If you invade someone's pool, you are liable for what happens. However, the pool owner cannot be held liable for a trespasser. If your pool has been invaded, you should immediately call the police. The one big reason why you don't allow people into your pool when you are not around is the possibility someone might get hurt.
@@grannygoes About what? You are liable if you invite someone into your backyard and they get hurt. That is where liability should begin and end. If someone breaks into your backyard and is injured, then it is on them.
@@grannygoes yep in some states even with a fence, gates, locked. If trespasser gets hurt. You will get sued. I pay extra insurance with no pool. Just in case.
I would not have gone onto my own property but immediately called the police and then have the police charge all people on his property with trespassing.
Even if she hadn't done this to herself, what exactly was he supposed to do? Was he supposed to mop up around the pool to make sure no one will slip around a POOL?! That's not how it works! No reasonable person would have any expectation of the pool deck being dry when the pool is in use. You might as well assume that somehow the land immediately around a race track is going to be free of exhaust fumes. The pool deck being wet is why YOU DON'T RUN AROUND A POOL! If you CHOOSE to run while using a pool, it is on YOU when you get hurt.
Not that I believe this story to be true but unless he is calling an attorney he personally and previously knows, attorney offices are not open on Sunday afternoons. Which is why he contacted one on Monday.
Here in Germany she could have partially won. You have to keep your garden and home etc. safe. And this includes trespassers. If a trespassers steps into a tool you left and gets hurt, you are responsible and have to pay for damages. Even a burglar can sue you if he trips over e. G. an electric cord or a child's toy. And before anyone says: yes, to me this is absurd too.
See this is why the ones that are called Karen they think everybody is stupid but themselves no matter where you're at in what country they believe that everybody is ignorant but them
All people that run in HOA they feel they're above the law and they can do whatever they want and their exempt from the laws this is this is why the supreme Court needs to see all these videos about HOA
She gets Bert on properties. She had no business being and now she has the nerve to actually threaten to Sue them for her own actions. Her own injuries that takes a lot of nerve
And you got security cameras and you could have built all this before you got back on your phone and you were the only know what was going on you could have called the police you could have called an attorney your attorney could have showed up at your house before the cops showed up and but people like you don't think of that
If you are going to write and/or read a made-up story, how about at least keeping your narrative of the "facts" straight. A lawsuit filed and the homeowner sued on Monday morning, the day after the incident? NO lawyer or court moves that fast. Immediately before being served, the homeowner was making a mental note to file a police report... then magically one was filed the day of the incident. The homeowner cleaned up his pool and property within a few days of the incident... and then suddenly had to clean all the debris up again weeks later after the court case. If you are going to spin bullshit for us, at least disguise it better.
3:50 the moment he realised all those strangers in his property he should gave called the police.

Why don't people just call the police‽
The first thing I would have done was call the cops

Those "pointed stairs" can hurt your feet ...
As soon as you saw what was going on you should have called an attorney and the police

Is Karen the only available name for AI in these stories? Lol all of the women hoa board witches are named Karen 😂😂
So not only was Tom's lawer not allowed to cross examine Karen, Karen's lawyer never bothered with discovery so they could see the crucial evidence.

Why? More than half of them are invented stories
Not a realistic trial procedure. Neither attorney got to question or cross-examine the opposing side.
She gets Bert on properties. She had no business being and now she has the nerve to actually threaten to Sue them for her own actions. Her own injuries that takes a lot of nerve
As they say - entitlement knows no bounds.
How many of these you got to be put on TH-cam before The supreme Court disbands all HOAs in the United States
60% take place in Canada.

Thats the problem with pools..even if they break in, the home owner is liable for injuries.
No they're not. Not in a civilised country anyway. That's what the law is for. You don't get protected by the law when you decide to break it
