You were had in Game #1. He made a bad move and then wanted a draw. And since he has takeback turned off, this is how he protects himself from a losing position (if he gets the opponent to accept, which you did). I bet he has done this many times in the past.

Touch move just forces people to move a piece they touched to prevent cheating or intentional take backs but miss click is accidental drop of piece.

Last week I, a lowly 1500, was also playing against a 2300, who moved his queen to a square which was covered by my pawn. But in that instance, he did not ask for a take-back and I, of course, did not offer one. Also, I was down to a handful of seconds and couldn't believe my incredible luck. And then, instead of playing on and trying to flag me, he simply resigned. And that, folks, is the Coles Notes version of the highest-rated player I've ever defeated.
Well... *cough* ... I say "defeated", but really...

That first game I think you overlooked that he blundered the queen because you weren't expecting something so obviously bad until he asked for a draw. I don't think he was being honest, though. He literally changed his settings, so you couldn't have asked him if the roles were reversed. If you wanted to, though, you could have offered to move a piece back and forth so you could get back to the position from before.
