I have studied in a missionary school. My physics teacher was a nurse, she used to wear gown and head cover what nurses usually dress. There was no restriction on hijab as such.

I have also studied in mission school . No type of religious symbol locket, kada or anything was allowed to be worn over uniform. All school have right to frame rules of their uniform. Individual choices don't supercede rights of Institutions.

A very informative and intelligent interview. Personally, I don't think it should be a problem, as long as the girl chooses to wear a hijab. When I studied in a convent school, muslim girls would wear their Abhaya to school and remove it before getting to class. Even if they wore it to class, no one objected. This was in a all girls school. I lived in a muslim country, the UAE for several years so have worked with muslim women both who wore hijab and those who did not. To wear or not to wear the hijab is one's personal choice and we ought to respect that.

With all respect to Karan for the great line of questions... he obviously got couple of things wrong while he set the premise for the discourse... i.e. he mixed up between full face veil (niqab) and hijab (khimaar) which is headcovering.... also, that he mixed up in the Contexts of past high court judgements, while calling them mutually contradictory whereas they are not! All judgements varied due to Contexts i.e. All-girls school, or minority educational institutions etc... however, none of them challenged the hijab in govt and public institutions as it is essential / integral part of Islam. An amazing interview indeed... kudos to Hegde and Kamat for doing a job so well... clearly judges are not in the best of the lights due to the interim order they issued undermining the fundamental rights of citizens of India.

@@unison2679 The appeal has been filed in the Supreme Court, please request your counsel to present this aayat, its context and interpretation from a recognised and well-established authority and the way the hijab practice is followed in other nations especially those that have Islam as their state religion. The High Court is bound by previous Supreme Court judgments hence if your claims stand the veracity and scrutiny of the Supreme Court then hijab may well be recognised as an essential practice.
I agree with Mr. Sanjay Hegde. The onus needs to be on the state and the saffron hooligans to justify their position as in why do they have a problem with the attire of people and how is it valid ? U said it : it is college. In school children wears uniforms. Hijab can not be part of school uniforms. Hijab is not an essential part of Muslim women. It is discretionary.

Notes Hijab - cannot be denied per se, fundamental right But if there is some circumstance the state sees that requires denying, only then (specific situation/circumstance-based) How to decide if something's integral to the faith? Judges are not experts on religion; there could be different opinions by different religious experts. Freedom of religion + freedom of conscience If people assert a certain belief / conscientiously believe in a practice (hold a belief), there is religious backing/evidence, and a large section of the people follow it - the state cannot deny them the freedom to practice it. The state cannot interfere unless there is a serious/strong (very great) justification, and the interference cannot be beyond what's absolutely necessary. Government institutions - should accommodate, allow for opportunity for all groups, such that no section is disadvantaged Private - may have discretion... If Hijab banned, my the same logic, other signs of religious expression that are common, would also need to be banned... True, but we don't want to follow the French model. In India, secularism means pluralism. We cannot impose uniformity upon diverse peoples. No legislation (Act) which imposes uniformity in dress in schools/educational institutions, it's only in Rules made from the Act. HC order, no interim relief, cannot go to schools/colleges with Hijab, isn't it like having taking a stand (essentially a judgement) during this interim period while the judgement is still under evaluation? So, is the court order lawful/justified?

Sanjay Hegde says that the girls have been wearing Hijab for years but there is a class photo of the Govt PU college which shows all girls without hijab. I also saw an interview with a Hijab wearing girl on NDTV who said that they all wore hijab only till the entrance of the class and then took it off. But recently some girls started insisting on wearing it inside the class.

Heaven wouldn't have fallen had the controversial order of the government or the educational institution been stayed in the case of Udupi. India is country of diversity, hence uniformity cannot be imposed.

if the hijab can be worn in a class room where a uniform is mandated, then they should be allowed in armed forces, ncc, police forces and all other institutions. Also the same privilege should be provided to all castes and creeds in the country. So the great cultural ethos of India can be demonstrated in all it's glory and young minds get an overdose of education.

Hijab is practiced by Muslim women all over the world.. you can see it overwhelmingly in every muslim population in the world.. everyone in the world irrespective of religion knows hijab, and knows it is related to Islam.. if it was local practice you would have not seen it in every country and in every ethnicity. This shows that vast population of muslim population believes and practice it as Part of Islam.
I have seen small Hindu temples inside central hall of government schools and colleges in Karnataka and I have seen students putting tilak and bindiya on there foreheads in government schools and colleges and at that time no questions or no one thinks about uniformity and is that not a discrimination against other communities students then why targeting only Hijab

Personally, I don't think it should be a problem, as long as the girl chooses to wear a hijab. When I studied in a convent school, muslim girls would wear their Abhaya to school and remove it before getting to class. Even if they wore it to class, no one objected. This was in a all girls school.
I lived in a muslim country, the UAE for several years so have worked with muslim women both who wore hijab and those who did not. To wear or not to wear the hijab is one's personal choice and we ought to respect that.

With all respect to Karan for the great line of questions... he obviously got couple of things wrong while he set the premise for the discourse... i.e. he mixed up between full face veil (niqab) and hijab (khimaar) which is headcovering.... also, that he mixed up in the Contexts of past high court judgements, while calling them mutually contradictory whereas they are not! All judgements varied due to Contexts i.e. All-girls school, or minority educational institutions etc... however, none of them challenged the hijab in govt and public institutions as it is essential / integral part of Islam. An amazing interview indeed... kudos to Hegde and Kamat for doing a job so well... clearly judges are not in the best of the lights due to the interim order they issued undermining the fundamental rights of citizens of India.

Religious freedom is allowed therefore a Sikh with a turban can study in a class as it an essential Religious practice, Hijab, burqa, nikab or chhadar are not essential Religious practice as per Quran for those who have Islamic beliefs hence not allowed in the classroom. Instead of delving on the crux of the matter they have just done bakvas in-line with The Wire's minority appeasement policies. @@unison2679 The appeal has been filed in the Supreme Court, please request your counsel to present this aayat, its context and interpretation from a recognised and well-established authority and the way the hijab practice is followed in other nations especially those that have Islam as their state religion. The High Court is bound by previous Supreme Court judgments hence if your claims stand the veracity and scrutiny of the Supreme Court then hijab may well be recognised as an essential practice.

How to decide if something's integral to the faith? Judges are not experts on religion; there could be different opinions by different religious experts.
Freedom of religion + freedom of conscience
If people assert a certain belief / conscientiously believe in a practice (hold a belief), there is religious backing/evidence, and a large section of the people follow it - the state cannot deny them the freedom to practice it.
The state cannot interfere unless there is a serious/strong (very great) justification, and the interference cannot be beyond what's absolutely necessary.
Government institutions - should accommodate, allow for opportunity for all groups, such that no section is disadvantaged
Private - may have discretion...

No legislation (Act) which imposes uniformity in dress in schools/educational institutions, it's only in Rules made from the Act.

Sanjay Hegde says that the girls have been wearing Hijab for years but there is a class photo of the Govt PU college which shows all girls without hijab. I also saw an interview with a Hijab wearing girl on NDTV who said that they all wore hijab only till the entrance of the class and then took it off. But recently some girls started insisting on wearing it inside the class.
I respect their sincerity when they say they aren't experts in islam or religion.

I have seen small Hindu temples inside central hall of government schools and colleges in Karnataka and I have seen students putting tilak and bindiya on there foreheads in government schools and colleges and at that time no questions or no one thinks about uniformity and is that not a discrimination against other communities students then why targeting only Hijab

Since the day the sanghis have started poking their nose in the religious matter of other communities things are spiralling out of hand and the country as a secular democratic republic is losing its status rapidly.

In the USA, schools allowed prayer room let alone wearing hijab. Government’s fundamental job is to honor dignity and protect the life of their people. The topic should be discussed should we allow mob to harass women! Should mob become the the judge? See the big picture! You should also change your education system from memorization based to context based.
What are you talking about Mr Suhail Ahmed? In US schools there is no uniform system. Girl kids go to school even with makeup (lipstick etc.). They even start having sex with each other while still in high school. What if an organization has a uniform system, anywhere in the US you must respect the regulations and follow the system.
