The guy gifts flowers to elderly, alone or homeless people for his tiktok. He films them unknowingly. First the old lady didn't had a problem but she started getting pity messages and all social media treated her like she was depressed and praised the tiktoker. It started to bother her and her family so she decided to sue the guy for filming him unknowingly.
The comments from stream viewers are priceless. Someone said she cant sue because of first amendment rights. People need to learn what the first is and what is does. Also, in most places, you have to consent being recorded. As in, someone cant legally use that video for anything.
why was everyone in her chat talking about how americans sue over anything and how he's allowed to film in public because of the first amendment blah blah blah when the people in the video are obviously not american... the guy had an accent, im not sure if it was australian or new zealand though.
That last clip with the guy recording the old lady. A bunch of people in chat were trying to say its against the law. Its not. Atleast in the US, people dont need to get consent to record someone if its in a public place. Someone can call the police on someone recording but the police will just tell the person who called that the person recording is allowed to do it. Its part of the first amendment rights. If it was on private property then that'd be a different story. Now given the guys accent I'm guessing that video wasnt in the US. So maybe the laws are different where it is.
i mean i don't know where it was filmed but it can be illegal in my country also (depending on how you were filmed eg in a crowd is fine but not like the old lady was). We have a "privacy act" that comes into play. There is some people that this doesn't apply as heavily towards (normally businesses or the news etc) but for individual things like this it does. You can get permission to use after the image is taken which can be argued that you have verbally but in this videos case he would have walked away so he could leave the flowers and not gotten it before so it was a surprise therefore couldn't claim this.
Hi there, to the Guy in your Chat with meaning, if you are in Public, then you can film everyone. NO, its also with Pictures of your Family and stuff, if some random People in the Backround, you need to ask that Person if have a Problem to be on it or you need to censor it, cut the Face out. That Person dont know anything about the Rule, Law, etc. People think can film, make Pictures of everything, if People in Backround, who cares. But if you get Unlucky like that Guy in the Video, someone can sue you and then you have a big Problem.

Yea I guess, but it's just sad because regardless of his intentions, the video was still wholesome. It reminds me of people trying to cancel Mr. Beast with that same logic that he wouldn't do it if it wasn't on camera, not knowing that he is actually more charitable offscreen than 99% of people saying that
