’s lawyer, Zafar, argued that neither the Constitution nor the Elections Act 2017 granted the ECP the right to review intra-party elections.
Referring to Article 17 of the Constitution, he asserted that contesting elections with an electoral symbol was a political party’s right, accusing the ECP of discrimination.
Zafar contended that PTI’s intra-party elections adhered to the party’s constitution. “Despite responding to the ECP’s 32 questions in writing, the watchdog set aside the polls”.
Zafar claimed that none of the PTI members challenged the intra-party polls, stressing that the party complied with the 20-day timeframe set by the ECP to avoid exclusion from the elections.
Reiterating his stance on democracy, Chief Justice Isa emphasized the need for democracy within political parties and the country. He underscored the importance of verifying that intra-party elections were conducted, acknowledging Akbar S. Babar’s role within the PTI, even if disliked by the party.
CJP urged PTI’s counsel to either provide the full context for allegations of mala fide against the ECP or keep the arguments strictly legal.
“It should at least be seen that [intra-party] elections were conducted,” he said, adding that Akbar S. Babar was also a party member “even if disliked” by the party.
“Did we appoint them? You all appoint these people. We don’t appoint them,” he remarked, adding that the apex court could “force” the commission to perform its duties but “not take on their responsibilities”.
The CJP told the PTI counsel: “Substantiate if you are taking the angle of mala fide.”
Chief Justice Isa pressed the PTI counsel to substantiate claims of mala fide.
At this, the PTI counsel, Hamid, opted to keep arguments non-political when asked if he was withdrawing the mala fide allegations.

I am in Indian and I was thinking the same. You need a Balla App, which will use location of your polling booth to find out the candidate name, symbol. But the issue is different, military just stole all the women and minority seats, almost 70 seats. Unfortunately Sheikh Rasheed turned out to be a traitor. Otherwise all candidates could have joined Kalam dawaat. One last move can still be done. If a PTI TLP secret deal is done, after elections all PTI people can join TLP and give a shock therapy to Donald Loo.

PTI is still in the game and possible options.
PTI must conduct an Intra-party election immediately and get certificates even though they cannot participate on 8 Feb on the same symbol, but at least, one should resign and contest under the PTI umbrella reserved seats will be lost but the party can be gathered under one platform in National Assembly.
PTI leaders should support at least one seat to the JUI Shirani group in KPK and later join the Shirani party to get their reserved seats.
PTI should collaborate with a small party in the National Assembly after the election and join with and get reserved seats.
. Dasti should contest the election with the symbol of his own party and later PTI should join his party after the election to get reserve seats.
PTI must file an appeal for review but there is a marginal chance for PTI to win in the supreme court led by Qazi Essa.
PTI should make separate petitions for the reserved seats.

Wasted a lot of time to follow the happenings in your country. Today, I wasted whole day & night till now to watch live telecast of hearing in the supreme court of Pakistan.
Feeling truly frustrated to see how a person like your chief justice have / can become a chief justice.!!! He never allows the PTI lawyers to talk. Hearing means he is supposed to hear, but he gives lectures, and scolds everybody.!!!
He was asking the PTI lawyers to provide extra evidences on the most minor technical points, which were pretty evident from the provided documents, & also questioning on absolutely unrelated issues to waste time, while telling, in fact scolding the PTI lawyers not to waste time of the court.
Whereas, he did not ask for any evidence from those so-called PTI members about their membership and involvement with PTI. And unfortunately, one of the main point of his verdict was their (so-called members) complains about not allowing them to take part in the PTI intra-party election.
If PTI applies to review today's verdict, please tell them to raise this vital point regarding the discrimination in asking for evidences by the most biased chief justice, I am sorry to say.
I never make any comment on social media, but felt it as my responsibility as a human being, and a Muslim to express my views as a neutral observer, on today's hearing & verdict of your supreme court, which should be one of the few worst judgements in the history of judiciary around the world throughout the history. What A Shame.!!!!!

I suggest few steps: 1. Make list of candidates for NA and PA and inform the voters by district. 2. Information should be repeated continuously thru all utubers and vloggers. 3. You can also announce the names of utubers and vloggers thru which this information is given out. This is to make sure that wrong info regarding PTI candidates is not given. 4. All candidates should give printed flyers to voters when they go out for canvassing.
