The private car is at fault, the private car was overspeeding, he was over the speed limit. if the blue car was within speed limit, it would have stopped and come to a halt from the distant it started applying its break, if the blue car was withen speed limit, then its breaks are faulty, implying that the vehicle is not road worthy.
