So the FBI does more than just investigate, they decide whether to prosecute? Why have a DOJ? Crook.
Great question. I believe you are correct that the DOJ is responsible for the actual prosecution but the FBI will make a recommendation on whether to prosecute based upon the facts of the case. Given Mr. Comey's background as deputy attorney general and US attorney he was in an excellent position to make that recommendation to DOJ.
First I would’ve insisted/suggest strongly that Lynch recuse herself from HRC investigation, instead of handing over DOJ duties to FBI. Never is this a choice in Coney interviews.

5:25 first lie..... second lie not about server but mishandling classified information. OK because she had a personal server and sent and received classified information on it was an important tool to uncover mishandling classified information.
I understand where you're coming from but I think you're misunderstanding a key point. The legal standard is the person under investigation must know and be aware that what they are doing is illegal. Ignorance is not illegal. Knowing that having said private email and still using it would be illegal. You can see Mr. Comey explain this @1:00:48. But the FBI, after reviewing hundreds of thousands of emails, was unable to reach that conclusion.
