    Help me please . Caretaker cousin took my name off my father and mother will.caretaker cousin got my heir and my parents property.     Clint - If a Nurse in Texas, is considering going 1099 from current W-2 status, is an LLC a good structure for this healthcare focused business? Would the WYoming Manager LLC be a good addition for liability protection? Would the PPT be applicable for this , also, as an addition protection layer?

      Yes, that could work. A TX LLC is most likely treated as an S-Corp for federal purposes, possibly a solo 401k. I do not see a need for WY in this type of structure.

    I am on SSI . Won't SSA or the IRS be able to see I have a Resource in the LLC or Trust ? :\ QC

      Yes I believe you would need to disclose this. I suggest you speak with an attorney who specializes in SSI and benefits before investing to make sure you will not risk your benefits.

      @@ClintCoons Thank You Clint , I have an SNT , it holds the House and Car , but there is only 2 or 3 years of funds left and I'll be 55 this year , when the funds run out I'll have to take the House and car but I do not think I can get a Mortgage because of the SSI , Should I just Mortgage it while the Trust is the Owner ?

    Clint, other than the obvious difference in terms of the type of property held, real or personal, are there any other technical differences between a land trust and a personal property trust (particularly in states that don't have a LT statue like FL)?

    10 year old video. I like the info, but I prefer the Wyoming Irrevocable Real Estate Trust and having a Wyoming LLC Holding Company as Beneficiary, then my LLC for the property is in whatever state where the property resides

    If you own multiple properties, do you need a separate land trust for each property or can you keep adding properties to one single trust? Thanks, great info!

      Separate trust and separate LLC beneficiaries because if a trust is sued then all of the trust's assets and those of the trust beneficiary (except Florida) are at risk.

    Awesome info. Just a quick question. If it's necessary to get a bank account for the llc and the bank can't tie you to the llc as a member or manager, are they going to allow you to open a bank account for that llc?

      You must provide them the LLC operating agreement and EIN letter you receive from the IRS for the entity.

    Is land trust same as revocable trust? Ie can revocable trust own real estate property, be manager of LLC?

      Yes it is the same and it can own real estate but I would not make it the manager of an LLC.

    If you buy property you will not get the loan unless you show income and in most cases that is your employment income as your newly established trust does not have income

    Clint I have a question. At a certain point in American history there were people who's Land Deeds/And Trusts were stolen by way of deception and or coercion. My question is, would it be possible for peoples descendants to be able to get their families property back into the hands of their family?

      That would require state legislation. The statute of limitations for a civil action has passed.

      @@shannonmcintyre1970 I forgot to mention straight up intimidation too and threat of violence. I suspect thr real reason it's so difficult to get the lands back is because they now belong to the sane groups that did this..
      It's like saying the Walmart family doesn't owe anyone reparations. A case c old be made. People don't know what happened to their distant relatives and how their lands were stolen. Do you have twitter and instagram?

    How does it protect you from the gov when they have the technology to find any thing, for example i had a private lender that was affraid to purchase real estate because it would affect his social security disability benefit, how could he purchase property and not losing his benefits or is that possible

    This is so complex and absolutely merits hiring an attorney. But the poor mans way of doing this is to form an S Corp in NV and have it encumber all your assets secured by a UCC 1 filing DONE !

    So I would transfer all my property to Anderson to hind all my property. So what happens if Anderson goes rogue or bankrupt etc? Do I lose everything ?

      No because you are not transferring anything to Anderson - you remain in control and ownership.

    Could a crooked attorney actually take your assets cinsidering this is not recorded publicly and tgia document is held private? I assume the tryst has to be set up first with attorney as the individual who then resigns and onky then tge prooerty is transferred over. But what if the attorney never resigns ?

      Yes it needs to be set up first and if the atty does not resign then you have the ability to remove him as the trustee.

    You say a personal property trust will not provide asset protection. But if there is a judgement against you how will the party know you are a beneficiary of that trust when it's not recorded anywhere??

      They won't. The PPT provides privacy which is a form of protection but if you are brought into a debtors exam and they find out, the assets in the PPT can be reached by the creditor.

    Even with a Nevada llc, one still has to register that LLC in Nevada. Soooooo If u don't live there and u have a Nevada LLC for what purpose? The property you own in the state u do live in? still has to be registered with your state. Meaning: what purpose does the Nevada LLC serve If you still have to register in your state of living? Each LLC cost monies. To have a fictitious LLC in Nevada would be...... for?????? It can't be for privacy. Why? Because you still have to register your property LLC in the state you have PROPERTY!!!!

      If the LLC owns the real estate then you are correct but many strategies involve having a NV or WY LLC own other LLCs holding real estate. This provides anonymity of ownership for the state specific LLCs. The NV or WY LLC would never own real estate directly in another state otherwise you are correct and this would blow the entire purpose of the setup.

    Do you go over wills? Can I write a will myself, and give it to a relative? Will my landlord and my bank hand over my property to the designated person on my will that I write myself??? Can the will be notarized?

      Any will you put together will need to go through probate. I would not recommend you create your own will.

    I need to know ..if i open the bank acct with ssn then put that acct into a TRUST will the bank remove the ssn so upon and search for assets by ssn the TRUST wont be found.?

      If you obtain an EIN for your trust then you could use it for the account over your SS #.

    Doesn’t the “do not use a nominee when establishing business credit” problem apply equally to just opening a regular business checking or brokerage account? The SOS website only shows your trust as the managing member if you’re in privacy mode, so why won’t the bank or brokerage make the same assumption you said a creditor will make, that being you just printed a fake operating agreement showing you are an officer?

    If i put my bank account under PPT and I am a trustee then judge can force me to revoke it or make my opponent become an owner of PPT. I don’t understand how PPT would help in this case. Please explain.

      A personal property trust does not offer asset protection it's only designed to protect your identity. So yes you can lose your account to a judgment.

      @@ClintCoons if I provide the bank with the copy of the trust agreement, then does that give the entity suing me a way to find out what are my assets in the bank? If they just know the name of the bank that I bank at, can they discover my assets?

      What about the evil people who sue without grounds, just to clean you out? And it costs $100,000 for a lawyer to defend you, when you have done nothing wrong. And you don't have $100,000. How about that?
