Thank you, Brian & Glenn. This is the most in-depth and inside look at this case I've seen anywhere. I thought Marco really outlined each side's argument well. I hope to God his team is successful.
The constitution mentions the word office, but more importantly, it is part of the oath Trump took. "I do solemnly swear (or affirm) that I will faithfully execute the OFFICE of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States." When you want to pause that same constitution, and not help with the peaceful transition of the Presidency, which is also covered in that same constitution, then you are not preserving nor protecting it. This is a slam dunk. Section three of the 14th amendment talks about insurrection or rebellion against the constitution itself, which is precisely what Trump engaged in to try to cling to power.
Furthermore, if the President wasn't an officer then how does Impeachment ever apply to a President. Yet they don't argue that you can't impeach a President. In fact, they want to impeach Biden all the time.
"Article II, Section 4: The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors." It literally says that the President is an Officer here in the first sentence.
One thing that has not really been mentioned and it speaks to the hypocrisy of Trump as his enablers. First the portrayal by some that Jan 6th was not violent, and no one could have foreseen the attack on the Capitol. If this is the case then how did Trump somehow have the forethought that 10000 troops needed to be offered? There has been no evidence that this ever happened, but if part of the plan was to invoke the insurrection act, then pre positioning those 10000 troops would be needed. it would be a terrible look politically to have the military supress any civilian protest, especially as the protesters were Trump people, so this idea obviously needed to be shelved. The schemers knew that it would be far better to delay the count in Congress, hence Grassley presiding over the count because Pence wasn't expected to be there. Pence doing his constitutional duty threw a spanner in the works. Trump knew of all of these plans and has been throwing everything against the wall to divert attention from his own actions. Who would think that someone like Mike Pence would be the one to save democracy in the United States? No wonder Trump wanted him stopped, and was gleefully willing for his minions to actually execute his own Vice President.

The reason SCOTUS Is going to find in favor of Trump has nothing to do with his guilt or innocence, or what office he held. It is more complex than that because section 5 of the 14th Amendment empowers Congress to enforce the provisions of the 14th Amendment. Not to mention there is a question on whether state authorities even have the power to disqualify someone for FEDERAL office under the 14th Amendment.

Arguing that "one state" should not choose the president is hypocritical -- Colorado only seeks to control Colorado -- just as SCOTUS authorized one state, Florida, to do in Bush v. Gore -- and did so without any delay. All SCOTUS needs to do is affirm that Colorado DEFINED "insurrection" correctly and that definition can be a guide to all fifty states as each state exercises its states rights to control its own elections.

Thank you, Brian & Glenn. This is the most in-depth and inside look at this case I've seen anywhere. I thought Marco really outlined each side's argument well. I hope to God his team is successful.
The constitution mentions the word office, but more importantly, it is part of the oath Trump took. "I do solemnly swear (or affirm) that I will faithfully execute the OFFICE of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States." When you want to pause that same constitution, and not help with the peaceful transition of the Presidency, which is also covered in that same constitution, then you are not preserving nor protecting it. This is a slam dunk. Section three of the 14th amendment talks about insurrection or rebellion against the constitution itself, which is precisely what Trump engaged in to try to cling to power.
Oaths mean nothing to the orange one.
Furthermore, if the President wasn't an officer then how does Impeachment ever apply to a President. Yet they don't argue that you can't impeach a President. In fact, they want to impeach Biden all the time.
TRUMP SAID HE DID NOT OATH THOSE WORDS SO IT DOES NOT APPLY.
"Article II, Section 4: The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors." It literally says that the President is an Officer here in the first sentence.
One thing that has not really been mentioned and it speaks to the hypocrisy of Trump as his enablers. First the portrayal by some that Jan 6th was not violent, and no one could have foreseen the attack on the Capitol. If this is the case then how did Trump somehow have the forethought that 10000 troops needed to be offered? There has been no evidence that this ever happened, but if part of the plan was to invoke the insurrection act, then pre positioning those 10000 troops would be needed. it would be a terrible look politically to have the military supress any civilian protest, especially as the protesters were Trump people, so this idea obviously needed to be shelved. The schemers knew that it would be far better to delay the count in Congress, hence Grassley presiding over the count because Pence wasn't expected to be there. Pence doing his constitutional duty threw a spanner in the works. Trump knew of all of these plans and has been throwing everything against the wall to divert attention from his own actions. Who would think that someone like Mike Pence would be the one to save democracy in the United States? No wonder Trump wanted him stopped, and was gleefully willing for his minions to actually execute his own Vice President.
This attorney is a super hero for democracy snd law.

What the Supreme Court should be asking themselves is, "How would they vote if Trump wasn't a past president but instead was a senator or congressman who had led an insurrection, then tried to run for president?!?" If the belief that all men are created equally holds true, then their decision should be no different than it would be in this scenario, and Trump would be disqualified!

The reason SCOTUS Is going to find in favor of Trump has nothing to do with his guilt or innocence, or what office he held.
Trump will win because SCOTUS will say that Colorado has no constitutional right to remove him from a national ballot for a national office. ONLY Congress can do so. Colorado can remove those from the ballot for state elections but not from national elections for national office.

The states differ on who or what agency gets to approve who is on ballots. Remember, this is only about the primaries, not the general election
It is more complex than that because section 5 of the 14th Amendment empowers Congress to enforce the provisions of the 14th Amendment. Not to mention there is a question on whether state authorities even have the power to disqualify someone for FEDERAL office under the 14th Amendment.

Arguing that "one state" should not choose the president is hypocritical -- Colorado only seeks to control Colorado -- just as SCOTUS authorized one state, Florida, to do in Bush v. Gore -- and did so without any delay. All SCOTUS needs to do is affirm that Colorado DEFINED "insurrection" correctly and that definition can be a guide to all fifty states as each state exercises its states rights to control its own elections.

We know how MAGA's are going to act if the supreme court upholds the law. We also know how they are going to act if they don't and Trump doesn't win. No matter what path is chosen there will be political violence. With that in mind it only makes sense to make the morally and legally correct decision.
