    Thanx for the info. Does this have any adverse effect on landowner or his tax liability?

    • @CleartaxIndia
      @CleartaxIndia  2 ปีที่แล้ว

      No, this document is to confirm if the business is actually carried out from the rented premises or not and the owner is aware of it. There may not be any other implications affecting the landlord.

    In case the business/company is not paying the GST, then will it have any implication on the landlord whose premises has been used for gst registration?

    • @CleartaxIndia
      @CleartaxIndia  ปีที่แล้ว

      There is no impact on the landlord of such a place of business.

    Attach permission from competent
    Authority / Municipal Corporation office / GMADA / PUDA, should I upload owner consent letter or do I need something from the authority.

      Hi. If you are referring to the consent letter/NOC that is required for GST registration, then the same needs to be signed by the owner of the premises from which you are carrying out your business. You will find the details and format in this article: cleartax.in/s/consent-letter-gst-registration-format-requirements
      You will need to upload the consent letter on the GST portal along with the other documents required for GST registration. You can find the list of documents required here: cleartax.in/s/gst-registration-documents-checklist.

    Now a days GST department asks for the relationship in the consent letter apart from other information you have just mentioned. Else they ask you to upload rent agreement

      If a property is owned jointly, all the parties must give consent to use the property for business purposes to get GST registration.

      Hi,
      Please note that in such a case, you may need to obtain a consent letter from the legal heir, if you do not happen to be the legal heir. Hence, you will need to produce the death certificate of the property owner to validate claims.

    My father died last year and our property is still on his name. So in this case can I obtain NOC from my mother???

    • @CleartaxIndia
      @CleartaxIndia  2 ปีที่แล้ว

      Hello Dipranjan,
      Your mother will need to prove that she is the legal heir of the property in order to issue an NOC. It is better to get the property transferred in your mother's name first and then obtain the NOC.

    I have own property and electricity bill is on my mother name but noc non judicial stamp paper I want to upload

    • @CleartaxIndia
      @CleartaxIndia  2 ปีที่แล้ว

      Hi, Please note that whoever is the owner of the property as per the property documents, please obtain NOC from that person. If the electricity bill is in your mother's name, she is the owner, so please take NOC from her. Whether or not to use the stamp paper would depend upon the requirement of the jurisdictional officer. But it is a better practice to follow.

    100 rupees stamp paper is required for this consent letter???

    • @CleartaxIndia
      @CleartaxIndia  2 ปีที่แล้ว

      @Ankur Sable, we have noticed that a few officers ask for the consent letter to be duly stamped and notarised. In such cases, it is required when demanded by the officer. Otherwise, the requirement is nowhere stated.

    • @CleartaxIndia
      @CleartaxIndia  2 ปีที่แล้ว

      @Ranadhir N, Hi, please note that for owned premises, the supporting documents are ownership deed/document evidencing the ownership. Apart from that, you must submit the latest property tax receipt, Municipal khata copy and latest electricity bill copy in the owner's name.

    For gst practitioner consent letter format

    • @CleartaxIndia
      @CleartaxIndia  2 ปีที่แล้ว

      @Sameer Shaikh, Can you please elaborate on the context here where consent letter is being asked? There is no such separate document required for GST practitioners. The taxpayer chooses the GST Practitioner on the GST portal, and the GST practitioner must accept or reject the request. Every step is online. Read more: tutorial.gst.gov.in/userguide/gstp/index.htm#t=Accepting_and_Rejecting_Taxpayer_manual.htm
