Guy comes in with his girlfriend. Points at a pistol and says babe you want that one. Guy walks out girl tries to buy a Glock 43 and the shop refuses to sell her the gun. She starts screaming that everybody is racist and the guns for her so they need to just sell it to her right now. She starts recording on her phone. One of the guys that works there is and off duty state trooper. He calls some on duty state troopers and they show up and find cocaine in her unregistered uninsured car and he's got warrants. It was a very entertaining trip to the gun store.

@@SouthernHavocwell in a lot of states it’s illegal to drive without insurance, and in almost all states it’s illegal to drive without your vehicle being registered with the state. As such, the vehicle is illegally being operated and can be impounded which constitutes a warrantless search. They didn’t even need to give permission it’s very likely the impoundment of the car led to a search.

Boy things have changed. My grandfather took me to the local hardware store in 1968 when I was 10 years old to buy a couple of guns. He bought 2 pistols, a .357 for him and a .22 revolver for me. All while telling the clerk it was my first pistol. Put cash on the counter got the receipt and walked out. And we didn’t have school shootings or anything like we have now.
Big difference between buying a gun for your grandson and buying a gun for a guy who can't buy one himself because he went to jail for beating his wife and kids.

Many gun shops I have been in recently have boxes of 12 Gauge shells either on the counter or within arms reach of the counter. Difference is they take the firing pin out of any display firearms so they can’t be used against the clerk.
@@dmo848well here's a tip for you: don't just go to a store to buy "a gun" and figure out what you want at the counter. Figure out what you want in a gun or what you want it for, and then go to the store (or multiple stores) till you find something that works for you. For example, what do you want the gun for? For home defense? If so, don't look at small caliber handguns, or hunting rifles (unless that's all that's legal where you live). Is it for learning skeet shooting? If so, get a shotgun and if you have no experience with one, get one that's low enough caliber that you can learn on it, and simple enough that you can learn how to work it. Also, I've never seen anyone at the gun counter getting laughed at for asking questions. Not only that, but most gun guys and salesman are really excited to talk about guns and answer questions. It's our dream to get someone hooked on guns. An alternate approach is to take a shooting class, then after the class decide what you liked and didn't like in the guns you used, and talk to the instructor about what they recommend, and figure out from that what you should buy, then go get it. In short, before you go to the store, decide what niche your gun will fit (hunting, home defense, sports, concealed carry, range day, training, etc.) and then ask the guys behind the counter if they can recommend something for that niche. Or take a class and find out that way what's right for you. Hope this helps.
Excellent Advice!! I never go into a gun shop without having researched what would actually be the right type of firearm! And don't ever go to a gun show without having a good idea of caliber, the action, what you plan to use it for (i.e. deer, upland game birds, duck/geese, home defense etc.). I was very blessed to have had an older brother who taught me about how to shop for a specific type of firearm before actually going out to different places to compare prices to the kind of firearm I thought I would want to use for different shooting sports. Buy a couple of monthly subscriptions to a popular gun magazine and read the featured articles on different types of guns. Study up beforehand before actually buying the type of gun you're looking for will definitely help you from needlessly spending a lot of money on a gun that is not gonna be suited to the need of it. What might work for someone else, might not work for You! Become a member of the US Concealed Carry Association USCCA and The Gun Owners Of America. Stay far away from joining the National Rifle Association (NRA), because of its leadership is hypocritical and corrupt!! If you are gonna be going out into the mountains or heavy wooded country hunting deer or elk or whatever?! The same thing applies for knowing what type of rifle, handgun, shotgun or even a muzzle loading rifle. Do some homework beforehand. Seek out experienced hunters who have been hunting for years. When I was in the military, I went in to buy an HK USP compact. I was from Kansas but stationed in Washington State. Dude wouldn't sell to me due to being technically a Kansas resident. No worries. FFL owners reserve the right not to sell if something seems off and rightly so. That old Fudd just lost a sale, is all. The next place legally sold me one actually at a better price. This video is a perfect reason to refuse a sale, however. It is called straw purchasing and is illegal.

I work at a gun shop right outside Detroit and when I tell you this happens all day we can’t even sell guns fr cuz people either get denied or 4 dudes walk in with one girl smelling like weed and felonies and pointing to guns and talking about it while she says nothing and then once the guys agree on a ar pistol they be like “she want that ar pistol” then get mad when I tell them no.
I hate this smell really, maybe I am different because I come from Poland or maybe because I don't like when people ruin their lifes for drugs. Anyway for me the smell of it is dusgusting...
I worked at pawnshop on Van Dyke near 8 mile and know this quite well.. Or just be some illiterate that they don't understand the questions on the 4473, or possibly high and keep answering questions wrong. We started having people put the firearms in layaway before doing the paperwork since people would come in to see if they'd pass or not and just walk out. It was a lot of fun working there sometimes, just left a few months ago after 6 years.
I've seen the salesman demand background checks for the person sitting in the car (right out in front of the store, fully visible from inside). I've seen it happen when the person standing quietly next to the purchaser nods to the purchaser and the salesman requires a background check for both. Then there was the couple who came in, the guy did all the talking and then when it came time to pay, the woman pulls the cash from her purse. The salesman then requires BOTH to have a background check. No legitimate gun shop is going to risk losing their FFL and prison time over one sale of a firearm. The ATF runs stings to see if gun shops turn a blind eye to straw purchases.

If you do that with a couple, or parent/adult child, you can expect to lose a lawsuit. Even if the husband is a felon and can’t own the gun, it’s not a crime for him to advise a spouse, friend or loved one on what they should get. So, by trying to do a check on someone not buying the gun, you are just setting yourself up to be sued.

@@Killer-vi4ihgun stores aren’t actually beholden to reviews scores to survive as they are not establishments that have a frequent customer basis like restaurants or department stores. It also doesn’t matter much when a majority of all FFL(s) work with L.E. or have a L.E. program. I mean biggest thing to get from a review of a gun store is the pricing, range care/time, and personal. It’s just not as a debilitating factor to their businesses as you’d like to think. Now that’s not to saw bad customer service won’t turn away customers. But the majority of customers going into these FFLs are primarily concerned with customer support or education. The other thing is that the FFL has the right to decline making any sale, meaning they could refuse to do business with anyone except law enforcement for example. Now because of consumer rights and other laws/regulations, if you did a background check to purchase a firearm and have given money and no response from the ATF came back in regards to your background check, then the firearm is allowed to be sold. It does not mean that it will be, just that it can as the ATF has failed their responsibility as required by law. Another thing, a review about someone not being able to purchase a gun versus a review about being sold a gun used to kill are two different reviews that will never exist on the same platform. “this guy at this gun store pointed me in the right direction for my gun of choice for my first drive by, although he didn’t know I was going to use it for a drive by, I just I need it for self defense.” Versus “they have bad customer service, would not sell me gun cause I was on the phone.” SOME FFL do not allow use of phone when purchasing a firearm. It’s a very unnecessary gray area that exists because the ATF is broken and so is our societal structure. I’ve done straw purchases to prove a point and it’s very easy for someone with a friend or to even fool a friend into getting a firearm very easily. The fucked yo thing about this whole thing, is that we can sell a 12ga slug that’ll completely tear a human apart to a 18yo but a 9mm or 22 that is survivable is at 21. And the main excuse is, shotgun big, pistol smol. Yea sure. Cause a kid can’t buy a shotgun, take him home and modify it for ease of access or deployment. I mean there are so many rules and regulations that don’t even keep people safe, they just make money or oppose rights to citizens. I went with my friend when I was 17 (he was a couple years older) and he bought a 30-30 winchester lever gun for me right there at the counter. I was even holding it and checking it out and told him yeah that one lol. That was back in the late 90's though, and at a Dunhams sporting goods. I also walked behind the counter with a friend at that same place and got a couple canisters of pyrodex smokeless propellant for muzzleloaders when we were both 15 or so. We just walked behind the counter, grabbed a can or two, then walked up to the checkout and paid for it. No questions asked or anything. Good times, good times lol

He assured them it was not and he bought a gun for himself too just to prove he would pass the background check. Back in the '70s I bought my first deer rifle at Woolworths in Milwaukee on North Avenue. Got an 8mm Mauser and 1000 rounds o Czech armor piercing ammo for $9.95. I was 14 years old and no paperwork to sign or an adult present. I had the ammo in my Radio Flyer wagon and the gun slung over my shoulder. A cop pulled up and asked where I got the "canon" and where I was going with it . I told him where I got it and what I paid for it and that I was headed home. He revved up the cruiser, did a U turn sped down the road toward Woolworths.
@@AcidHead710 In '74 the age limit to buy a centerfire firearm was 14 without parents and 10 for a .22 . Woolworths was within the law and I seem to recall having to sign something stating I was over 14 but there was no I.D. check. Things were just way easier going back then.

You can do this but normally you want to be transparent with the FFL and explain the situation, and the person who the gun is going to would fill out and attest on the 4473 that they are the intended transferee. Abramski v. US is a Supreme Court ruling that ruled on this so no FFL wants to take the risk if they think you are giving the gun to someone else. This ruling was a majority opinion swayed by Barack Obama appointees... it likely wouldn't stand under today's Supreme Court, but those are the cards we've been given so far...

I had recently moved and they made a huge deal because the ATF needs to “know” where the fire arm is going. I told him that logic was counterintuitive considering people move all the time or they could simply buy it for someone else. Which he stated it wasn’t legal to do, claiming he took a course and he knows more. Yes you can absolutely buy a firearm for someone else. The ignorance was blood boiling. I get they dont WANT to but to lie and tell me you CANT is absurd. Also a huge believer in a human right so i (or anyone) shouldn’t have to explain to anyone who and what they are buying it for. If it falls back on the FFL dealer when someone commits a crime then we have bigger issues to discuss.

To be fair, most reasonable gun stores will even tell you to just STFU when you are purchasing a gun and not over-explain anything - ignorance is bliss and they'd rather you not say something that could be construed as a potential legal problem. I was referring to the original parent comment I replied to though - again, you absolutely can buy a gun for someone else as a gift but the main problem is that there is Supreme Court case law that says you cannot be the one that fills out the 4473 form if you are buying that gun specifically for the purpose of giving it to someone else, even if that person ls legally able to possess it. It's a dumb ruling in my opinion but the court at the time ruled that when you check off that box that you are the "intended transferee," you've committed a crime if you made that purchase with the intention of giving it to someone else at that time of purchase, even if that person isn't a prohibited person. (It's still stupid in my opinion because what's to say I didn't get buyers' remorse immediately after purchasing said firearm, but alas your intent apparently makes a huge difference.)

@@JUHEBLA17764473 is not a background check. It’s a Firearm Transaction Record. This form is used when transferring firearms between FFLs and/or private persons. This form is used to transfer NFA items such as suppressors and grenade launchers.
Yeah, it doesn't make any sense. What if my friend came in with me and was helping me pick something out because he is an expert and I am not? They going to background check him? A store like this probably wouldn't sell to me since my background check always comes back as "delayed". I don't know why. I don't care. I do expect them to release it to me after 5 business days. The big box stores won't do that. Never had a problem with a small gun store acting rational.

I worked at a liquor store that was across the street from a 7-11. We caught a kid using a fake license and refused sale. When we saw the kid go to the 7-11 we called them and they refused sale also.

If someone drops you off and make no signs of communicating to them once on the store, they won't know you have a buddy in the car. If you walk in and you are on the phone asking questions and confirming things with someone just outside, then they will get suspicious. Even a private seller has the right to refuse a sale if they think you're being sketchy.

The law passed in DC was ridiculous in the first place and clearly violated the 2nd Amendment, but saying the “history and language” of the 2A protects the right to self defense is hardly a black and white issue. To take Justice Scalia’s majority opinion as the end of the discussion ignores the fact that 4 out of 9 justices disagreed with him. The very same case you’ve referenced even says that the right to bear arms is not unlimited and that certain restrictions on guns and gun ownership are permissible. You know what that includes? Background checks, and preventing people with violent felony convictions or mental illnesses of owning firearms. You’ve invalidated your initial claim that background checks are unconstitutional.

Had a guy try to purchase a firearm once. He filled it out no incident but, he looked nervous. Manager told me to send it to the NICS system and it denied him instantly. Received a call 30 seconds later from an ATF agent who told me to stall until they came to pick him up(luckily he decided to go to the bathroom). As soon as he returned there were two agents with their guns drawn reading him his rights.
The thing has a brace on it which at the moment are a very gray area with a ruling against them that have multiple lawsuits against it. Some people just don't care/ don't believe the ATF ruling is valid or maybe this video was made before that, dont know.
I worked at a gun store in California 21 years ago. I spent 4 years there. I had a hand full of people that I suspected of a straw sell, but nothing even this close to this crazy. Let common sence rule, but don't expect gun dealers to be investigators. As far as my experience, we specialized in antique weapons. That's where we made the bulk of the money. Modern firearms(at about 25% mark up), was barely enough to pay the overhead. It really wasn't breaking our heart to deny a sale on a glock or something. Most of the time it was a young, small woman trying to buy a 1911 of some variant for her boyfriend. It was pretty clear she had no clue what was going on with the gun, and once we tried to strear her in a different direction, she would leave. At some point later, she would come back in with a man that clearly knew more about firearms than she did. At this point I would simply tell them that I didn't fell comfortable with the sale, and they would leave with out issue. It's a Grey area that some shops fall more victim off than others. In my case, the weapons that we made the most money off of were weapons that weren't prohibited to begin with, and brought us enough money to not hesitate to deny people like this. At the end of the day though, there are no bad guns, just bad people.

Boy things have changed. My grandfather took me to the local hardware store in 1968 when I was 10 years old to buy a couple of guns. He bought 2 pistols, a .357 for him and a .22 revolver for me. All while telling the clerk it was my first pistol. Put cash on the counter got the receipt and walked out. And we didn’t have school shootings or anything like we have now.

@@dmo848well here's a tip for you: don't just go to a store to buy "a gun" and figure out what you want at the counter. Figure out what you want in a gun or what you want it for, and then go to the store (or multiple stores) till you find something that works for you. For example, what do you want the gun for? For home defense? If so, don't look at small caliber handguns, or hunting rifles (unless that's all that's legal where you live). Is it for learning skeet shooting? If so, get a shotgun and if you have no experience with one, get one that's low enough caliber that you can learn on it, and simple enough that you can learn how to work it. Also, I've never seen anyone at the gun counter getting laughed at for asking questions. Not only that, but most gun guys and salesman are really excited to talk about guns and answer questions. It's our dream to get someone hooked on guns. An alternate approach is to take a shooting class, then after the class decide what you liked and didn't like in the guns you used, and talk to the instructor about what they recommend, and figure out from that what you should buy, then go get it. In short, before you go to the store, decide what niche your gun will fit (hunting, home defense, sports, concealed carry, range day, training, etc.) and then ask the guys behind the counter if they can recommend something for that niche. Or take a class and find out that way what's right for you. Hope this helps.
Excellent Advice!! I never go into a gun shop without having researched what would actually be the right type of firearm! And don't ever go to a gun show without having a good idea of caliber, the action, what you plan to use it for (i.e. deer, upland game birds, duck/geese, home defense etc.). I was very blessed to have had an older brother who taught me about how to shop for a specific type of firearm before actually going out to different places to compare prices to the kind of firearm I thought I would want to use for different shooting sports. Buy a couple of monthly subscriptions to a popular gun magazine and read the featured articles on different types of guns. Study up beforehand before actually buying the type of gun you're looking for will definitely help you from needlessly spending a lot of money on a gun that is not gonna be suited to the need of it. What might work for someone else, might not work for You! Become a member of the US Concealed Carry Association USCCA and The Gun Owners Of America. Stay far away from joining the National Rifle Association (NRA), because of its leadership is hypocritical and corrupt!! If you are gonna be going out into the mountains or heavy wooded country hunting deer or elk or whatever?! The same thing applies for knowing what type of rifle, handgun, shotgun or even a muzzle loading rifle. Do some homework beforehand. Seek out experienced hunters who have been hunting for years. Lastly I would suggest that You get some training by certified firearms instructors.

When I was in the military, I went in to buy an HK USP compact. I was from Kansas but stationed in Washington State. Dude wouldn't sell to me due to being technically a Kansas resident. No worries. FFL owners reserve the right not to sell if something seems off and rightly so. That old Fudd just lost a sale, is all. The next place legally sold me one actually at a better price. I worked at pawnshop on Van Dyke near 8 mile and know this quite well.. Or just be some illiterate that they don't understand the questions on the 4473, or possibly high and keep answering questions wrong. We started having people put the firearms in layaway before doing the paperwork since people would come in to see if they'd pass or not and just walk out. It was a lot of fun working there sometimes, just left a few months ago after 6 years.
I've seen the salesman demand background checks for the person sitting in the car (right out in front of the store, fully visible from inside).
I've seen it happen when the person standing quietly next to the purchaser nods to the purchaser and the salesman requires a background check for both.
Then there was the couple who came in, the guy did all the talking and then when it came time to pay, the woman pulls the cash from her purse. The salesman then requires BOTH to have a background check.
No legitimate gun shop is going to risk losing their FFL and prison time over one sale of a firearm. The ATF runs stings to see if gun shops turn a blind eye to straw purchases.

So, by trying to do a check on someone not buying the gun, you are just setting yourself up to be sued.

@@Killer-vi4ihgun stores aren’t actually beholden to reviews scores to survive as they are not establishments that have a frequent customer basis like restaurants or department stores. It also doesn’t matter much when a majority of all FFL(s) work with L.E. or have a L.E. program. I mean biggest thing to get from a review of a gun store is the pricing, range care/time, and personal. It’s just not as a debilitating factor to their businesses as you’d like to think. Now that’s not to saw bad customer service won’t turn away customers. But the majority of customers going into these FFLs are primarily concerned with customer support or education. The other thing is that the FFL has the right to decline making any sale, meaning they could refuse to do business with anyone except law enforcement for example. Now because of consumer rights and other laws/regulations, if you did a background check to purchase a firearm and have given money and no response from the ATF came back in regards to your background check, then the firearm is allowed to be sold. It does not mean that it will be, just that it can as the ATF has failed their responsibility as required by law.
Another thing, a review about someone not being able to purchase a gun versus a review about being sold a gun used to kill are two different reviews that will never exist on the same platform. “this guy at this gun store pointed me in the right direction for my gun of choice for my first drive by, although he didn’t know I was going to use it for a drive by, I just I need it for self defense.” Versus “they have bad customer service, would not sell me gun cause I was on the phone.” SOME FFL do not allow use of phone when purchasing a firearm.
It’s a very unnecessary gray area that exists because the ATF is broken and so is our societal structure. I’ve done straw purchases to prove a point and it’s very easy for someone with a friend or to even fool a friend into getting a firearm very easily. The fucked yo thing about this whole thing, is that we can sell a 12ga slug that’ll completely tear a human apart to a 18yo but a 9mm or 22 that is survivable is at 21. And the main excuse is, shotgun big, pistol smol. Yea sure. Cause a kid can’t buy a shotgun, take him home and modify it for ease of access or deployment. I mean there are so many rules and regulations that don’t even keep people safe, they just make money or oppose rights to citizens.

I went with my friend when I was 17 (he was a couple years older) and he bought a 30-30 winchester lever gun for me right there at the counter. I was even holding it and checking it out and told him yeah that one lol. That was back in the late 90's though, and at a Dunhams sporting goods. I also walked behind the counter with a friend at that same place and got a couple canisters of pyrodex smokeless propellant for muzzleloaders when we were both 15 or so. We just walked behind the counter, grabbed a can or two, then walked up to the checkout and paid for it. No questions asked or anything. Good times, good times lol

A cop pulled up and asked where I got the "canon" and where I was going with it . I told him where I got it and what I paid for it and that I was headed home. He revved up the cruiser, did a U turn sped down the road toward Woolworths.

A local shop tried to do this to me and my wife, she wanted a little 6 shot revolver that comes with a. Pink finish so I was showing her around the gun and she was asking questions because it's her first time handling a revolver that would be hers, the seller said something like "Yeah we get a lot of women trying to buy the felon husband guns" I just shrugged it off and was like "Ohh that's weird anyways my wife wants to ask some stuff" and he cuts me off and says "I said she can't buy you the gun, guy if you want it you gotta do the background check" so I tell my wife well go somewhere else to get it, we find another place that has it, buy it tell the owner the story,he knows the guy and calls him and basically calls him a retard because after my wife bought her gun I bought a pretty expensive 1911, so he tells him "if you would have just waited til the wife got hers, the husband was going to buy a $1k 1911 but we got them all settled over her now" dude lost out lol

You can do this but normally you want to be transparent with the FFL and explain the situation, and the person who the gun is going to would fill out and attest on the 4473 that they are the intended transferee. Abramski v. US is a Supreme Court ruling that ruled on this so no FFL wants to take the risk if they think you are giving the gun to someone else.
This ruling was a majority opinion swayed by Barack Obama appointees... it likely wouldn't stand under today's Supreme Court, but those are the cards we've been given so far...

I told him that logic was counterintuitive considering people move all the time or they could simply buy it for someone else. I was referring to the original parent comment I replied to though - again, you absolutely can buy a gun for someone else as a gift but the main problem is that there is Supreme Court case law that says you cannot be the one that fills out the 4473 form if you are buying that gun specifically for the purpose of giving it to someone else, even if that person ls legally able to possess it. It's a dumb ruling in my opinion but the court at the time ruled that when you check off that box that you are the "intended transferee," you've committed a crime if you made that purchase with the intention of giving it to someone else at that time of purchase, even if that person isn't a prohibited person.
(It's still stupid in my opinion because what's to say I didn't get buyers' remorse immediately after purchasing said firearm, but alas your intent apparently makes a huge difference.)

Had a guy try to purchase a firearm once. He filled it out no incident but, he looked nervous. Manager told me to send it to the NICS system and it denied him instantly. Received a call 30 seconds later from an ATF agent who told me to stall until they came to pick him up(luckily he decided to go to the bathroom). As soon as he returned there were two agents with their guns drawn reading him his rights.

I worked at a gun store in California 21 years ago. I spent 4 years there.
I had a hand full of people that I suspected of a straw sell, but nothing even this close to this crazy.
Let common sence rule, but don't expect gun dealers to be investigators.
As far as my experience, we specialized in antique weapons. That's where we made the bulk of the money. Modern firearms(at about 25% mark up), was barely enough to pay the overhead.
It really wasn't breaking our heart to deny a sale on a glock or something.
Most of the time it was a young, small woman trying to buy a 1911 of some variant for her boyfriend. It was pretty clear she had no clue what was going on with the gun, and once we tried to strear her in a different direction, she would leave. At some point later, she would come back in with a man that clearly knew more about firearms than she did.
At this point I would simply tell them that I didn't fell comfortable with the sale, and they would leave with out issue.
It's a Grey area that some shops fall more victim off than others. In my case, the weapons that we made the most money off of were weapons that weren't prohibited to begin with, and brought us enough money to not hesitate to deny people like this.
At the end of the day though, there are no bad guns, just bad people.
