  • The problem is that Granite City has what it calls a “crime-free” housing ordinance that amounts to a compulsory eviction law. Under the law, if you rent your home in Granite City and any member of your “household” commits a crime-anywhere in the city and, sometimes, anywhere at all-then your landlord is required to evict you. In fact, your landlord can be fined and even lose his rental license if he fails to evict you. That means Jessica and Kenny are on the hook for this past spring’s burglary, even though no one believes they had anything to do with it or even knew about it.

      If I'm not mistaken I think the citizens wanted the law was happy with the law and is now pretty upset that the law may go away.
      If you own property in a neighborhood and Tenants wreak havoc or become a long-term nuisance what do you think its going to do to your property values, how do you think that's going to affect your children and your general standard of living?

      So now if ij wins on a case like this it will mean that the homeowners who live next to the houses that are rented to people who constantly do illegal activity in the home must be endured by neighboring homeowners that live there. They must endure the constant police activity.
      Even after that tenant moves out, if another tenant like that moves in it can continue like a vicious cycle.
      Yes, what I said isn't exactly what took place in this case but that's the way case law is broadly interpreted.
      So now someone who gets convicted of murder could be brought back to the home then could be convicted of robbery come back to the home then can get get convicted of rape and can come back to the home as long as they continue being a good graces of the landlord.
      If the community as a community doesn't want that then they shouldn't have to put up with it

      You can't take someone to court for what someone else did because they aren't a party to the action this a basic fundamental principles of court! The city has zero standing if I remember this they are claiming a contract for housing was violated but you can't be held accountable for any portion of a contract outside of your control! Again basic legal principles! It would be similar to saying that you signed a agreement with a deposit for your rental but because a hurricane damaged the home you don't get your deposit back! There's nothing legal the constitution protects freedom of association it protects helps angels from being illegal it also protects you from getting into trouble simply because you interacted lawfully with someone!

    This video is very important as well as informative. It needs to be pointed out that people that are sight-impaired are not able to read what is printed on the screen. Even with my magnifying glass I am not able to read read it. I think someone is being evicted from their home because of criminal activity. Continue to print on the screen but also speak what is being printed. Sight impaired people would greatly appreciate that.

    1) Has the accused even been convicted of the crime this family is facing eviction for? Not saying he’s not guilty, but this shows how willing lawmakers are to abandon basic civil rights and due process.
    2) Would the family even be permitted to rent another home within the city, or would they have to leave it to obtain housing? This is patently unconstitutional.

    Wow this is crazy. I live in St Louis about 30 mins from Granite City and I was evicted from the house I rented because of a similar "nuisance law"
    I rented this house specifically because I was leaving my extremely abusive ex and took my daughter with me. I told no one except my mom where we were moving to. We had only lived there a few weeks when one day while I was at work my ex broke in and scared the crap out of my babysitter and daughter. I think he had someone follow me from work and found where I moved to. Within the next 2-3 months he broke into my house over 13 times. He robbed me, beat me up, broke windows out. I called the police every time it happened and they did absolutely nothing except take him in for a few hours and let him sober up then release with no charges, even though I had a restraining order. I lived in University City in St Louis which apparently has a law that if a house makes over a certain amount of calls to police they are deemed a nuisance property. After 4 months of living in hell wth no help from anyone we were also evicted. Now it's hard to find anywhere to live because I have an eviction on my record when I did nothing wrong.

    I was involved in a hit and run, the guy cut me off and slammed on the brakes, and I hit the back of his truck, then he sped off. So I went after him long enough to get his plate number then called the cops. The cops said it was my fault because I went after him instead of calling them right away. Got a ticket for careless driving and had to pay to get my own car fixed.

    This ordinance is in violation of the Constitutional prohibition of excessive fines. Since they can't claim the robber as an income tax deduction, he cannot be considered a member of that household. He is a guest. Jessica and Kenny have a civil rights lawsuit opportunity.

    Unfortunately, constitutional protections are not available for everyone in every instance. And the worst part is you can never know that you are the one who will be excluded from those protections until you are in the midst of their being denied you. And rather than our elected representatives working to see that abuses don't happen, they daily pass more and broader reaching laws that wind up misapplied to the abuse of more law abiding citizens.
    One would think that a law of this sort would be unable to be abused, but the law doesn't have eyes to discern who it is enforced against and most district and city attorneys are so overworked, so overtly competitive and so cynical as to push the responsibility of determining the truthfulness of the accused onto the courts rather than assuming the responsibility for throughly investigating criminal allegations. It is good to see an organization who seeks to right injustices but again, there is still a remnant who are left to endure the wrath of broadly written laws and attorneys and bureaucrats who dispassionately enforce effectively unconstitutional laws and ordinances because they have a job to keep secure by enforcing laws against an unsuspecting citizenry.

    This is what authorities do when they're given powers like these - they abuse them. It's vital to understanding the mentality of law enforcement that they don't care about right and wrong, they only care about getting results, and ANY result will do.     Why are city governments so commonly lame like this? These kinds of stories are really discouraging. Crime free neighborhood is really geared towards criminal activity such as drug production and sales, or any other criminal activity that a property is being used to facilitate. It was never meant as a means to remove somebody for making a mistake. There is a big difference between somebody committing a crime, especially somewhere else, and a property being used for criminal activity. This is where overreach becomes a big problem and justice is definitely not being served at all. Thank God we have an organization like you guys.

    Another all or nothing law which prohibits extenuating circumstances to even be considered.
    Just because a law is past does not mean it is a legal law. Only when challenged in a court of law can it be considered a law. I do not believe this law will stand testing and redress will be given to this family.

    If anyone can answer this, how can you become evicted from a home you own. You can't. Is it public housing? Then I can see it. Otherwise we're not getting the whole story. If they own the home then I can see the issue. But if they don't own the home, well sorry to say it might be tough luck. It must be public housing or some kind of housing program they are involved in. If you own property you can't get evicted. Someone please give me more info if you have it.

      Sometimes, settlements are made with the stipulation that they be kept confidential. However, one of their cases that took place in the city where I live was all over the news when IJ won, and they did post a followup video with their victory.
      Unfortunately, another reason why they don't post followups is that sometimes they lose (and maybe don't want to talk about it further). This appears to have happened with the suit in California about the requirement that students in a school to learn how to work with horses have a high school diploma or a GED.

    If we were to add anything to the Constitution it would be this one thing.
    Any infringement on the rights of any citizen of the United States by any citizen who is acting in an official government capacity; the offending citizen acting in a governmental capacity SHALL be held criminally liable and shall lose all benefits, pay, position and authority and be barred from any government position for life upon conviction of said crime. Said convicted citizen SHALL pay for all legal fees, loss in work time, medical fees or any financial losses incurred by the offended citizen in the process of jury trial and conviction. This law SHALL not be construed to be at all applicable to the citizenry at large but to those elected, appointed, or otherwise operating in any official government capacity. Citizens operating in a governmental capacity SHALL maintain their own individual rights and that conviction on the grounds of violation of another citizens rights does not forfeit their right to due process of law. They will be awarded the return of full faith and fellowship of their fellow citizens once they have served their sentence and paid in full their debt to the offended and society at large; with the exception they SHALL never serve in in any governmental capacity again.
    Anyway something like that is what I have in mind. It would keep alot of these scum politicians and police in check. At least in my opinion.

    so the law is like we want more homeless people on our streets? so maybe everyone works now but someone messes up then everyone around them goes homeless? i guess its not all that bad you'll be able to leave town with your family to search for new housing but you'll end up homeless in another city. triple digits :) when i say its not that bad i meant for the city when the family has to leave their town lol

      Of course they do. Those in power who desire to maintain or grow that power always wish to move things toward a state of aristocracy whether they are conscious of it or not. How better to do that than by pushing people bellow them on the social ladder down to reestablish "the peasantry".

    Ummm... regardless of the details about the friend, the law is unconstitutional. They can't just force you out of your home (it's not clear if they are seizing it or forcing the person to sell) because you committed a crime... that's the job of the courts. You commit a crime, get arrested, get tried and convicted, and go to jail. AFAIK, you *still* have the rights to your property unless it was part of the crime and seized or unless the court has it seized to pay back restitution to the victims of the crime. It's essentially an illegal seizure of property, no? And any crime is supposed to be handled in court - even parking tickets if you choose to fight them. It's like the dumbest zero-tolerance law ever... commit a crime and we will make you homeless, so that you will have to commit more crimes in order to survive and never be able to get back on your feet; or so we can put you into a for-profit prison which we get kickbacks from. Sounds like some naive and stupid Karen had the bright idea that if they just kicked out all the criminals out of town there'll be no more crimes!

    Ironically we the public, the people are the problem. We ignore the various politicians we elected at various levels, we complain about them but don't truly hold the accountable. Why because mostly we busy with are lives, so we let the Politicians turn over various issues to the Bureaucracy of the Government be it local, county, state or federal. The Bureaucracy does things based on various reasons of special interest or the public good etc etc, we the people don't think much about it because it hasn't caused anything to harm yours/our individual lives. And when we hear about it we feel bad and hope things work out, again because we are busy individually with are own lives and until it disrupts that bubble we just watch.

    In my opinion, kicking a whole family out of their house, for a crime 1 person, who is not even a member of their family, but only a friend of one of their kids did, is absolutely wrong. The mother did the right thing by turning the person who did the crime in. But the city has no grounds to kick the family of their own house, the family did nothing wrong. The city is 1 million % wrong.

    I believe IJ is leaving out some critical parts.
    Does this involve public housing and or use of public funds like housing grants for Section 8 or some other type of state or federal funding?
    If so then I am familiar with that policy in which the federal govt by way of the state terminates housing grants or residency within Federal funded housing facilities if it has been proven that the residence has been used for drug or crime activity.
    The logic behind it is that there is a very very long waiting list for public housing and public housing grants so there's no need to tolerate nuisances
    It is highly likely that the restaurant robbery was the final straw that broke the camel's back and that the household was a general nuisance over and above that specific crime I would not be surprised if that address had numerous interactions with police.

    Stop breaking your oaths. Code can only be law if it does not interfere with the
    supreme law. The law that you swore an oath to protect and to serve against all
    enemies foreign and domestic. If code interferes with said law it is and was
    void Ab Initio at its conception. By enforcing said codes you are guilty of
    subversion/treason.
