    I had to pay to trim a neighbor's tree back and their tree was doing the same thing to my roof. I feel bad for the disabled guy though. That's too bad. I don't like the smug look of the landlord at the end though. Not very neighborly.

      It's not the job of a neighbor who cuts their trees to also trim your side, too. Disability or not. It really isn't even relevant when people say the "if he was a decent human being" thing. This isn't the neighbor...he's the landlord over the property and has tenants. This is like going to the grocery store and asking the person in front of you to pay for your cart of groceries after they just paid for theirs. One of those "you just don't do that" kind of things that any person with common sense will say is a bad idea to even ask.

    Honestly there is nothing worse then living next door to a lazy neighbor . My neighbors house is a dump it’s a rental place and the landlord and the tenant just don’t care .

      Somehow I doubt that the Plaintiff 'can't afford' to hire someone every few years to trim some branches back. It's not that expensive. He's the one coming in there in a suit and the defendant literally has on, what, a white shirt and some kind of pullover and is much older?

    That's ridiculous. If you have a tree in your yard and it's damaging other people's properties, it should be your job to take care of it. All your neighbors shouldn't have to pay to clean up after you.

    I know it's the law in a lot of states that whatever hangs over on your property is your responsibility. The defendant seems kind of heartless when listening to the plaintiff's story. He may not care about being a good neighbor since he doesn't actually live there, but it's just kind of sad when the plaintiff can't do it himself or afford to have it done. It's too bad there are no family or friends to help him out.

      I'm more curious where the Plaintiff's family/friends are and why he thinks that his responsibilities are everyone else's or that because he maintained his side of the property for years that suddenly everyone should do it for him for free just because he became disabled. Dude is in there in a suit talking about not having the money to pay someone to trim branches. The Defendant is dressed in basic dress and owns the complex. That's a super nice neighbor that trimmed branches at the request of the Plaintiff. Most won't and it isn't because they're bad people, it's just a lot of work and they get nothing for it after working all day. He doesn't seem very grateful and doesn't know the law. I literally trimmed about 800 pounds worth of branches over the past couple of days from trees that are growing on the fence line. I have had lightheadedness and exercise intolerance for nearly 2 years now. They still haven't identified the issue yet. If I worked full time through all of that, he can get himself a pole and ladder. Just yesterday I trimmed using a pole to reach a branch around 20 feet high. That branch alone was probably 200 pounds.

    The defendant really rubbed me the wrong way. He may be legally right, but there are many ways he could've tried to work with the plaintiff. He honestly sounds unempathetic and uncaring. I feel bad for his tenants.

    Depending on local laws, you can cut back the tree as it intrudes onto your property, as long as that trimming doesn't injure or kill the tree.

      Anything over your property is always fair game. It doesn’t matter if it might kill the tree. Whatever is over the ground of your property can be cut.

Do some research before making a definitive statement. It's a grey area and even lawyers will disagree on this, but check out case law.

      I did look it up. No law states “you can trim a tree intruding in your yard as long as it doesn’t kill or injure the tree.” Guess what genius? Hacking off the limbs of a tree is the definition of injuring something! Instead you pivoted the conversation into the absurd about the air space above our homes to get away from the fact it’s you who needs to do your research before saying something asinine.

Ohio code S901.51 , and I'm paraphrasing, states that if the branches of a neighbor's tree overhang your property, you can trim them back to your property line as long as you don't encroach on your neighbor's property to do it, and you can't cut them so much that they injure or kill the tree. By killing or injuring the tree, you are liable for three times the value of the tree. Guess you didn't research hard enough.

      "No person, without privilege to do so, shall recklessly cut down, destroy, girdle, or otherwise injure a vine, bush, shrub, sapling, tree, or crop standing or growing on the land of another or upon public land."
      This is not public land, so this does not apply. This law covers some Joe Shmo going into a public park (or other public land area) and chopping down trees, it does not cover private property. There may be a different law in Ohio for private property, but this isn't it.

    I wish ppl werent such a**holes JUST bc theyre within the law. The man is disabled and on a fixed income, unfortunately his neighbors a jerk. I cant stand ppl like the defendant. It doesnt take much to bless ppl or make them feel like their feelings matter. It prob would not even put a dent in his wallet just to help the plaintiff out. He makes me lose what little faith I do have left in humanity. Why cant ppl just do things out of the kindness of their hearts? It has nothing to do with legalities or right or wrong.

      Just because the guy has a fixed income does not shift the responsibility to the neighbor. Leaves fall and blow. Limbs grow and if over your property you can them down. It’s part of home ownership. Yeah, it might be nice to work together to find a resolution to the tree but a new roof? No. The plaintiff has options but says he can’t afford it. But that’s not the neighbors problem whether he has money or not.

    It sucks for the Plaintiff but that's how it is in a lot of places. Any trees or bushes going past your property line you're well within your rights to cut back to the property line. You can't just let stuff grow then complain later about a problem that you anticipated. This case ended exactly as I thought it would.

      This case is timely, as my neighbours have a tree that is over the roof of my house and sheds leaves all the time... personally I love the shade and nature around my house, but my friend was saying I should tell them to trim their branches as it is ruining my roof... good to know that is in fact my obligation, not my neighbours...

    Because of the damage that tree has done to the ground underneath it and how it is growing out of the ground and damaging the sidewalk and the alleyway I would find a way to have that tree completely cut down if I had to spend money that I can't afford to spend

    Interesting, because in my neighborhood, all the trees are on the part of land between the sidewalk and the street and if you want it cut or taken down, you have to ask the town to do it !!

    The defendant is an arrogant landlord, doesn't live onsite, couldn't care less about his overhanging trees. Evergreens don't drop leaves, so if the leaves are clogging up the drains on the garage then they're NOT evergreens. The plaintiff should cut off every branch overhanging his garage, straight up to the sky, the tree is coming through the fence from the defendants property, not the alleyway!!

    I have a giant tree in front of my house and my neighbors want me to cut it down because they don't want to deal with the leaves. I live on a dead end with a circle drive but we also have a forest around us and they also have trees in front of their yard, so it comes down to nature just doing its thing and I clean up my yard along with some of the circle drive.

    The plaintiff should have used the money he spent on fixing the roof to trim the tree or have the gutters cleaned out so that the roof never got damaged due to lack of maintenance.

      @@AnneOhn123 he said that the leaves piling up in the gutters is what ruined the roof. They are his gutters so obviously he should’ve cleaned them out before anything got damaged on the house. I don’t know why someone would need advice to clean out their own gutters

      He won't be liable then ,either. The tree is obviously healthy, if it falls, the house it falls on better have insurance. Every unfortunate occurrence is not a successful lawsuit.

    Legally the defendant doesn't have to however morally he should at least do it once. He clearly lacks sympathy for others. I hope the other neighbors hear abt this case and trim the tree for the plaintiff. Sad that he's having to deal with health issues and this tree.

      @@ddinottia39 - The defendant said he bought his 3-unit building 46 years ago and rents it out. Assuming that the mortgage is now probably paid in full, other than taxes, insurance and maintenance, that property is mostly all profit. And I’d bet he has other rental properties and assets. So, no doubt, he’s doing very well financially. I doubt he’s on a fixed income.

    He wanted the neighbor to "trim the tree"...maybe it is different in other states, but in Georgia, you both trim the tree on your side if the branches are hanging over your property. You can trim back to where your property line ends, but not trespass on their property or cut anything on their side of the property. However, if it is on the property line, you can't cut the tree down, use chemicals or cut roots so as to kill the whole tree. If you do, they can sue you for sentimental value, the cost of removing the dead tree and/or cost of replacing the tree. Unless they're in agreement that it needed to go. If you can't clean the roof yourself, hire someone to do it. I don't think the neighbor is responsible for this guy's roof cleaning just because of some leaves from trees. I'm sorry to hear about his amputations, but that's not really relevant to the tree situation and not his neighbor's fault just because he can't get onto the roof. His neighbor looks older than he is. I'd like to know how old that roof was. Leaves don't just 'damage' the roof. It wears out over time. Also, nails push up out of boards due to the repeating hot-cold-hot-cold pattern of the seasons on virtually every house, which is why you see so many houses that have a new looking roof that isn't very old and yet it will have a few places where it is patched. The fact that he is telling the guy to keep 'his' tree trimmed...you're responsible for what happens in your yard and he's responsible for what happens in his yard. Every neighbor would be at war if we worried about leaves from each other's trees. His response at the end was, "I guess that's the law..." No, that *IS* the law and the judge just told you that.

    The law is the total opposite in France, it is absolutely the neighbour's (the owner of the tree) responsibility, in fact in France you don't have the right to cut overhanging branches of someone else's tree, (although people do) but you can ask permission and then you are supposed to give back all the cut branches, but people don't do that either...

I say this because as a Judge Judy aficionado, I have watched enough JJudy shows where the complaint is the same: someone’s tree is encroaching onto another’s property, be it branches, leaves, or roots. She has always ruled in favor of the person who is suffering damages. Her reason: the tree is the responsibility of the the person in whose property it is growing!

    I don't like the judges' attitude towards the plaintiff in this case.
    A simple receipt would be to check and make sure his insurance on his garage is well intact and then gasoline the tree and his garage and get paid. Don't put back another garage or make sure you don't have another tree either-or.

    He law aside (😂) the defendant is basically an a-hole. Who cares if he’s“semi-retired”, the plaintiff is clearly disabled and can’t afford the expense on his fixed income. No, by law, the defendant is obviously not required to trim the branches, and since he doesn’t actually live there, he doesn’t even care about being neighborly. Too bad.

    Be careful to look up your local laws/ordinances. What she said is mostly true, but in some cities there are laws to protect large/old trees from such extreme trimmings as it might fatally injure the tree. (If you take half of a trees branches in one fell swoop, you’re likely to kill the tree) . Not every common law applies to every jurisdiction

    I live in Virginia. My neighbor has a filthy river birch tree that I absolutely loathe. We are constantly cleaning our gutters of leaves, twigs, and the confetti seeds that clog our gutters and down spouts. We have to wait until mid June to open our pool because of the confetti seeds that will clog our pump. In Virginia, I legally have the right to hire a tree company to cut the tree away from my property line, and we have. It is a royal pain in my ass but that is the law. We have to constantly work at cleaning this shit tree’s debris, we have to pay hundreds to have it cut away from our property, but it’s not my f*cking tree. 🤷‍♀️

    Milian did the plantiff dirty which is typical for her with respect to how she handles Black litigants in her court room. As soon as she asked the plantiff had he gone on the defendants property to take that first picture of the tree, thinking she got him in a trap, I knew it would be all down hill from there. She's funny with Blacks no question about it.

    First of all while the law may say the plaintiff is responsible, the defendent is just being an ass. His tree is way overgrown as was other trees in those pictures. My husband and I bought our house a year ago and we made sure to cut the trees surrounding our house because we don't want to deal with them destoroying our house or our neighbors. That is just what a good neighbor does. Also, the fact that the defendant came out with that shit eating grin and said "it's an evergreen". No sir that is not an evergreen. Evergreens do not lose their leaves in the winter and become bare. They are ALWAYS GREEN hence the name EVERGREEN. I feel bad for the plaintiff have to live where the other properties obviously aren't cared for.
