    Kung Agricultural land po ang klasipikasyon ng lupa, idagdag ang DAR clearance sa requirements ng Registry of Deeds.

    Thanks for this newly discovered channel. Akma sa knowledge na kailangan po namin ngayon.
    Long question post ahead, sir. Sana po matulungan at masagot nyo mga katanungan ko.
    1993 po nung mabili ng parents namin yung 100sqm na portion ng lupa ng isang tao.
    Deed of sale lang po ang kopya namin nun. Ang problema after nun hindi na po inasikaso ng parents namin. At ngayon lang po namin nalaman na hindi pala naka rehistro sa register of deeds yung deed of sale namin.
    Ang problema po, yung title nung kabuang lupa na naka saad dun sa original title ay ibenta nung may ari sa ibang tao.
    Kaya ngayon parang nangangahulugan na pagmamay ari na rin nung nakabili ng kabuang lupa kung saan parte yung lupa namin na 100sqm.
    Tanong ko po, may paraan pa po ba para mapa rehistro namin sa register of deeds yung deed of sale na hawak namin gayung wala kami nung mga requirements na kailangan para sa pagpaparehistro sa ROD tulad nung;
    Original tax clearance
    Original tax declaration
    Certificate authorizing registration
    Original OR of gain tax?
    May laban po ba kami kung sakaling kunin sa Amin itong lupa (nung tao na nakabili nung kabuang lupa nung first owner kung saan nabili ng parents ko itong lupa namin ngayon) na kinatitirikan ng bahay namin simula pa nung 70's era.

      Parang ganito po. yung isang buong pizza na pag aari dati ni Name A..
      Yung bawat slice binenta nya sa mga taga rito sa barangay namin.
      May 4 slice po na nabenta sa ibat ibang tao na deed of sale lang po ang kopya.
      Ngayon parang early 2000 po ata binenta naman ni Name A yung kabuang title nung isang buong pizza kay Name B.
      Ngayon po yung ibang naka bili ng slice ng pizza (lot portion) ay nakuha na po ni Name B sa hindi ko alam na paraan. Kasi ang katuwiran nya po, sya na ang nagbabayad ng amelyar nung kabuan ng pizza na nabili nya kay Name A kasama din po dun yung slice of pizza namin (lot portion).
      Natatakot po kami ngayon na baka ipagiba na rin itong bahay namin at kunin din nila itong lupa namin dahil yung katabing lote po namin ay pinapa bulldozer nya na ngayon dahil may project daw po na itatayo dun.
      Sana po mabigyan nyo kami ng advise sa kung ano po yung tama at dapat naming gawin ngayon para hindi po makamkam o makuha ni Name B itong lupa namin ngayon. Maraming salamat po.

      Daming proceso po iyan dapat pagbumili kayo ng lupa siguraduhin na hindi lng dead of sale lng ang hawak nyo kundi napagkasundoon nyo po ang mga bayaring taxes sa BIR depende na po sa transaction na ginawa ninyo mahirap po magpapatunay na pagmamay ari mo na yung lupa na kulang kulang kau sa mga documento..

      What to do sir, ?when parents land no mother tilte,then I bought portion and stated 200x10 sq.m plus excess land area will be given to the purchaser. After 30yrs the owner who has no mother tilte claiming again the said potion which already given to the buyer and stated in the agreement. My question is , the buyer can demand to the owner?, what's is our right about this issue?

      Mas mabuti po na ipalipat po ninyo sa pangalan ng father mo ang tax declaration kung may notarized deed of sale sila bago mamatay yung orig owner. May content po ako paano ipalipat ang pangalan ng owner’s name sa tax declaration.

      Sa process po ngayon, kung kasama po ang subdivision plan sa naisubmit sa Registry of Deeds, iissuehan lahat ng lot ng title. Yung maibabalik sa inyo ay ang new title sa remaining lot na hindi ibenenta.

    May lupa kasi ang Lolo ko at binigyan ang kapatid niya ng 1/3 portion of Land, ang 2/3 sa Lolo ko nakalagay po ito sa Mother title. Ngayon patay na sila pareho, bali ang nagmana na ng lupa is Father ko at yung sa kapatid ng Lolo ko naman ay sa mga anak nila.     Sa deed of consolidation-subdivision with absolute sale (of a portion of land) wala pa po LRA Number, balak na po ipanotaryo ni seller ito kahit kulang pa po ng LRA eh hindi naman po tatanggapin ng RD yun kung kulang po. Sabi ko po wag po muna inotaryo dahil kulang pa po. Paano po ba malalaman kung may totoo na may LRA number na lalabas, kung may entry po talaga kasi yung pinapakita po ng seller resibo galing sa surveyor. Baka po kasi naghihintay lang po sa wala mag one year na po kasi yung petsa na resibo na pinakita sabi December 2021 lalabas na ang LRA Number pero wala pa rin po, fully paid na po.

    Sir, new member here, may tanong lang, may gustong sanang bilin na lote kaso nakamother title pa at hindi pa nahahati sa 5 magkakapatid na magmamana. Kung bibilin ang 1 portion ng lupa kailangan bang bayaran ang buong estate tax or portion lang ng bibilin. Salamat in advance. malaking tulong ang video nyo.

      Opo. Tama kayo. At hindi lang yung mother title na nabilhan mo kundi pati narin lahat ng real property ng namatay kailangan bayran ng estate tax ng heirs.

    Hello John,
    DAR Clearance is only needed for agricultural land less than 5 hectares?
    If the owner owns more than 5 hectares, you don't need the DAR clearance if you're only buying portion of the land?

      following, may nakaka alam po ba ng sagot? I have similar case, they are charging me 10,000 for DAR Cert from 77sqm lot portion that I bought from the original lot size of 4481 sqm (mother title)

    question po meron po kaming nabiling lupa bali 20 slot un from 1 mother title bali direct buying kami sa ownwer ngayon po ipapatitulohan na namin ako po ung bi igyan ng SPA isa rin ako sa buyer ngayon po gusto ko po malaman kailangn ko pa po ba ng license to sell nagugulohan po ako kailan po ba kailangn ko ba ng licence to sell eh hi di naman developer ung owner

      Depende po sa halaga ng zonal value, fair market value o selling price , which ever is higher. Kaya di ko po masagot. Maguupload pa po paano magcompute.
      Ang pa survey magsisimula sa 12k ang presyo pataas.

    Bale naka 8 po kami naka bili ng Lupa hinati hati samin bale portion lang po Fully paid napo tapos napo masukat ng Geodetic Engr at may subdivision plan napo. Hinihingan po kaming mga nakabili ng tig 10,000 pesos each para daw po sa oag process ng Subdivision plan sa DENR region po.. Sakto poba yung 10K each po?

    Sir salamat ng marami super informative ng video nyo po, may karagdagang katanungan po.
    - ofw po ako nagpanotaryo ako sa Phil Embassy ng SPA para sa nanay ko na sya ang attorney in fact para sa bibilhin namin na lote. Question po may nabanggit kayo sa video na dapat iconsularize lalo na pag ang spa ay hindi sa pinas ano pong documents ang dapat ipa consularize?
    - mother title po yung lote na binibili namin tapos nag engage kami ng geodetic engr para sa survey pero dahil agricultural land po need pa ata ng DAR clearance, alam nyo po ba requirements ng DAR para makapagbigay sila ng clearance 300sqm out of 2175 lang po na portion ang buy namin.
    - yung after po ba ng approved plans from DENR at other docs from geodetic engr pwede na kami magkabayaran full payment then we can bring all docs to BIR? At what point ba kailangan ang DAR clearance

      Hello kung nandito pa kayo sa Pilipinas nung pumirma ka ng spa, di napo kailangan ng consularized SPA. Sa Registry of Deeds requirement ang DAR clearance.

    Goodmorning po Sir, tanong ko sana kung anu ba ang mauuna? Pasukat ng lupa or absolute sale? Kasi ang sabi ninyo sa vlog ang requirements sa pasukat ng lupa ay kasama ang deed of sale. Peru sa step by step ng vlog nio mauuna ang geo-engr.. confuse lng po. Meron kasi akong bibilhing lupa. Peru mana lng siya at portion lng ang binibenta sken. Ano po ba ang una kong ggawin. Meron siyang mother title, sketch plan at blue print peru walang subdivided or partition...

    Good evening po, sir. Sana mapansin po. Tanong ko lang po about sa balak namin bilhing lupa. Bale pang 3rd transaction na po kami, at dun sa 2nd transaction ng magbebenta sa amin, sabi deed of sale lang ang hawak nya. Pwede po ba na wala talaga silang sundivision plan or title?
