1st degree is more for the death penalty. New York doesn't see it that way. 2nd degree will still give him life in prison and it will be easier to convict him.
He's not being charged with first degree murder because it didn't meet the definition of first degree murder under NY state law. It's that simple. Premeditation is not an element of first degree murder in NY.

Depends on what you know of the medical INDUSTRY. 100 years ago, most hospitals were community owned or run by religious orders. Not perfect but if people understood more and trusted less, the spending on “health care” would plunge.
