    For someone who didn't bother to look at the damages as soon as it was presented to her, she surely made a big deal out of the whole process!!

      The judge was wrong. After all, the woman waited ten days or so to look at the damages. She also didn't allow the guy to make the repairs. He probably would have made the corrections. Again JM sided with Karen.

    This guy was willing to fix what he had done wrong. Meanwhile, my neighbor takes a leaf blower every fall and blows his dead leaves and junk into an 8 food high pile for me to clean up every year, on my lawn.

    The defendant was negligent with respect to the varnish but I believe it was a legitimate mistake. But folks aren't neighborly in the way they use to be these days compared to how things were in the past. It's why I avoid as many people as possible these days. It's just not worth it.

    A couple of months ago I had all my fences stained. He did it all with a brush. He told me that a sprayer doesn't do as good a job and always makes a mess. The fences look brand new and absolutely no stain got anywhere except on my fences. I hire this guy for everything outdoors and he is amazing. I'm so happy I have someone I can depend on to always do a fantastic job.

    As soon as she said that about the snow, I got a bad feeling about her. I live in Maine and I let my neighbors push snow off their driveway onto my lawn. It would just be downright mean not to. There's nowhere else to put it.

    I absolutely hate having neighbors. They would be fine if they would just stay within the confines of their own property. Life goal is to buy acreage away from close neighbors.

      Doing that is a lovely idea, but remember someone is going to own land next to you. We have that problem actually. Have a cattle ranch in the mountains with a home on it, and have neighbors who don't have a house but have property near our 160 acres, and they have tried to cause problems aka trying to keep us from using the road to get to our property.

      @@redgurl60 but she has a duty to mitigate her loss, in this instance the neighbours hired a contractor and she refused to let him do the work.
      Her claim ought to have been reduced to the amount the defendant had arranged a repairman at.
      She ought to have let him complete the work then sue if not happy

      Whole mitigation is sometimes over used or misused I still feel that she acted unreasonable in this instance which is well here in Australia the true test.

It was said nicely and I don't think it's unreasonable to let a neighbor know if there are any issues with respect to keeping property in good order. It goes both ways. Allow a 'church lady' speak her mind... funny how people rise up in arms. Let's focus on how this fellow damaged her property and didn't have the nerve to knock on her door and take responsibility.

    The judge should have looked at the estimates and picked one that is affordable and not only go with the one the plaintiff presented. Besides the defendant acted in good faith trying plan A to B to remedy the damage which he acknowledges. Judge Milan should have done better

    I'm mindblown over the negative comments about the Plaintiff. 1st of all she's as easy-going as they come, she had no attitude when she was told the neighbor caused damage. She took him at his word & didn't go looking to complain about any little thing. Meanwhile the Defendant lied & said he only damaged her fence. The Defendant didn't try to fix his mistake when it happened. If he had tried to pressure wash it happened, it might have come out, not 2 weeks or a month later. He didn't try to fix it until he was called out about it. He was absolutely out of order to send someone to work on her house without clearing with her first. This guy clearly has no respect, thinks he can do whatever he feels like & doesn't have to listen or ask for permission. Nevermind the sneaky that he tried to get it done when she wasn't home. The clear problem here is the majority trying to perpetuate the angry black woman bias, whenever she has the nerve to stick up for herself. The judge had the right ruling pay to fix her siding back to the way it was "before" you damaged it and you eat the costs for your arrogance. That's all folks

    What did I miss? Was he throwing snow in her actual property? Or on the side of his own property? If it was his own, then what right does she have to tell her where he can put his snow? Just because her basement floods that her friggin problem not his. She obviously needed to pay someone to fix whatever her problem is. But if he tossed it onto her property then I understand.

    Shes one of those elderly people that's been living in her house for decades And has an issue with anybody that moves in. Plus, didn't she say her daughter told her about the accident and she didn't immediately check in the beginning but then her daughter says he never said anything...😕. That was a bit off and surprised the judge didn't catch it

    I mean I wouldn’t want someone to send a random man to work on my house unless I’ve seen reviews and references. I would want to find someone myself then get the quote myself and show it the guy. She may seem a little tough but she’s just not a slow old lady. I do think she could be a little nicer but she was in the right. Her husband should’ve been the one dealing with him IMO

    Gotta say, I like the plaintiff. She’s an example of ‘she’s lived and learned’, ‘knowledge applied is wisdom’, and ‘an ounce of prevention is worth a pound of cure’. I have to respect her position on the defendant’s choice of contractor. She has to protect her property, and what could’ve gone wrong had he done a poor job.
    The defendant was very reasonable, a good guy. I hope they were able to be friendly, or at least civil, neighbors after this.

    It is not cheap to get varnish off siding. Dude was into saving money and she knew it would cost. And even to replace the siding, it costs more if they can find the same type and color of the siding and install.

    The defendant meant well by hiring a contractor to correct his mistake. The plaintiff is a Karen. Again, the judge was wrong. This gives the plaintiff more reason to be a jerk.

      im a painter and this was a easy fix , and to paint the side of the house and the fence would have only probably cost around 800 total .

    They both seem like decent people. I tend to side more with the plaintiff on this one. As a homeowner, if you damage my property, specifically the siding on my house, you don't get to hire the cheapest person you can find. We're going with the original contractor.

      I was thinking that’s what I would’ve done as well since she clearly was asking for a crap load of money for it, it’s like trying to meet her in the middle because we all know if he presented her with a $400-600 estimate she would’ve laughed in his face- she’s clearly even more picky than he expected

      You don’t have to like your neighbors, not all neighbors are likable, it’s not bad to hold grudges with neighbors or anyone else, people have the right to do so and they have the right to forgive someone or not , if they decide to forgive , they can do that on their own time, if they never forgive , then it’s their choice, depends on the two or more people involved and the situation

I used to have a neighbor who operated an "unpermitted" home business and his customers would come and park in front of my house. Did it for years! After many attempts to change that, I finally called the County on him and he got fined over $1000 -- and then even more problems ensued. And then there's the other neighbor who was like family to us (we comforted her husband who died, pet-sitting, plant-sitting, food exchanges, etc). Neighbors come in all packages. And like you said, it's not bad to hold a grudge. At least, you KNOW you are holding a grudge. Awareness is everything. Real forgiveness is rooted in awareness, otherwise it's only dismissal because "you are not supposed to have a grudge; it's bad for your well-being."

    He paid a contractor to fix the damage and she wasn't satisfied with that. She's money hungry she wants more money then the damage's worth should of took what he offered.

    I had a grouchy neighbor overspray his fence, a fence he made clear was 3 inches in on his property so it was “his” fence and he killed my rose garden 😏. He didn’t offer to pay for anything so I refused him access on my property to spray the next time.

    I think these two were some of he most reasonable people who aren't bad people. The guy paid for his inexperience in how air painters work...they are nice ,but only in the right place and or conditions,no wind,and or no other objects around that you don't want to get paint on.🤪👌

    WHAT? It was just a few splashes of varnish (stain), yet he has to replace the whole siding, why not just repaint it? How is that reasonable, what about the age of her siding? Why isn't that taken into account. What is going on with the judge to award her $1700 to get rid of a few splashes of varnish?...

    I believe in grace, forgiveness and honor when dealing with a neighbor and especially from a church lady. She lacks all of those things and she’s not a kindly person but expects the same from others. She’s a Karen and you can tell he’s above it just to keep the peace but honestly they don’t always have to get their way especially if they lack the grace to return a favor in kind. She’s an asshole.

      He damaged her house. He hired a contractor to work on her house without her permission. He thought he could bully her into doing what he wanted. And the judge shut him down.

      @@goblueinga I don’t think he tried to bully her, she may not have agreed with the person he chose but at least he tried to fix it and it was an honest mistake. Of course no one likes their things to be damaged by others but she’s not going to die from it and he did the right thing by trying to fix it, people only know how to fix it correctly if they have been in that situation clearly that was his first time and she was honestly just mean even the judge said she could have been more neighborly when she described the first incident.

    Defendant, normally contractors will charge the innocent people for the work they do. That is what was she was afraid off. You need to work on being a neighbor and remember that older people do not trust others, so try to visit and build a friendship with her then offer to repair the damage. And she was smart to the cheap contractor that she needed a contract before he touched her house. I do not blame her for yelling at a fool who was willing to work without a contract.

      Actually, it’s the same in the USA; many people don’t know their neighbors names. In rural neighborhoods and in the southern states, it’s different. They know EVERYONE and speak to everyone. The downside? They also know everyone’s business!😁

    The worst I ever had was neighbors in a condo building. The people for the most part were great except for the clunky people who made awful noise after 11pm. The building was horribly unsound insulated. My single family and twin house never had a issue
