  • The state of New Jersey recently clarify the difference between a guest and a tenant at a long-term hotel. This definition is important because it could impact short term rental landlords as well.

    Small landlords (any landlord with under 100 doors) need to come together and pool lawyer fee resources to get things done!

    In the state of Nevada, parts of which are very transient (Las Vegas) I believe it’s 30 days you are considered a tenant. It’s the worst kept secret in the hospitality industry that many extended stay hotels nationwide have become quasi apartments of last resort for the exact reasons mentioned. No traditional screening, first, last, or security deposits.

    This is easy. Renters/tenants sign Leases with the appropriate language. Guest sign contracts with appropriate language for hotels, motels, Air BNB, extended stays, etc. Pay your rent or fee or get out. Why is that so hard to understand?

    Hotels are not affordable housing because of the high rates and many have required the guests to move for years to avoid the situation where they have tenants rights for years in New Jersey.😮

      When I lived in these type of places they would make you all the way leave after thirty days. Not even a different room, had to move out completely. After 24 hours, you could check back in.

    In the state of Nevada I know this 45 if you stay in a motel a hotel whatever you want to call it more than 30 days you are classified as a tenant

    That drivers license idea is brilliant. Anyone willing to stand in line at the dmv for 4 hours must really be planning to stay

      I am a NJ resident, surprisingly NJ DMV isn’t as bad as other states. I’ve seldom been in a DMV no more than an hour.

      But UT is a well-run state, NJ is not.

    Here in nyc they'r planning a building for veterans. Great idea but the cost is 670k per apartment for a total of 88 million.

    For goodness sake!!! Hotels have different functions. They ha e business licenses, permits, policies. The homeless organizations really want to commandeer hotels/motels.
    In California's No ember ballet, voters are being asked to decide if hotels will have to give up unbooked rooms to the homeless.
    This is ridiculous.

    In Florida they REQUIRE " guests" check out on day 29 and wait for 3 days before returning...( 30 day rule in Florida) nany of the hotels work togeather to suffle them about.

    What needs to happen is to assess the cases of each and every person who needs to be relocated
    Take into consideration some of these people are actually HOMELESS
    Get them the right help they need and make sure that help kicks in and actually helps them
    There could be some people out there who are older and maybe not in the best physical shape
    Those are the people who should be helped FIRST
    There shouldn't really be much of a rush in certain cases where someone CAN'T be moved right now....

    Am I understanding the 3 month rule the guest has to be in the same unit for 3 months along with other stipulations? The hotel could then move the guest for example every month to a new room.

    I read the same article and beg the differ on the interpretation. One these so called extended stay didn't mind take money cash or debit card for residency. I've been there 7 years and now they're pulling this nonsense. You forgot that eviction needs to be through the court and letter written not word of mouth. 2nd , the state and Feds goverment created this mess sense Sandy. As usual, the investors' interest takes over the average man whose surving.

    It was from storm Sandy. Most still never got a home built yet. That's how long these folks have been there, don't let anyone tell you different. I worked at these places doing plumbing. U see things.

    Do the renters pay for those three months? and to change your address to a hotel is fraud. A PO box is a better option.

    To me motel residents should NEVER qualify as tenants. As for Airbnb, it should be in the rental contract that the renter waives their rights under tenancy law

    Hotels are temporary from the beginning. Never got to tenant statis. They are not renters. They are a business of giving sleep and rest to travelers.
