Well, here in FL it's just a slap on the wrist. Neighbor had five DUI's and jokes the worst punishment is his insurance rates. Kill someone driving drunk and get a lesser sentence than selling drugs. What a failed system that only encourages drunk driving.
It's not advisable for anyone to do those tests because they are pseudoscience (e.g., were never peer reviewed). Of note, the (defunct) government contractor that submitted these FSTs to NHTSA indicated that they are not valid for subjects over 65. Without the FST evidence, the evidence would be the "canned three" of glassy eyes, slurred speech and odor of alcohol + 16 over driving a Lambo. Especially, without FST evidence (or other more tangible evidence than 16 over in a Lambo), a lawyer may also have been able to suppress chemical test evidence based on lack of probable cause. (A pro-se defendant could try, but that ain't gonna go anywhere.) He had to have insurance. No rental company would hand over a car without having the renter also sign a policy for it. Would have been with the rental papers. His video with the rental agent would also have presumably confirmed that (which is presumably what he was trying to show).
