Herefordshire farmer jailed for damaging protected River Lugg

  • A Herefordshire potato, beef and cereal farmer has been jailed for 12 months for badly damaging a protected stretch of the River Lugg.
    John Price, 68, has also been disqualified from acting as a company director for three years.
    The Environment Agency estimated Mr Price caused £600,000 worth of damage after he used a bulldozer to reprofile the river and its banks in Kingsland, near Leominster.

    Making sure people's homes and property are protected from flood waters.

      @@charlessmyth I agree that putting him in prison won't do much good, but it does send a message. The man is a destructive vandal who happens to own riparian habitat. He wasn't doing anything to alleviate flooding. In fact, all that loose soil will have gone in the river and made flooding worse.
      In my opinion, the senior managers of the greedy water companies should be joining him, as they have deliberately filled our rivers with raw sewage over the last 35 years, while making obscene profits

    All over the country the cry has been for years that the River Agencies no longer dredge rivers to prevent flooding, thus causeing towns to flood.
    Here the good man uses his own money to clear out the old debris to clear the way for the river to flow freely.

      Absolute nonsense. Dredging is an environmentally destructive practice that makes virtually no difference to flood alleviation. In fact, what this landowner has done will make flooding worse, as all that loose soil will clog up the riverbed, damaging fish spawning habitat and slowing the flow of the river.
      Whenever I hear someone mention dredging as the answer to flooding, I immediately know that I am talking to someone who knows very little about rivers and riparian habitats.

      You obviously have very little knowledge of how rivers work. I hear so many clueless people trot out the tired old cliche about "dredging the rivers". The problem is in the upper and middle reaches, where land drainage is too efficient, sending excess water off the land too quickly. Then, the drainage engineers had to build huge floodbanks in towns and cities and that just sends more water downstream to the next town. It had taken a long time, but drainage engineers are gradually accepting that this does not work and the solution is to slow water down in the uplands, while allowing rivers to flood farmland (their natural floodplains) in the middle reaches. Slowing the progress of extra water down, rather than speeding it up. Dredging has no part to play in this. It is best reserved for stilted up drainage ditches and old ponds. Definitely NOT rivers.

    What's the problem here?
    The river bed will have new life in no time. Nature repairs and will thrive.
    12 months inside seems bloody harsh when you hear that rapists are given suspended sentences because prisons are over crowded.
    There seems to be something fundermentally
    wrong with our system of justice?

I am sick of people like him getting away with destroying the environment. It is time to start fining and locking these criminal farmers away.

    Judge Tree-hugger as the tip-of-the-spear for the Eco-Terrorists. The farmer did a fantastic job of an intervention to a traditional let-go-to-the-dogs situation. The grass will all be back and rampant by the end of July. New trees will be planted in a location that will not undermine and collapse the river banks.

    He turned a beautiful river into a lifeless ditch. He’s promoted erosion by removing vegetation that holds soil together. He’s done nothing to prevent flooding downstream. More vegetation is the answer to reduce flooding as it holds water and releases it slowly.
    How can you guys not see this was foolish?

    The government and councils say flood prevention measures are the responsibility of the owner of the land and one someone decides to clear the river and prevent the risk of flooding in the future they are punished. This farmer has only done what should be done in more areas of England where the rivers suffer from appalling lack of maintenance causing £billions worth of flood damage practically every year.

River banks and drainage have to be maintained it is the responsibilities of the land owner , but those who shout and complain are heard , this should have been thrown out so

    But why would he think he could get away with clearing out what looks like half a mile of trees anyway 😂, I mean the trees would of absorbed some of the water, there would of been more wildlife there, it’s not going to go unnoticed, cmon you can’t even spread slurry without some sort of ban or restrictions now. He must of been expecting some consequence. Whether he was doing ‘good for homes’ is irrelevant, as the river was protected not by him.

      The roots of the trees undermine the banks, which then, in time ( at about the time that this intervention was done) , collapse into the river. Hello. . . Hello . . . Anyone in there ? :-)

    I'm hoping there's more to this than meets the eye, because this appears to be an error of judgement and headstrong action by the farmer, but does it really warrant imprisonment and such a massive fine? Real criminals with malicious intent against their fellow man are treated with kid gloves in comparison in this country, I really fear for my children's future.

      He fully deserved this sentence, as he had done something similar in the past. Destroying delicate habitats of fish, bats, otters and other wildlife is an environmental crime and an example needs to be made.
      Hopefully, this sentence will frighten a few of the senior managers at the privatised water companies who have been pumping untreated shit into our rivers on a vast scale since privatisation in the late 1980s. They have made massive profits for shareholders, while the taxpayer (Environment Agency) have been left to clear up the mess.

    Definitely worth reading the Wikipedia page on the River Lugg and following all the linjs to get tge full story. The EA had in a conversation said they wanted one bridge arch cleaned. Price, the landowner, claimed this as the basis for his unilateral action of stripping all the trees and gravel from nearly a mile of river, using the gravel to build a hardstanding for his own use. Price also inadvertently admitted that he had previously illegally felled trees, including one blocking the bridge arch. So yes, Price deserves some jail time so he can reflect on his decision to try and mislead the court and the public, as well as because of the ecological damage he has caused. I expect he would gave got a shorter sentence if he had been honest with the EA, the press and the magistrates.

    All the stuff dredged out of the river is stuff washed in off the fields. Why can't farmers get their heads around this? After a rainstorm the whole Bristol channel is the colour of drinking chocolate. Year in year out tonnes and tonnes of top soil washes into the rivers and out to sea.

    After watching the video, I read the full article on the Farmers Weekly website. It is a bit more involved than the over-simplified video suggests. Unfortunately, it seems that he was very much in the wrong, even if his intentions were good. Nevertheless, I completely understand the anger at the sentencing. The justice system in the UK is ludicrous. People who commit far worse crimes get served community service orders or suspended sentences. It is ridiculous. John Price was clearly guilty of breaking laws and refusing to adhere to a stop work notice, but surely a suspended sentence would have been in order. As for the utterly useless Environmental Agency, local councils and the entire bureaucratic and political system, they are even more of a joke than the judicial system. Especially when it comes to the agricultural industry.

      This is why we employ judges and judges take a long time to weigh up the evidence. They apply the egregious nature of the act, the aggravating factors and in this case the excuses used in mitigation. This was a sound judgment in my opinion and I would welcome a further ruling by the appeal court.

    Farmers of the uk, start doing what are European farmer friends do, get down to London cause havok on the roads with your machinery spread shit across the capital and stop your products reaching the shops!
    Says it all about this country come over illegally and get a nice hotel weekly allowance and don’t actually provide anything positive for the country! Do something that’s positive and saved homes from flooding you get to go to prison.
    Only got to watch clarkson farm to see how our farmers are being treated.

    This is a case of do what we say but we don't do anything. The Environment agency and Yorkshire Water are involver an a court case where they are responsible for polluting a waterway in the Malton area. Fighting government body's is so frustrating

    Obviously neither the river board and natural England have not been back to see the natural regrowth of the Lugg. I expect they want the hundred of thousands of pounds not to reinstate the river instead its needed to renew their fleet of Ford Rangers so they can just ride round.
