  • If I die without making a will - this is called Intestacy. How your estate is then decided is defined by the Rules of Intestacy. Here are 7 rules to explain what happens if you die without making a will.     My sis died In Nov left no estate just money below £50.000..what happens .she had no husband no children just 1 sister 1 brother alive ..NO WILL
    2024 I just found out that even the deceased siblings inherit ,and then you have to inform the dwp because it effects your pension credit .
    Absolutely a disgrace

    In your opinion how long should a persons will take to come to completion ? Just a basic straightforward will made at a solicitors in the UK.

    Hi Lee, thanks for the video. Please can you define “children”? I fear I am about to lose my late fathers home because his surviving spouse has died without signed her will. As I’m not her actual child, does “children” apply to me?

    I would really appreciate some help... My Mother Passed away last Month I Made sure my Mothers Accounts were frozen by contacting bereavement team and supplying the death certificate , MY Mothers Husband Estranged (technacly still married) and didnt even bother has now turned up after 3 years of not living with her is now Hounding and harrasing me for the entire state, Is it really the case he is net of Kin and My brother and I get Nothing, this is in England btw, thank you in advance for any help. Edit too add, i dealt with my mums funeral and expenses, there was no will left as i painfully went through the photos and documents . Thank you in advance

    Children is 'blood children' only unless you make a will to state them in the will. Adopted children are included within blood children.

    My grandmother Pilipina died 2010 and his british husband died 2019.My grandmother have sole property in uk but the problem my grandmother no WILL left.The property title still in Uk.The heirs are pilipino my mother and my uncle.Anyone can help please.

    Nobody mentions 7 year rule. If you were given money from the deceased within last 7 years of their death you have to pay tax on it.

    Thanks for sharing. To make a UK Will legal, does a UK Will have to be registered with the UK authorities?

      Who would you 'register' it with 🤔 It is obviously better to draw up a Will with a lawyer who will keep the original unti it is necessary to apply for Probate. Once a _Grant of Representation_ is received assets can be then be distributed.

    Question. Does the entire estate go to the crown if there are no surviving grandparent/uncles/aunts as well as no CP/spouse or children? What if you just have brothers or sisters...will they get the full estate or a share of it, before the crown? Thanks in advance.

      the brothers and sisters would each get a share of the estate but they have to apply for probate or else it will fall to the crown after 12 years

    Hi Lee,
    My father died recently leaving no will, but an estate.
    He was not married, but had a partner for 40 years. I am his only child & my question is where do I stand & where do I begin?

      Hi James’s. Technically you fall under the rules of intestacy as described. Having not being married the partner usually isn’t entitled unless the hold joint accounts/ investments and property and then they are entitled to their half. Call me to discuss 07805201314.

    Whats the point of writing a Will when it can be ignored and over ridden by a judge? Your last Will & Testament means nothing if a judge can ignore it and decide for themselves how your estate/finances are carved up. Plus any family member who may not be in the Will can contest it in court meaning your last wishes on how you want your affairs handled are completely over looked. I will never waste money on a Will only to have some stranger wearing a funny wig ignore my wishes and do whatever with my estate.

      Well you wouldn't wanna be within my legal position, so I suggest you have a will in which the beneficiaries that are susceptible to the distributions are prioritised within that document. As if anything happens individuals who aren't even within someone's bloodline do not benefit from the estate, only left to make illogical decisions.
