Why would Tom need to sue after the insured in the split limit coverage when after he used up the $25k he additionally went to the $50k under “all Damages the” the insurers would pay.??

What if one of the passengers has a medical implant that is damaged and needs replacing? Is that a bodily injury or a property damage?

It'll pay under medical payment if its on the insured policy (must have medical records showing the implant was damaged in the accident). If there's no med-pay, it'll be paid under BI.
