Thanks Joanna & Helen .. fabulous, again. I particularly liked the wry grin with Helens own legal disclaimer at the end. Funny but necessary. Thanks again.
That's good to know about fair use. I'm thinking of starting a blog about stories that interest me but I wasn't sure if mentioning them and using pictures from them was okay legally
You can mention and comment on things based on the principle of Fair Use - have a look at www.thepassivevoice.com/ as he does this well. But I wouldn't use pictures from other sites unless you have licensed them or they are from royalty free sites like Unsplash.com
Hello my name is Mo ,I'm living in California Santa Barbara. I really need your help guys because, I'm almost done with my book project with create space . My Front book cover is an image that I took from the Internet, I don't know who owns it and I don't know how to get a copyright for this image.

I know Im asking the wrong place but does anybody know of a method to log back into an Instagram account?? I stupidly forgot my account password. I would appreciate any help you can give me
@Tate Jeremias I really appreciate your reply. I found the site through google and Im waiting for the hacking stuff now. Looks like it's gonna take quite some time so I will get back to you later with my results.
Not that I know of :) All our creative work is inspired by something. I am frequently inspired by art and architecture. It's only plagiarism if you steal work and pass it off as your own. If you create something new based on inspiration and new thoughts, then that's awesome!
Can you used charts that are published by the goverment? for example use a chart of inmmunizations from the US deparment of Heath-Center of Disiase Control and Prevention? also, can you used annonimous quotes or quotes from people like Albert Einstein? I would like to use some inspiration quotes on my book byt not sure if I can do this. I appreciate the information. Thank you.
Copyright law is broken since the advent of digital technology, it just doesn't work any more as it has in the pre-digital era. 2:16 That's not true for trivial works plus some other exceptions. Also, the word "idea" can be very misleading in this context; copyright doesn't protect ideas, it protects the expression of ideas. 3:14 Giving usage rights exclusively to a publisher doesn't make sense any more. This was common practice in the past to ensure that the investment of the publisher gets returned, but with digital publishing, there are neither as huge investments any more nor is the traditional route the only way to fund a project. 6:38 Please note that signing such a contract effectively ends the author being a self-publisher (at least for that medium or format). 6:46 One can grant exclusive e-book rights to a e-book publisher, so he prevents himself from selling/distributing the e-book via any other distribution channel, that's indeed exclusive too, regardless and separate from print-rights or other rights. 7:16 With print on demand technology, nothing ever again goes "out of print". Instead, the contract should focus on if customers can obtain a copy within reasonable time or not. 8:37 If they have such contracts, then they're untrustworthy. They don't need exclusivety in order to do what they do, they want to abuse the authors usage rights for protectionism and vendor lock-in, which is unfair to the consumer. 10:35 Images almost always need permission, even portions of it, because the image in itself is an entire work protected by copyright, and using it goes far beyond a citation, with some minor exceptions. 14:06 Unfortunately, not all Creative Commons licenses are free licenses. Authors should consider to release their works under a Creative Commons license (CC BY-SA, just as the Wikipedia) instead of only using freely licensed works of others for their covers etc. That's the "commons" part in the name, feel encouraged to contribute. 15:00 That's bad. "Commercial use" can be usage on a site which has advertising, or usage in a corporate environment, regardless of if any earning is generated by anybody. Furthermore, selling usage rights is a clear sign of a non-digital business model. 15:17 Please note that one should indeed read and understand the Creative Commons licenses. For instance, at least version 4 (international) prohibits DRM, so if an author uses an image under one of the Creative Commons licenses in a DRMed book, that's a copyright violation. 16:52 Restrictive licensing destroys or prevents such a community entirely. For works of fiction, art and entertainment, one might be able to move on if some other copyright holder just refuses to grant permission, in the world of software, educational material, scientific works, works of practical use in general, such behaviour and abuse of copyright law has very harmful consequences every day. Additionally, publishers usually don't want to share works with the world (except they're paying loads of money), so it's crucial that the original author or artist keeps the rights in order to grant it to other people who ask for it, as long as he/she hasn't signed an exclusive contract. Another aspect is that restrictive licensing of works which are already published on the internet violates the digital rights of the users, and as every author is a user too, one should think about creating artificial hurdles by restricitive licensing of their own work or to save other people from it by free licensing right away. 23:39 The word "publish" refers to making something available to the public. Whenever digital technology is involved and data gets transmitted from one machine to another machine by any means, the sender effectively looses control over what is actually happening with it on the recepients side, so this data eventually might find its way into the public space of the Internet. That's especially true if an author publishes his work to a number of unknown readers, each of them capable to do whatever they want with it regardless of technical or legal counter-measures. However, as works of art and entertainment are things somebody can do without them (in opposition to works of practical use), an author might prosecute commercial copyright infringement of large quantities. At the same time, not-for-profit c can be seen just as another distributor that offers another portion of potential audience, so one could probably cooperate with them. As "pirates" aren't authors and don't produce works of their own, they're always at disadvantage when compared to an author, who has the initiative (on special editions, reader relations etc.).

Is it breaking any laws if you wrote a poem inpired by a movie or a painting and have that poem published in book form?

Thank you! This is really well put. It's pretty overwhelming to know stuff about publishing but i must! XD
