The difference is that if Kaepernick were to sign the waiver he would be signing away any all rights to arbitration for himself and further generations, against the NFL. So not only was he not guaranteed the position but when they do deny him the position he can't pursuit any further litigation against the NFL. Also the NFL didn't want the media allowed so that when they denied Kaepernick his opportunity to play they can control the narrative by saying he wasn't good enough. This was shady by way of the NFL.
