I also noticed a father-son dynamic between Brian and Justin, at least in the first 2 seasons. If you remember, Brian called Justin sonny boy in the 1st episode, and the morning after their 1st night he also mumbled to himself that he had two babies. Even though he kept insisting Justin was not his responsibility, Brian really took being responsible for Justin's wellbeing seriously.
I don’t think you can sign away your parental rights before birth (that might have changed with surrogate situations), so that is probably why it wasn’t settled ahead. I also think Lindsey offered Justin the ice cream to distract him while they talked to Brian.

Ohh okay that could explain it then! - would have helped if they'd at least come to a clear agreement to each other beforehand
