- The plaintiff paid the defendant to paint some rooms, but she had to postpone the job. The plaintiff tried to reschedule the painting job, but the defendant ghosted her, so she's suing for the amount the plaintiff already paid. The defendant argues the plaintiff tried to cancel on the day of the job. Besides, the defendant used the deposit to purchase materials for the work.

How can the Defendant NOT HAVE a receipt for buying cans of paint? Answer me that. You can't pass thru the CASH REGISTER w/o being handèď a RECEIPT.
So if she cancelled the job and liable for the deposit and this painter already bought the paint, then she should give the client the paint then so she can keep the deposit.
Give her all the products you bought with the money and give her the receipts....done.

I’m a painter. Sherwin Williams keeps great records. She could have called and gotten the receipts. You use your company name when you buy them cuz you get a discount And then you use a project name. Does she not do taxes?
EXACTLY. I used Sherwin Williams weekly for my job and I can go in and tell them to look up a color I bought X months ago and they pull the records in no time at all

Sherwin William’s keeps all that on file. I was able to go there and get touch up paint that the previous owner painted the house.
All the people commenting that $2200 is too expensive are out of touch with how much painting costs. The cabinets alone could easily be $2200. Price a gallon of paint and you’ll be shocked. A gallon of SW paint is $90!

Frankly, I think discussing ANY contract price with a friend or relative after the contract's already signed is likely to elicit an "Oh, that's too much" response. People often want to show how much smarter than you they are.
Yup. And their price they think they can get done cheaper is usually just for the materials or "I know a guy that knows a guy that can do it cheaper". Someone can offer to do a job at 20% under market value and STILL be told "I was told you're charging too much".

We had our kitchen/dining/living rooms painted professionally. Best choice ever. Was spendy, but was done in less than a week and if we had done it, would have been a wall a weekend and we would still be working on it. Best money ever spent!

Painting kitchen cabinets alone can be expensive. It’s such a tedious thing to do. Me and my husband painted our cabinets ourselves recently and I said I would never do it again. They came out beautifully but it took so much time. Degreasing them, then sanding them, then painting multiple coats was a lot of work!

$1000+ (just for the deposit) to paint a couple of rooms in a house? The total amount was $2,200?? This lady isn't making good decisions for herself. They were definitely taking advantage of the situation.
It was more than a couple of rooms. Living room, hallway, bedroom, and kitchen....and also kitchen cabinets. The cabinets alone would take days.
Also all of the paint, paint brushes, drop cloths, etc, were included in the price.
It’s very expensive to paint kitchen cabinets.

I didnt realize there was something at the end! How sweet that was! As for the case, ALWAYS put your contracts in writing. Verbal contracts are so cloudy things can be changed up by either party and it ends up being a "your word against mine" kinda thing, and most times it's the company with the reputation that prevails. Who doesn't bring proof of the purchased items to court though? I guess her painting company does *shrugs*

It’s very annoying to spend time on a project that a client cancels, but I would return some of the money to the lady. Being in business, you should be able to figure out how to return unused product! Unless you are careless! She did not sound believable! 🙄

I always get a receipt. I extreme coupon & like to look at the small amount I pay for stuff… so if I need a receipt, I’ll have it for a return, reimbursements or court (yikes hopefully I won’t need to go to court!)

I disagree with the comments that the price was too expensive especially since she was going to paint the cabinets, however I do not believe that she purchased any paint for supplies & should have returned her money if she didn’t do the job.
The should have asked the defendant if she started a new paint job with another client. Is the defendant did started a new job, she should have returned the money to the plaintiff. Yes, I know about contracts and there's no difference between a renter that moves out in the middle of the month, and the landlord charges the whole month rent. But if the landlord does have a new renters that moves in two days later, then she/he have suffered no damages, and cannot charge a full month's rent.

Most of the time, clients think a retainer is all they owe. It's not. It just gets the attorney the impetus to start work on your case. Often times, the client likes to do silly shit like call the attorney over nonsense not recognizing these are billable hours. It's ignorance on the end of the client, more often than not, not attorney malfeasance.

Prepare, prime, and paint a living room, hallway, bedroom, kitchen, AND kitchen cabinets---which involves removing then reinstalling all the cabinets---for $2200? And the supplies included in that? (except for one can of paint for the cabinets)
That's a STEAL! The supplies alone would take at least half of that amount.
But no receipt from Sherwin-Williams? Sketchy.

$2,200 is a rip-off. I hate when people do that to the elderly. I had to watch for my parents when they got older...people really do try to take advantage of them if the opportunity arises. Caught one of our local taxi drivers charging them way more than the trip should've been. I was furious! I asked my dad...how much did he charge you to get back here (my house) from the town and he told me the price...it was about 30% more than it cost me a week earlier. I was furious! He assumed since they were from California and didn't know the prices in England he could rip them off and get away with it. Makes me sick!
We don't have enough information to say that because it could be a good price, a fair price or a bad price depending on the kitchen cabinet work. Painting kitchen cabinets correctly is a lot of work. Especially if they were stained a dark color previously. You have to remove all the doors and all the hardware. Sand,prime, paint, poly, then reinstall everything. So again depending on the level or work this could have been a good deal or a rip off. We will never know
I got an estimate to paint my kitchen cabinets (small kitchen) and bathroom vanity and was close to $4,000. I decided to get new cabinets instead.

@@zombi05JM said that because they took her job, they weren't able to take other jobs. So they were out of money. It's like renting an apartment with a deposit. If the rentee wants they money back, the renter loses money because they had to hold the apartment when they could've given the apartment to someone else.
I do believe they should've given her the paint at least. I question if they fully spent the deposit on the paint.
@JaiB-xr9fl True, that is a good point if they did cancel other jobs. If they ordered the paint, then it should have been given to the plaintiff. Its not like they can use the paint the plaintiff picked out for any job.
Seems to me that immediately buying materials for a contract is considered relying on the contract, and so locks it in.

@@oldageisdumb I guess it depends on what kind of paint you go for. We just painted our bedroom. We paid $24 a gallon, but it was from Walmart. Sherwin Williams is a little rich for my blood lol.
@@blurrble5 $24 is very, very inexpensive paint. Even a lower grade paint at Home Depot is $50. The point was that surely you can see that $2200 for three rooms, a hallway and cabinets is not over charging. That’s cheap, actually. That should just be for the cabinets.
