    Today all judges are selected by judges themselves which is wrong.
    Only 300-400 families of India control whole judiciary system of India.🙏🙏

    Sir, As per policy, Chief Justice of High Court of any state is always from other state and not from the same state. A judge cannot be appointed as CJ in his parent High Court...

    सुप्रीम कोर्ट भी इसमें निष्पक्ष नहीं है लेकिन सुप्रीम कोर्ट राजनीतिक हस्तक्षेप से बचा सकती है जो इसे न्याय प्रणाली के लिए सबसे उचित है लेकिन एक सीधा अर्थ यह भी है कि न्याय प्रणाली को जनता ने नहीं चुना है और मुझे ऐसा भी नहीं लगता कि न्याय प्रणाली हमेशा जनता की भावनाओं का ख्याल रखती है

      Judiciary hi ek aisi jagah hai jo kisi ko accountable nahi h. Vo kuch bhi faisla le sakte h, kisi bhi majority se pass hue bill ko cancel kar sakte h.
      This is too much power, ye to wahi baat ho gayi ki desh me do sarakar ya power center hai ek logo dwara chuna gaya aur ek judges ke family dwara.

    What are the chances NJAC would not promote favouritism in appointment??
    Local Courts and their judges are not performing their job that's why pendings are increasing.

      Same collgium system is run by favouritism of family members and connection and NJAC will make it political, both system appear to be defective, it's like a power struggle where two centres of power are fighting with each other.

    All India Judicial Service (AIJS) has lingered in the backdrop of the judicial reforms debate for almost sixty years. The purpose of the creation of a judicial Service Commission is to help the recruitment to the post of district judges and review of the selection process of judges/judicial officers at all levels.

      @@anshulrathor9620 supreme court guardian hai malik nahi jo usko critisize nahi kar sakta koi, aur jis collgium system ko ye judges bacha rahe vo bhi samvidhan me nahi h, ye baad me bana hai, so itna abhimani hona sahi nahi ki jo hum bole wahi antim faisla hai iss desh ka.
      Aapko kya lagta hai judges jo ek dusre ko appoint karte hai vo kisi politician ke prabhav me nahi? Unke parivar se koi politics me nahi.
      Ye samvidhan khatre me aa jata hai jab bhi ko8 sawal pucha jaye? Koi accountibilty nahi h kya judiciary ki?

    As per a report given by the National Court Management Systems in 2012, the number of cases that would be filed in 30 years would be as high as 15 crores.
    To handle these many projected cases in the given timeline, there would be a requirement of 75,000 Judges.
    A “properly framed” All India Judicial Service (AIJS) on the lines of other all-India services would help in strengthening the overall Justice delivery system.

    As per the amended Constitution, although Article 312(1) gives provision for setting up All India Judicial Services, a resolution must be passed in the Rajya Sabha with the support of not less than two-thirds of its members present and voting.
    Thereafter, a law for the creation of AIJS has to be enacted by the Parliament.
    The challenge behind the implementation of the All India Judicial Service (AIJS) is that the filling of vacancies of Judicial officers or Judges in Subordinate Courts and Districts is the domain of the respective High Courts and State Governments.
    Hence, the Government has to take a consultative approach to arrive at a common ground as the different stakeholders have diverging opinions.

      O bhai ye thoda galat procedure hai but jis din gov ke hath me chala jayega us Laude lag jayenge judiciary system ke. Collegium ko hata ke koi aur system lana chahiye jisme transparency ho but gov ke hath me bhool ke bhi mahi jana chahiye otherwise it will disaster.

    अगर जजों को कोई भी सरकार अपने हिसाब से नियुक्त करने लगी तो जज ईमानदारी से और स्वतंत्र होकर न्याय नहीं कर पायेंगे फिर सरकार के दबाव में ही IAS,IPS, की तरह जजों को भी काम करना पड़ेगा ओर सरकार की इच्छानुसार काम ना करने पर ट्रांसफर कर दिया जायेगा ।

    Minister should wait for such statements until supreme court opens (next year January) after winter vacation time, After such hard work they are on vacation of 15 days out of 159 yearly holidays

    क्रांति तभी आती है.... जब लोगो पर अत्याचार होता है। कोर्ट अगर अपना काम अच्छे से करे तो किसी को कोई दिक्कत नही। पर जब मामूली केस भी 10-15 साल तक खीचे जाते हैं तब लोग तो दुखी होंगे। कोर्ट की छुट्टिया देख लो कितनी होती है। केस की pendency कितनी है। फास्ट ट्रैक कोर्ट ना के बराबर है। VIP और पैसे वाले लोग आसानी से कोर्ट से छूट जाते है और गरीब का घर बिक जाता है न्याय के लिए। कोर्ट में ज्यादातर भाई भतीजावाद, corruption हैं। अगर कोर्ट वाकई में जनता का 100% भला कर रही है तो जनता अपने आप कोर्ट के लिए खड़ी हो जाती। अगर आप history देखोगे ज्यादातर जजो की तो वो भी किसी ना किसी पॉलिटिकल पार्टी से अंदर ही अंदर जुड़े होते है। Executive भी civil servants को transperancy के साथ recruit करती है अगर वो भी जजो की तरह अपनी मर्जी से IAS, IPS भर्ती करेगी तो फिर क्या होगा। Politician जनता में direct जाते है लोगो की प्रॉब्लम को जानने के लिए judiciary को कभी देखा है जनता दरबार लगाकर litigants की समस्या को जाना हो। कितने जज मीडिया में आते है direct लोगो की प्रॉब्लम को सुनने के लिए।

    NJAC is the right way. No where in the world are judges appointed through a Collagium of Judges as brought in Infia in 1990s

    The only solution is SC should be transparent while appointing the judges otherwise govt will keep targeting the judiciary. This is not fare for healthy democracy.

    संविधान का बेसिक स्ट्रक्चर क्या है , कहीं संविधान में इसका जिक्र है ?
    क्या कॉलेजियम संविधान के बेसिक स्ट्रक्चर का हिस्सा है या मनमाने ढंग से जजों द्वारा बनाया गया नियम है ?
    क्या कॉलेजियम का जिक्र हमारे संविधान में है ?
    जज क्यों चाहते है कि जजों की नियुक्ति सिर्फ जज ही करे ? क्या पूरे विश्व में या किसी भी देश में जजों की नियुक्ति की ऐसी प्रक्रिया कही है ?
    NJAC में 6 में से CJI समेत सुप्रीम कोर्ट के तीन वरिष्ठ जज , एक कानून मंत्री और दो कोई क़ानूनवीद जिसकी नियुक्ति CJI , PM और विपक्ष के नेता करेंगे , की कमिटी के प्रस्ताव था । इसमें कहाँ ऐसा लगता है कि इस व्यवस्था से जजों की नियुक्ति में सरकार का दखक होगा ?

    The process of appointment of judges should be modify but Govt. intervention should not be in appointment of judges. Bcz NJAC is more dangerous than colligium system for a democracy.

    We should be make autonomous body for judge requirement and empower to power apart from both Government and supreme court nepotism. The body construction retire judge , retire administration officer.

    Govt. is the direct representative of the people, if they don't work well people can change them, so does the laws made by them. But by this collegium system, there are no. checks and balances on the judges of SC. They are not choosen by the people l, it will be good if someone who is choosen by the people (government) actively take part in there selection process. I support this new bill, as this old one only created opacity and pendency in our courts.

    We should not involve politics in appointment of judges because it is the most trusted institution but there should be a transparent system in appointment of judges...collageum system should also have two or three judicial experts...
    2- judges which are in race of cji, their name should be public and then selection process start
    3- collageum should have to public alll details, on which the base... Judge has selected and also public the details of other judges rejection
    3- judicial expert view point also be important and the rejection of their view should be seen as a problem

      @@steverogers7712 aur abhi kya ho sirf kuch judges aur unki family ka control hai pure supreme court pe, wahi appoint karte hai next judges ko aur unke pass absolute power hai ki kisi bill ke pass hone baad usko radd kar sakte hai, to ye ek unelected parallel govrenment ki tarah kaam kar raha SC jiske bare me aam janta ko kuch pata nahi..
      Koi third system to chaahiye jisme sarkar aur SC dono Nispaksh rahe.

      @@amreshsingh3763 judges don't need to give accountibilty? This is only in case of a monarch, who rule you Because he inherited it from his family and is not accountable in any aspect and you have to accept his decision as order from god!
      Do supreme court consider itlself greater than a parliament which is elected representative of peoples whereas those judges get appointed by family connections, that's very aggrogant behaviour for a democratically independent body.
