How to Transfer a Section 8 Voucher to Another State or County (Section 8 Portability)

- In the Housing Choice Voucher (HCV) program, moves with continued assistance may occur both inside and outside of a PHA’s jurisdiction. An eligible family that has been issued a voucher can lease a unit that meets program requirements anywhere in the United States, provided that a PHA administering a tenant-based program has jurisdiction in the area in which the unit is located. This feature of the program is referred to as portability, which is the process of leasing a dwelling unit with tenant-based housing voucher assistance outside of the jurisdiction of the PHA that initially issues the family its voucher (the initial PHA).
This chapter describes how eligible families may move from one jurisdiction to another using portability. The PHA that initially issues the voucher to a portable family in order to allow them to move to a different
jurisdiction is referred to as the initial PHA. The PHA in the jurisdiction to which the family wishes to move is known as the receiving PHA.
Under TBVs, the subsidy is tied to the family, not the unit. This means that the assistance may be used within the jurisdiction where the family lives or within any jurisdiction with an HCV program.
With PBVs, however, the subsidy is tied to the unit, not the family. Only after one year of assistance in a project-based unit, the family may switch to the tenant-based voucher program and exercise portability if they choose, with some restrictions.
An applicant's family must be allowed to move to another jurisdiction under portability provided that the head of household or spouse was a resident of the PHA’s jurisdiction at the time the initial application for assistance was submitted and that all other portability requirements are met. Conversely, non-resident applicants have no right to move under portability for 12 months from the time the family is admitted to the HCV program.2 Once a HAP contract is executed on behalf of the applicant family, the family becomes an HCV participant.
Initial PHAs may allow portability moves during this 12-month period.3 The initial PHA may decide to allow portability when the move would respond to a special family (for example, for employment opportunities) need but not allow such moves in other instances. The PHA is required to document the exceptions to the residency requirements in regards to portability in the administrative plan. The PHA may also choose not to impose a one-year residency requirement and allow for portability immediately for all applicants.
Residency is determined based on the family’s domicile at the time that the family initially submitted their application for assistance, not at the time they reached the top of the PHA’s waiting list. Domicile means the legal residence of the household head or spouse as determined by State and local law. The PHA needs to set a policy in the administrative plan outlining how the residency will be verified for those resident applicants wishing to exercise portability.
Note: Residency requirements associated with portability are different for participants in HUD-VASH and are described in the Special Purpose Vouchers chapter.
A family must4 be income-eligible in the area where the family initially leases a unit with assistance to be admitted into the program. This means that applicant families who exercise portability must5 meet the applicable income limits of the receiving PHA’s jurisdiction. Income eligibility does not apply to participant families; that is, income eligibility is not re-determined when a participant family moves under portability.
Note: Under certain circumstances, the receiving PHA will need to re-determine income eligibility for applicant
families. For example, if the applicant's family initially reported they had no earned income but they
subsequently obtain new employment, the receiving PHA may need to re-determine income eligibility for the applicant's family to ensure the family is income-eligible in the receiving PHA’s jurisdiction.
To begin the portability process, the family contacts the initial PHA to provide the name of the location to which the family wishes to move.7 If more than one PHA administers a voucher program in the area to which the family is moving, the family either chooses the receiving PHA or requests that the initial PHA make that choice.8 The family must9 notify the landlord before moving out of the unit. The family is also responsible for providing proper notice to their current landlord in accordance with their lease agreement. Once the receiving PHA has been selected and the portability request approved, the initial

When I tell you how much I appreciate you and the information you give to us freely. Had the HCV since 12/2023 and still can't find a decent place. They told us during briefing that we're only allowed 1 extension. Well 2/2024 they provided an extension for another 60days . I argued that the amount of the voucher was the problem with finding a decent place in this small town (40 mins from Charlotte). Tried to ask for portability and "No" was the answer. Then she tells me I have a little wiggle room with the amount of the voucher but didn't tell me how much. I was trying to find answers to these questions regarding billing and portability for me for 2 days i have section 8 in kleberg county and want to move to Harlingen, Texas you provided clarification i definitely needed! I thought i was asking some sort of secret questions when i was calling Harlingen and asking at my local PHA. My brother just ran into a issue with his housing program. 10 years ago. He moved from Cleveland ohio to Florida. He lived there 10 years. Cleveland was billed for his housing in Florida. But this year. His landlord sold his unit and forced him out. He tried to find another place. But, because of the hurricane he couldn't find a new place. Cause salvation and red cross. Bought up all the apartment available units to house displaced people who lost their homes due to the hurricane. So he had to come back here to Ohio. And going threw this now of porting back and finding a new place. He right now homeless.

@Section 8 Consulting Have you done a video on how rental portions are calculated. Including an explanation of how your gross income is adjusted to determine your adjusted income for which the tenant will pay 30 percent of that as their rental portion for the apartment, home their leasing.
No one has ever requested that in all my years of doing this.

I've been on section 8 for 7 years. I have a landlord the height animals. She wants to keep up my deposit for my pet which is not a pet. I gave her all the paperwork on my service dog shot records and even some of my records but that wasn't enough she wanted to know everything that was blacked out on my health and the reason I have to have a service dog. And now she started making up lies to HUD, she has told other people she was going to make me lose my voucher. I am 70 years old
And now I'm trying to transfer from Texas back to Arkansas. But they're dragging their feet and I'm afraid time will pass by I have a hearing on her allegations toward me.

Hi, I have section 8 administrated by a housing authority. I’m searching for an apartment found one in a city 12 miles away. That city their housing told me, that the original housing will continue my case. There’s no need for them to intervene. I don’t understand. I was given the RFTA.

Mi mother in law move from Alaska to Georgia, she get her voucher transfer for Effingham ga but she can't not fund a place, can the voucher be transfer to a different county in this case?
That depends on that housing authorities policy.
I am alone and disabled and trying to switch to a different city within my county. My county is so big that they have multiple housing authorities for different areas. This is a real problem if you want to move around within the county because you have to switch housing authorities. My problem is that I don't know where to stay in between the time that I give notice and leave the old place and find another place while the transfer is happening. It doesn't seem like they make it very easy to switch because you can't really wait around at the old place for another place to come available like you can when you don't change housing authorities. It makes me feel trapped. Unfortunately the voucher I have is for spotty areas throughout the county and a lot of them are undesirable areas or inland where it's too hot for me with my health issues. I happen to be a little closer to the coast but I have to go either North or South and both of those cities are separate housing authorities. The city I am in has really bad areas that no one would want to live in and then the nice area I do live in is raising the rent so high that I can't stay here. I feel trapped because no matter where I go it looks like the same situation. They get you in there and then they start giving you these 200 or $300 a year rent raises that go above the limit that section 8 will pay. If you are on a very low-income this can be extremely difficult financially and makes it almost impossible to stay in one place. But moving itself is exhausting and financially impossible sometimes. So now I have to figure out how do I get all my things out of my apartment with nowhere to put them, because I don't know where I will move to. It's crazy. I found the perfect place in the perfect spot at the perfect price but unfortunately housing doesn't seem like they are going to cooperate and helping me get in there in time. I need about 5 other people helping me. This is so overwhelming and exhausting and confusing. I don't want to end up homeless, especially now that our governor is cracking down on every one that doesn't have a roof over their head.
My mother is trying to port from the Virgin Islands to salem Massachusetts she just got her voucher the web page of the Virgin Islands says you can port right away because she has lived there for more than a year on the website of the website it says they dont know if the section 8 is billing or absorbing in salem ma im confused why does it say that ?

I have a voucher with an extension through 2/23 and have been searching for a rental that will accept section 8 prior to requesting to port. I’m currently staying in a hotel that has been covered by my renters insurance after my apartment was destroyed by fire. I have recently learned that my insurance coverage has ceased, because there has been no rent paid and the ale coverage is for “additional living expenses” so if there aren’t any then they I am on my own. I learned this when after months I couldn’t reach my adjuster, and kept calling in. The reply when I asked how and why could this be as I had been asking about how this works for months. The response was it must’ve fallen in the cracks - unbelievable. So I have been given till oct 14, trying to port out or maybe see if I qualify for an emergency voucher being displaced disabled and 56 - I am close to losing my mind after having lost everything else - I want to go to the ocean I’m on SSI and wondering if I’m delusional or if there’s some secrete words I have yet to learn in order to accomplish this. I’ve been displaced since March - should my housing specialist be helping with this? I am going to be porting from New York to a PHA that is near Philladelphia that is billing only. I'm a little concerned where you spoke about New York not being happy with being billed by another state for someone that doesn't live there anymore. That left me wondering, is this safe for me to port if they are billing only? I'm disabled and can't afford to lose my voucher. Once both Housing Authorities agree in the beginning that they will accept billing only, I would think there wouldn't any problem after that as far as that part goes. If the fair the market rent in my city for two bedrooms is 951 and it’s 1721 for Portland where I want to move how much would my voucher be worth if the payment standard for a one bedroom there is 1204

Hey I have been on mercy housing for 6 years now, I just received a housing authority choice voucher, my case workers didn’t tell me the guidelines for moving and I applied for a house that is renting in the next county over and they accepted my application and take vouchers and it’s in within my voucher amount, I’m worried the county I am in won’t allow me to move.
