Hello Everybody, Let us Understand Philosophical School of Jurisprudence - also known as Natural Law School. The main aspect of this school is relationship between LAW & REASON. This school believes that Law is based on some higher morals and principles and
thus every Law should be Just, fair and Reasonable. This school believes that laws
should be Based on Ethical Values. According to this school, If any law is against the naturals laws - then that law is not valid. To be valid, law should be Based on Reason-They should be Just, fair & Reasonable.
Various Jurists have helped in the development of Philosophical School of Law - Saint Thomas Acquinas, John Locke, Rousseau, Thomas Hobbes, Immanuel Kant, Hegel, Fichte etc.
This School has also helped in the development of Social Contract Theory - According to which Government formation is a part of the Social Contract wherein People; for proper and uniform utilisation of their Rights, give away some of their Powers to the Government. Now Government has to protect these rights. If in case the Govt. misuses their Power, Then the people can choose to overthrow the government and appoint a New Government for the better protection of their Rights.

mam you said In the previous video on analytical thought that bemtham also believed in maximum happiness to maximum people and here you are saying that historical thought believed in that doesn't that make bentham a mixture of both thought he believed that law is made by state at the same time he think law should cause maximum happiness to maximum people.
maximum happiness to maximum people should under analytical school, as Bentham is from analytical school as u told in previous video, so please clear it whether this statement is based on analytical school or historical school

Hi, you teach amazing. Just wanted to clarify, that natural and philosophical schools are different and not same. Philosophical law school is ethical school.

Historical School's theory is law derives from the customs and in order to know how should be the law at present or future it should be known how was the law in past!
and it is sociological schools theory that says law is that which maintains balance between state and individuals

Basically there are total six Schools of jurisprudence,
1. Analytical School
2. Historical School
3. Philosophical or Ethical School
4. Sociological School
5. Natural Law School; And
6. Realist School of Jurisprudence
As you have explained the concepts of schools, you have made combination of schools along with the imminent s. For example the Montesquieu is the jurist belonging to the Sociological school and not to the historical school.......
