Constitutional implications of John Hlophe's JSC appointment

  • The Western Cape High Court is hearing an application challenging Dr John Hlophe's appointment to the Judicial Service Commission. DA federal council chairperson Helen Zille says the appointment of an impeached judge to serve on the JSC presents a clear conflict. Prof Pierre de Vos looks into the constitutional implications of the appointment.

    Clearly, DA is worried about MK Party. I just wish, Helen can also be mindful that MK party can take over South Africa in 2029. So the fight with this new Party should be objective.

    One person CANNOT taint the JSC but CRAFTING a law simply to prevent him sitting in the JSC will haunt the entire legal and parliamentary system of the country!

    When I gave MY TAKE on this issue about 4 weeks ago, AI didn't receive a single negative response. And so I'll repeat what I've stated then: 1. the National Assemblée is an autonomous and independent organ of state with its own INTERNAL RULES; 2. and so the ONLY impediment to this appointment can only come according to the INTERNAL RULES OF THE NA; 3. SA is a democracy with SEPARATION OF POWERS and as such NO OUTSIDE AUTORITY can intervene with regard to the INTERNAL RULES OF THE NA; 4. Dr. JH WILL NOT.....I repeat: WILL NOT appoint any member of the JUDICIARY: HE along with at least TEN other NA members will make RECOMENDATIONS after having heard candidates. The INTERPRETATION OF THE JOB BY DA is totally(maybe deliberately!) OVERBLOWN and OVERRATED. This is case deserved to be declared: non-receptive(niet-ontvankelijk). The WC has NO JURISDICTION over appointments made by the SA NATIONAL ASSEMBLEE........Period!!!

      If he can be a MP why can't he sit in the JSC? A former convicted criminal is Sports minister (executive member).
      So Hlope can be president and not interview but appoint judges.

    Separation of powers is not optional. It's a bad look for the JSC, but there's no legal issue here.

    Funny thing is you guys had no issues when politicians who know absolutely nothing about the law or being sitting on the same body and here is a man who knows what to look for in a future judge and you guy are making noise not because he is unqualified but based on his political affiliation. Most of you don't even know why he was impeached nibanga nje umsindo .

      He was impeached for Gross Misconduct, ie improper interference with fellow judges regarding the prosecution of the looter-in-chief, Jacob Zuma.

    Little trust left - selecting judges is not abt the most competent pson for the job. It deteriorated into a political proccess + platform where those with anger issues + dubious records vent frustrations iro the lack of political party + personal growth.

    The Prof was very Balanced however the channel is despicable when it came to the facts about Hlophe, not starting at the beginning.. He was the first in everything, Cambridge, PhD, etc

      He was also the first to sway the judiciary in favour of Former disgraced President Zuma. That's why he was impeached. He was found to be rotten.

    Nonsensical application by DA and its allies. JSC recommends, not appoint. Parliament (democracy) chose Hlophe to be in the JSC. Those fruitless applications must fail.

      If this is irrational then was it rational that De Klerk served as deputy President to Mandela while he was president of the Apartheid government while apartheid was declared as a crime against humanity.
