    I think SCOTUS took Rahimi (sp) as a way to play politics. It was a stupid case from the beginning and allowed SCOTUS to regain favor with the people and politicians to show they will to their bidding. The only one who doesn't think that way is our guy Justice Thomas. He just calls it like it is regardless of what people think of him. A true American Hero.

      People aren't really paying attention to the one part in Rahimi that really matters: The fact that SCOTUS vote the way it did because it openly stated ".. been adjudicated".. ie.. went to court. Not a bench order. Not a random decision. But an actual court case. It's going to slaughter "red flag" laws in short order. I'm just wondering why these TH-camrs haven't caught onto that other than VivaFrei.

    I think the biggest point is the statement in Cargill by Sotomayor that AR15s are in common use. That kind of blows a hole in Illinois argument.

      @@Paiadakine Instead of being thrown in jail, "Restraining Orders" dump the government's responsibility of placing criminals who should have been under custody onto the detainee himself, and onto the public at large. By decree, the restrained party is suddenly faced with homelessness, a cruel and unusual punishment.
      Therefore, detainees are suddenly faced with the situation that they must BEG to be housed in prison--at least with three hots and a cot--which is a big step up from his homelessness that has been decreed in exchange for not abiding by the wife's whining orders for oral sex, when she refuses to shower or shave, or for his inability to supply her with more money to waste vacationing.

    We need clemency reform for non violent felons please. They allow 2a for illlegals that could have escaped prison but I cannot protect my family over a 20+ year old non violent charge that’s now one of the countries biggest income

      You have to actually pay the 11% to establish the grounds to challenge it first. It's how you obtain legal standing to bring the case.

      Careful what you wish for… if we were a direct democracy, you’d have long since lost all of your constitutional protections. The SCOTUS is currently the only branch attempting to remain somewhat close to the rule of law.

    Don't read anything about "common use" , "tradition" , or "usual" in the 2nd amendment as written in 1791 writing of the US Constitution
    When wiil they reread and apply as written into the cases (BTW it should never get out of county courts and just affirm the 2nd Amendment as written)

    First place, they aren't "assault weapons". Semi auto is not fully automatic.....

      Wrong! All guns are assault weapons. Their primary function is to assault. With that said that is the reason they call them assault weapons so they can take EVERY gun.

    What does the decision do for states that have magazine laws that prohibit buying or selling “high capacity” magazines, but not specifically banning the possession of them? A MD resident cannot buy or sell them in MD, not buy them via mail. But they can travel out of state and bring them home.

    Here is the Rahimi language you may want to consider.
    “The conclusion that focused regulations like the surety laws are not a historical analogue for a broad prohibitory regime like New York’s does not mean that they cannot be an appropriate analogue for a narrow one.” Rahimi at pp. 15-16. (Don’t recall the correct citation to a slip opinion).
    General prohibitions on entire classes of weapons or magazines above certain capacity would likely be unconstitutional under this test.
    A bar on individuals judicial determined to be a threat to the public, after providing an opportunity to heard, from possessing certain kinds of guns or magazines about a particular capacity would likely be constitutional.

    i feel Rhemi was a bad example to move that case to the supreme court.. he had a lot more against him then an unrulily wife or a false restraining order. he is legitimately a nut job and using him for a 2a poster child was a bad decision to begin with.

    There are so many mixed opinions about the Rahimi case out there so I guess we will just have to wait and see and hope for the best. When it comes to the 9th Circus, I still expect bad news all around. I would be surprised if they send Duncan back to Benitez again, lol.
