@bonbonjovi4836 In a case like that, they can determine who's at fault. You didn't need a dashcam for that. They can actually find out who has a green and a red from the traffic lights themselves.

I almost got myself into a similar situation. I was going on a one-way street and about to turn right on another one way street. Usually most people only look in the direction traffic is supposed to be coming from. Fortunately, this time I decided to look down the road in the directional traffic before I moved off and was surprised by finding a guy reversing backwards going about 15 MPH on the one way street. Had I made my right turn and he backed into me he could have easy lied and said I rear-ended him. This is why dash cams are important.
As soon as the plaintiff started her story off with unnecessary information (going to put money down on their wedding venue) I saw her as a manipulator. Then the "salami" remark showed me that she is immature also. The defendant is disgusting in that he lies for sport and expects everyone to believe the unbelievable.
Good afternoon PC fam. I actually had someone back up into my car in a similar situation. Fortunately, he owned up to his actions and I didn't have to go through anything more than having the car repaired.
This happened to me, sorta. I was behind someone else at a stop sign when out of the blue they went into reverse and backed into me, slightly cracking my bumper. I was alone, he had two witnesses in his car. I didn't have a dashcam at the time and didn't think anyone would believe he hit me, instead of me bumping into him. So I shook him down and demanded cash in hand. He gave me a couple hundred bucks and we parted ways 😅 I never fixed the car (it wasn't super noticeable).
I like it how Harvey at the end says that judges in small claims courts are allowed to use common sense. It implies that in regular courts they are not allowed to...which is sort of true. They have to rely on expert witnesses, stricter procedures, and the epitome of anti-intelligence - juries.
Good call judge! But its asinine to think that just because the accident wasn't "straight" and only at the corner of the vehicle means that it couldn't have been a rear end. You can rear end people turning and damaging just the corner of your car.
From where the damage is at. I could believe they were making a turn and hit a car. If he bagged straight back more than likely it would be to the front only not the side 🤷♀️ those plaintiffs seem like bullies. Judge talks so much she don't listen to any reasoning outside of her head. Either could've been right.
That’s what they say and I say different… If I was rear ended and got told by a judge I was wrong that is nowhere close to how I would phrase it. I would be upset that I KNEW they had rear ended me.
Some years ago I was driving a company van. I stopped at a red light. The car in front of me stopped where the front end was in the crosswalk . Then all of a sudden the guy put his car in reverse and backed into me. Causing damage to his vehicle. I told him not to move his vehicle. I called the police. He said I rear ended him. After the police questioned him a bit he admitted he backed into me.
That defendant is a hard ass and a terrible terrible liar. I could tell he was lying from the start of his testimony. Tsk tsk old man. Pay up for being impatient
I hate that one can’t get the cost of repair to actually repair the harm, that it’s restricted to the blue book value. Many can’t afford a new car and repaid is steep, so to become whole, one truly needs their car repaired.
If you notice, in the 1st picture the defendant showed the Judge, her car is still sitting over the crosswalk where she depicted in the drawing on the board.
I'm an insurance adjuster and have to do this all day everyday. We have to determine fault and more often than not it's like this where both people are describing totally different accidents and someone is blatantly lying. GET A DASH CAM!!!
Like some have commented GET A DASH CAMERA. No joke I know someone that didn't have one for a long time and then decided to buy one. The very day he installed it got into a car crash $8000 in damage other party said it wasn't their fault, but the cam proved them wrong. He spent $200 on the cam. Do yourselves a favor and get one; if you have one keep up with it.
Def 50/50 . Plaintiff had enough time to see defendant stop and wait to honk her horn. I believe defendant was def backing up. Plaintiff failed to take evasive action and defendant failed to maintain proper lookout. Also 60/ 40 Just my opinion
Have been a driver trainer including whats called defensive driving. What the Plaintiff did what pretty on the money for what I trained people to do. Taking evasive action in the position she had the car in rounding the corner (cause remember she didn't see the defendant very dangerously reversing till partly round the corner) would highly likely lead to an impact on the much structurally weaker passenger side (where remember her fiancé was sitting) as the defendant was reversing at speed (the photos of the damage show its a fairly high impact collision). Stopping and having your engine between yourself and the oncoming vehicle collision are the best safety practice a driver can do as it massively reducers the physical forces involved - 2 moving vehicles hitting each other have much more energy displaced into each object than if only one is moving. Also any evasive action places the car into the middle of intersection where other vehicles are likely to be moving through, and its just not humanly possible for a driver taking emergency action to scan property for these other potential collisions. Stopping quickly and sounding the horn was the best action for keeping harm to the lowest possible. The Defendant was entirely at fault, both in law and defensive driving technique.
This is why the reverser needs to look when reversing. Uhaulers or commercial drivers reading this, use extreme caution and take your time backing up! Everyone else use mirrors and camera if applicable!
The reverse bulbs would have distended filaments or be blown by the impact of his backing up. He is not spacially aware proven by needing to be turned around by Doug Llewellyn so misjudging his reversing distance is understandable.
What a horrible liar lol. I've been there, someone did this to me, my Traverse (what a coincidence) was 18mo, a young man at the stop sign decided to put the reverse without checking behind him, I started honking and I immediately started reversing too to avoid him hitting me, but I got a bit panicked bcz I didn't want to hit others on my back in case they were coming behind me. That didn't help, he hit me with 4 mpr. I started recording the whole thing, he offered me $100, i said no, police wouldn't come for a fender bender accident. I got all his info, went to the police station filled a report, went home i called my insurance. The adjuster called me back, and he said that the young man said that he indeed backed up on me. On the first call the adjuster wished me luck to prove that the guy backed up on me, but I did tell him that I have a video offering money to me, and pictures that the young man was looking only at me vehicle for damages and not his, as if I had hit him, we all were going to be looking at his vehicle.
I know exactly where this intersection is and I will say this there is no way you're going to get 7 cars in there when the gates are down unless they're 7 golf carts. When those two maples are in bloom on the corner of the train station parking lot and the west end of that lot is full of cars from commuters you can't see what's around that corner when you're coming from the east. That's a no turn on red intersection so I've seen it a lot when people are westbound and the light is green or yellow and someone takes that right turn too quick so they don't have to wait for the red light on to West Ave (not street) from Division St. then realizes " oh s$#@" there are 3 cars already there and swerves off to the drivers side of the car in front of them. If you see how the bus is positioned behind the white car on the bend it kind of paints a picture of how it can go. A lot of accidents happen there.
