    I enjoyed the video blog you recently posted about how to get out of a ticket. I frequently drive alone late at night and was curious if there were any pointers you could give me regarding unmarked police cars. Are there distinguishing lights or anything like that I can look for and be comforted that it is a legitimate police officer who is pulling me over? What actions can I take to insure my safety when getting pulled over at night in deserted areas?

    i was pulled over by an unmarked car and did just that. called 911 and told them i was going to a better lit area. the unmarked officer was furious and verbally threatening. i walked away with an apoligy from the sargeant in the area. NEVER EVER TRUST UNMARKED POLICE CARS. EVER

      Yetifacekilah typically it vary state-to-state but more often than not unmarked cops cannot stop you. That's for the sake of the public safety. But like everything else with law enforcement they don't have to follow the rules.

    Well, here's the thing. Cops are allowed to lie their ass off in order to incriminate you, and it's a crime for YOU to lie. The best option is to keep your mouth shut, or simply reply "I don't answer questions." You are required to show driver's license, registration and proof of insurance if you are in a car. Roll your window down an inch only. Record the interaction using an app that uploads it to the cloud immediately in case the officer illegally confiscates or damages your phone. Do not offer information. Repeatedly inquire if you are being detained, if you are free to go, and ask the officer if he can articulate a crime he is accusing you of. You have rights. Don't give them up freely. Tell the officer he is being recorded. Be matter-of-fact, but not belligerent. No matter how friendly a cop seems, he is not your friend. You can incriminate yourself easily. Exercise your constitutional rights. Be aware of the law. Defense attorneys are constantly struggling to defend people who threw away their rights by conversing with police and damaging their cases. sometimes irreparably. I am not a "sovereign citizen," in fact I am a Democratic Socialist. We are facing an ever increasing police state mentality in the USA, driven by the 1% plutocracy who want to keep us down by owning the centers of power.. Fight back!

    I understand that you must comply if an officer demands that you get out of your car at a traffic stop, but aren't they required to state the reason why they pulled you over and the reason for requiring you to get out of the car? Since getting out of the car isn't normally required for a traffic violation, isn't there an additional reason, above the initial reason for pulling you over, for an officer to demand that you exit the vehicle.

      Mike Sapp I think it's bullshit Mike. I see that the federal socialist government sells their AV's for dirt cheap or, most of the time give them away via a bid. I don't believe that the officers feel militarized. I think the media and government is making it cool and popular to blame the police. To challenge authority when most cops just want to go home, most cops don't want drama and besides the rookies don't want to take someone's civil rights away. Most people don't realize that everything a cop does is picked at with a microscope by the upper management and that you're only a heart beat away from being suspended or fired because something shows up on the news of TH-cam. The media has been dehumanizing the police for a while. We forget that they are humans just like us that want to collect a pay check, pay their bills, love their family and take a vacation. Yes there's bad cops, I would say 10% or just an embarrassment to law enforcement but most of them I believe truly want to help people.
      Many people don't know that there is so much paper work that goes in when you arrest someone. Back when I was a cop 2006 and prior it was 6 pages minimum, who really wants to do that for some bs. It wasn't me. I challenge you the next time you see a cop see if they'll sit down with you and just talk with them. They're not out looking to screw anyone, they're looking to go home and get a pay check.
      With all those words from me I think the media is 100% controlled by the government and special interest groups. In other words is propaganda that they want to keep brain washing us into believing the world is bad, people are out to get us and vote for an idiot that lies to get into office then does what makes them a paycheck. If we should be angry at anyone it should be our socialist government and their lies.

    If there is no reasonable suspicion, I don't think it is "constitutional" as you say to have to get out of your car just because you are ordered to do so. You shouldn't have to do ANYTHING without an attorney present -- certainly no more than hand some ID through a crack in the window or eve just hold it up to a closed window.

    My brother just finished law school here in Texas and he told me that it is proper procedure do call the police department and have them authorize that it is in fact a police officer behind you signaling for the pull over. Anyone can go out and buy a police uniform outfit and put lights on their car!

    Hey Brian, what do we do when cops stop you and say you are driving over the speed limit?
    I was actually driving my Mustang GT (RED) towards my parents' cabin in North Georgia between 70 and 75 miles/hr and I was stopped and told I was driving 87 miles/hour. The speed limit is 70/hr and I told the office I was driving less than 75/hr. I had 2 extra witnesses in the car with me and the cop didn't like it! He took my DL and started interrogating me why my DL was just for one year. Then he goes to his car and comes back stating that he could take me to jail for Super Speed. I told him I was aware of Super Speed and he said he lowered my speeding to 85/hr so that he wouldn't take me to jail!
    I have heard that Cops on I575 are very corrupted and for years I have been driving to the cabin on that road. When I got my mustang about less then 2 years ago, I realized that cops have been targeting me more than before and don't take me wrong, I have been driving slower than the Dodge caravan I used to have! What do I do? I was nice, cooperative but he still wanted to put me down and intimidate me!!! I got the ticket and I had to pay for it because it is useless to fight against this!
    Any thoughts on this matter?

    PS. Instead of feeling protected, I feel they are terrorizing citizens around because of their position. I pay my taxes so that we can be protected and this is what we get: INTIMIDATION!

      The officer isn't required to show it, nor are they required to show the speed on the radar. That's why you go to court and fight it. Make them bring the gun, calibration report and have the officer clearly describe where they were. Pull images from Google earth and take your own pictures where it was listed on the ticket.

So we can pay thousands of dollars to a lawyer to defend us against something that we didn't even do and you guys God damn well fucking know that we didn't fucking do it. And then that lawyer we've spent thousands of dollars on isn't going to do anything but sit in a room and bullshit with the prosecutor about next time that they playing to go play golf and then the prosecutor is going to tell him what he thinks his client deserves and then the lawyer isn't going to fight for you whatsoever because they're Buddies. The lawyers going to go out and tell his client what the prosecutor is going to give them and then the typical American just boughs down and says okay I guess that's fair even though I didn't do anything wrong. Then he has a possible arrest record some things on his record because it's not going to be thrown out because the prosecutor doesn't care about the law or his oath just like all you crooked ass cops. So now the guys on probation has to pay more money for fines Etc

    @Manny4Realty Department policy covers that. Many larger department will not allow emergency equipment in personal vehicles. I can pretty much tell you that using your personal vehicle in the field would be prohibited by their policy. There are very few places around that allow use of personal vehicles in the field, and most of them you have to provide your own insurance. Having the lights and siren in a personal car also has to be declared with your insurance carrier.

    Look up the laws in your state in some it's actually illegal for an unmarked police car to pull you .. They have to have identifying characteristics plainly seen AS a police car ! Lights not hidden, tag , stickers , etc , something that plainly identifies it as a POLICE car .. The stop is invalid as the officer himself is breaking the law making the stop with said unmarked vehicle.. See if your state has this law ..

    Correct me if I'm wrong, but I do not believe there is such a law (or constitutional declaration) "That requires you to get out of your car." In fact, I'm quite certain that license, registration & proof of insurance are the ONLY things required. I applaud Brian P Cook for the instruction on how to behave during a stop. With his recommendations, I'd be hard pressed to think of any reasonable suspicion that could arise. If you politely exhibit you are exercising your rights, you SHOULD be okay...

      Let's say I (as civilian) am on my way to the hospital with my pregnant and in labour wife. And bozo the clown here (sorry, police officer pretending to be a civilian) attempts to pull me over for taking some liberties with the rules of the road.
      Guess who'll have a fist in his face with malicious intent, merely in order to continue on my already urgent way to the hospital.
      Two guesses what any judge will say about that ?

    Thank you for a good advise blog. Many on here give bad advise or forget that standards and laws very from state to state and even city to city. There is no national standards on police cars or even unmarked cars. But, anyone who is give advise should also consult an attorney in there area as well.

    Thx Brian for you're help, I was pulled over by a unmarked police car in Goodyear, Az in May 2014,I drive a full size dodge ram pickup, the cop that pulled me over was in a small unmarked car, apparently he was trying to pull me over behind me I don't know how long or how far He was behind me for I could not see his lights which were on his front LOWER grill, He did not have lights on that were visible to me. I noticed Him when he pulled over to my left , I then pulled over to the right lane next to me still not aware that He was pulling me over for I was legal. had tags,ins,was not speeding, to my surprise He pulled over behind me, I pulled over to the next lane He followed behind me turning on his sirens only then did I know that He was pulling Me over,I slowed down then lowered my window and singled that I was pulling over, I puled over at the nearest turn to get out of traffic ABOUT ONE EIGHTH OF A MILE for safety concerns. He claims that I should have puled over immediately,I explained to Him that I did not FEEL SAFE STOPPING WITH ON GOING TRAFIC, He said He was following Me for a while ,I explained to Him that I DID NOT SEE HIS Lights , He gave me a ticket for no seat belt, I was not wearing it MY BAD,He then gave Me a ticket FOR EVADING AND NOT STOPPING, THIS I have a problem with . BRIAN WHAT ARE YOU'RE THOUGHTS ON THIS, THX FOR YOU'RE RESPONSE.

    True story: If an unmarked police vehicle tailgates you, and you speed up to get away from the tailgating vehicle, and the officer gives you a ticket for speeding, you can go to court, get the officer to reluctantly admit the distance at which they were tailing you, win the case, and have the judge scowl and ask to see the officer in their chambers after the trial. That happened with my family... though the cost of hiring a lawyer was slightly higher than the ticket.

    Happened to my Mom, unmarked car freaked her out she called 911 and asked for another Cop. The female officer responded. The two officers were nice and only wanted to fix her plates but the unmarked car freaked her out.

    I agree that being polite to police is great idea. Also remember they also protect people.(Yes they have protected me from an enemy.) There may be some corruption but don't fight with them. The second is don't start trouble with them. (often I find on youtube videos where people just start the trouble) Third your only required to show driver license, registration and insurance when they ask for it. Fourth thing is that you don't have to answer the question. The Police officer might ask why you don't want to answer my questions. Stay calm and say I don't want to answer any questions. The fifth amendment gives me that right. But the best idea is just to follow what Brian says in the video. If you don't feel comfortable get a lawyer.

      I was polite to them. However, after I beat 5 illegal parking tickets, they were not so nice to me. I had to take them to Superior court. They did things like remove the hearing officers name from the paperwork so he could not be reached. Eventually, they decided to change thousands of parking signs because of me. They would issue tickets at 8:30 a.m. but the street sweeper would show up hours later. I had a meeting with the brass, and they changed their system. They actually had tickets reprinted to make them less clear. I pointed that out to them. They were reprinted again. This town is majority Spanish. So they were taking advantage of immigrants not familiar with the system and unwilling to protest. It was a huge rip off.

    In 1977, the Supreme Court ruled in Pennsylvania v. Mimms that a police officer can legally order a person out of a car, the person is obliged to comply, and the 4th Amendment is not violated. Under these circumstances, an officer may legally perform a pat-down for weapons without probable cause, as he is not searching the subject with the goal of identifying something illegal, but rather to ensure that his safety and that of the public is not at risk by a potentially armed subject. Look it up.

      Brian P Cook Hey Brian, do you happen to know the laws regarding volunteer police officers? I live in the rural south, in a county of just under 5000 people. My town in particular has less than 150 people. Our county is not able to pay many full time police officers. The Sheriff and his 1 Deputy are the only paid cops on the Sherriff's department. Besides that, our county seat only has one city cop and two state troopers that are never around. Due to this, our county depends on 3 volunteer cops who have not had any type of police training. They drive their own vehicles, pay for their own gas but have lights on in the grills of their vehicles. One drives a Dodge truck, another drives a Trailblazer and I am unsure what the last drives but none of them look similar to police vehicles. One of these volunteers I have known (from our community) all of my life. He is around 50 years old, has never moved out of his mom's house and he is not all there in the head. He was on the volunteer fire department his whole life and never really had a real job until about 4/5 years ago for a brief stint at a nearby jail. He got fired for taking pictures of nude inmates. Needless to say, he's a volunteer cop now and he harasses me because he knows I have been arrested for pot before lol. I never ride dirty in my car, but he always finds some bullshit reason to pull me over. The last time I just happened to be in an area where he was looking for someone who stole a four wheeler (which didn't give him any right to flip his lights on me; I drive an impala and there was no fourwheeler around). Since he's a volunteer, he just tells me to stay in my vehicle until the cops get there. Every time they get there they ask if I will let them search, I always decline, in which they have to call in a drug dog from 3 counties over. This takes a couple hours before the drug dogs get there, in which (for some reason) the drug dog always hits on my vehicle. So every time this happens (which is about once a month or so) they treat me like a criminal, until they find nothing in my car, and let me go. THIS HAPPENS OVER AND OVER AGAIN. Plus the same guy follows me to the gas station all the way back to my house and everywhere else I go. I definitely think he may have the potential of being a rapist but I'm not worried about that because I have my concealed weapons permit lol; but the point is this dudes really weird. What I'm personally worried about is them harassing me. They never find anything in my car, but keep searching me over and over again because the dogs hit on my car. By the time it's all said in done The sherrif, his deputy, two or three volunteer cops, and a few out of county cops with drugs dogs standing around me talking shit for 3 or 4 hours. I have no choice but to sit through it all.
      Sorry about this long story. My question is do I have to wait for police, if a volunteer cop with no training flips his lights on me for doing nothing; not committing a crime or going through a road block? Especially since he is in a civilian car and he is as weird as this guy is?

    2 times I have had unmarked cars, trucks actually, flip the lights on me. One was a blue chevy silverado and the other was a green jeep grand cherokee. Both on the freeway. Both times I called the police and told them what was going on and made it very clear that I am not running but I will not pull over until a marked car shows up. Both times the vehicles backed off and I went on my way.
    I will usually pull over, even for some unmarked vehicles, but these 2 just did not seem very typical and I wasn't taking the chance.

    The only reason I can see for using an unmarked car by law enforcement is if there is a warrant to be executed. If pulled over by an unmarked vehicle, especially if you are a female, and the cop does not have a numbered badge, radio, uniform, etc. then call 911 and report that you have been pulled over by a suspicious vehicle and leave your phone on. Tell the cop your concerns and notify him that you have called 911 and want to wait until another officer arrives. If they are not legit, then they will likely take off.

    #1 THING TO DO IS PUT YOUR HAZARD LIGHTS ON!! If you get pulled by an unmarked police car and you want to wait 'till you are in a heavily populated or well lit area before pulling over, then you should put your hazard lights on and drive slow until you reach a safe area. This lets them know you acknowledge them and are not trying to flee.

    I never get speeding tickets because I always set my cruise control to 1 mph UNDER the posted speed limit.
    That way I'm guaranteed to NOT speed, NOT get speeding tickets, AND to almost always PISS OFF everyone else on the road who is lined up behind me for miles. (I always drive in the right slow-lane, ALWAYS.)

    At that point, I would be more concerned about my own safety. Opening the door might give him chance to look in the car or attempt an illegal search ("Sir, you look unsteady, have you been drinking?")
    Start by putting the police officer at ease. Pull over to a safe place, turn off your ignition, stay in the car and keep your hands on the steering wheel. At night turn on the interior light. Keep your license, registration and proof of insurance close by.

    (cont)... The reason for this is officer safety. By removing a passenger from a vehicle, the person is denied access to any possible weapon that may be in the vehicle. If the passenger or driver chooses not to exit the vehicle they can be placed under arrest for failure to comply to an officers order. If the individual then challenges the arrest in court the officer has to prove there was an imminent safety threat. I am not talking about fishing trips I know there not allowed without cause.

    You left out the most important thing about getting stopped by an unmarked police car, which is that it's illegal under normal circumstances. Unmarked cars can only legally be used for undercover work, surveillance, or sting operations. They are explicitly prohibited from being used to make routine traffic stops, precisely because of people like the "blue light rapist" you referenced.

    "The officer does have to prove imminent threat however." Citizens have no duty to cooperate in a police investigation including their right to remain completely silent from the beginning. If the occupants open their doors, that can be construed as granting permission for a search of the interior of the vehicle, limited or entire. If the police tell you that you are under arrest, then all of the above is possible to them, including a search of the person or persons. No "fishing trips" allowed.

    Anyone who has a driver's license and has driven experienced dealing with an arrogant, power trip police officer. There are those who take their responsibility for granted and allow the title and not the job itself to go to their egos. Honestly, if he is trying to give insight on how to deal with them, then I am all for it. Arguing and threatening them do not help. It will just cause you get a lawyer who will charge you a hell of a lot of money to get you out of the situation.

    Hi Brian, Thank you for your service... I am a US Navy Vet and carry a CCW permit in the State of Louisiana. I am planning to drive one of our cars to California to visit friends and family and will be meeting my wife and daughter there at LAX to pick them up. I was wondering if you know the gun laws as it pertains to traveling outside Louisiana on the 10 freeway through Texas, Arizona and on to California.... Do i need to find out the laws in all the states I will be traveling through to comply or are there federal laws protecting my right to carry throughout my destination? (Precipitation Laws) and then once I am in California do I need to worry about carrying the gun with more than a 10 round capacity like a S&W shield keep locked in the trunk or is it ok to bring my 16 round XDM and can I bring more than one? I feel i need to talk to an attorney jsut to travel??? what should I do? Thanks Dan

    We had a situation in Hawkins Co TN a few years ago where a thug had gotten hold of a flashing blue light and was pulling people over in secluded areas at night, and only women traveling alone at that.
    I don't recall whether they caught him or not, but it stopped after the news got hold of it.

    My mom every once in a while tells me about how she and her friends were just cruising around after a party when they were younger. A police officer turned his lights on after noticing a burned out tail-light. My mom and her friend (the driver) had heard stories of rapists (mentioned in the video as well) pulling women over. My mom's friend just floored it to get away. My mom said that they should pull over but the driver didn't want to. Turns out it was a real cop (a very VERY angry one at that

    Cops don't always have a legit reason to stop someone. I got stopped a while ago and I showed my ID and insurance papers. I was not speeding; did not go through a red light. I kept asking the cops why I was pulled over and it took them nearly 20 minutes to finally tell me that I had a broken taillight lens. That lens had been broken since before I bought the car, six years before. The hole was only about the size of the diam. of a pencil. What a waste of all of our time.

    Personally, I would never agree to appear on the citation date. I'd inform the officer that I will not be able to be in court on that date and will have to request a continuance. He may then have to alter his own schedule to a date less convenient for him. A citation might then become a warning.

    Alternatively to everyone saying be a pain and make it hard for marked cars to protect your rights. Maybe instead of acting suspicious by only rolling your window down an inch or just giving them your license and registration and saying nothing else try asking them how their shift is going. It works wonders. They are there to protect you and while some of them are corrupt most of them are good cops just trying to do their job

    The Supreme Court has stated when the officer feels there is possible danger to themselves or the occupant in the vehicle they can order the occupants out of the car and the occupants are required by law to do so. The officer does have to prove imminent threat however. If an officer orders some one out of the car you are asking for trouble. They will then draw their guns on you and drag you out. Being a jerk to the police is not a smart thing.

    Traveling (by any means) is a right, something anyone can do with impunity.
    Driving is a paid commercial activity, that can be regulated by the state. We are fooled (tricked/lied to) into believing that we need a drivers license to travel.
    It is this that I have a problem with, when it comes to police officers. They are not told the difference.
    If you are traveling to work, you are not a driver. If you are a taxi driver, then you are a driver.
    The police need to learn this.

    Sign nothing, stand under nothing or you are admitting guilt. Police officers need to be aware that they can and will be held accountable for any trespass on you for any reason. They will be served and made to attend court as a man. No lawyer can speak for you in there, and you better have some proof you did not trespass on someone. Its called COMMON LAW and it hasn,t gone away. Not all of us are legal, some of us are just men and women in our private capacities.

    For those in Ca when getting a speeding ticket, you are as good as done deal, guilty, will never win your case no matter how you fight it. The officers always come prepared to court putting shits on you that the judges will not even wasting times to reconsider your fights and reasoning. Might as will plea no contest and ask for discounts on the tickets, might saved some money. Only way to win is that the officer died, sick or have an emergency that day and don't show up in court.

    Years ago an unmarked car pulls a women over he's a State Trooper, Shortly thereafter the women is found dead, her head bashed in, The Trooper cannot account for 45 minutes of his time, Case never solved but figure it out, This happened on Wellsley Island NY.

    I have found that if your polite to the police officer, there's a good chance he will let you go....many police officers do experience drivers who display "annoyance" towards the police officer who in turn find it justifiable in writing up a speeding ticket. The rare times I've been stopped by police, being polite to him almost always tells him that he's dealing with respectful citizen and thusly lets the driver go!..problem solved!..

I dont mean he killed her with no good reason and then claimed she was a gun slinger, he murdered her and dumped the body in a canyon. A female student later made it a pooint when pulled over to go to a well light transited area, the cop was pissed and told her if he wanted to kill her he woudl just do it.. this doesnt not give us much confidence

    Here's a question for you Brian... I preface it by saying that I like what you say... I would never want to live in a place without law enforcement... Now the question is.... Why doesn't a department, be it Police, Sheriff, State, etc get rid of rogue officers? You get a THUG (No offense to all the good ones) and people in power can't help but know this, he/she goes overboard, and the tax payers have to foot the bill when they lose a law suit? I am personally and financially responsible for ALL people who work for me...       MrHasbeenracer I can only speak for my time as a Military Police (USMC) and Memphis Police Department. I testified against an officer for excessive force and I worked some of the roughest neighborhoods in the city. I was a cop to help people, period. That meant if a cop was breaking the law then I wasn't going to tolerate it. I would say that 95% of officers I KNEW did the same thing. One thing I realized in my neighborhood I had to be fair, just and have creditability with the citizens. My reason is I wanted people to treat me like I treated them and also if I was ever getting my ass kicked I would hope a citizen would help me. Before I left MPD in 2006 I believe 8-10 officers were either fired or under investigation for committing crimes and I know the FBI was working undercover to get the bad cops. Remember that doesn't really seem news worthy to the press so we don't hear about it.

    Cops do not have the right to break constitution. I am a police officer and I maintain a knowledge of the constitution, local, state, and federal laws as well as case law. I know that a large majority of police officers do the same, although maybe not to the same extent as I. I agree that the rest of the officers whom do not fit into the category as enlightened should not be police officers. With that said, citizens not enlightened should not be citizens.

    You knew the job was dangerous when you took it. It's not my job to make each and every officer feel safe when they pull me over. It is however your job to soldier up and accept the risks while treating citizens with respect and observing their constitutional rights that your swore to uphold. If the job is too stressful, if you can't handle the paranoia of the unknown, then find another job. Don't take your fears out on citizens that is just making matters worse.

    Wrong! DO NOT sign a ticket if it is not correct! Signing a ticket IS, I repeat IS, an admission of guilt! If you sign the ticket, YOU are admitting that everything the officer has written on it is true and correct. This includes your infraction! DONT be fooled by this. Also, cops DO NOT need a reason to pull you over, this is called "probable cause" when pulled for no reason. That is law here. Put both hands out window so cop can see them before he gets next to your car, not the wheel.

    Many years ago when we lived across the street from a high school on a Friday (football) night like always there was no parking. My wife would get off at 9 & have no where to park so I would block a space in front of the duplex for her.
    Long story short, private security showed up since a scene was in the making with a couple dudes who wanted to park there.
    He asked for my ID & I really didn't want to give it to him. Here I am on my front porch & this security dude (he wasn't carrying) is wanting identification?
    Is the public required by law to obey a security officer the same as a law enforcement officer?

    First, the North Carolina Supreme Court affects nowhere but North Carolina, and therefore its interpretation of the law is, on a national scale, irrelevant. Second, there most certainly is a constitutional amendment giving officers their powers - the Tenth. Since this amendment declares that those rights not directly stated in the Constitution are delegated to the states, the states have individual permission to allow officers whatever powers they wish.
