    BoA earned interest on that $35,000 for three years. The family is absolutely entitled to all accrued interest as well.

      Not just that, they used it to establish their fractional reserve and lent out at least 9x that, collecting interest on each of these loans.

      Bill, I was clicking in to this comment to say exactly that! You also get treble damages so fractional reserve * treble damages * 35k * crazy interest rate because it's unsecured debt just like a credit card maybe 30% apr.... $1.5 million in interest.

    Don’t forget that during the 2008 housing crises, BoA foreclosed on thousands of properties they did not hold the loans on!

      And did not correct course on at least one until homeowners had a court order allowing the seizure of *BoA* property from a branch. Their "reasoning" was that the firm they used for a part of their foreclosure workflow had unbeknownst closed doors.

    There is a reason my husband and I call Bank of America, Bank of Charges. I refuse to do business with them. I would take my money and put in a mattress before I give it to them.

      I agree, BoA brags about all the little fees they collect from depositors. They drained my account and tried to collect over draft fees after they signed me up for an over priced insurance policy they were selling. Stay away from this predator.

      @@Foolish188 Yeah. I had a mortgage that was sold to them. Next thing you know they're charging me several thousand dollars a year for "lender-placed flood insurance." Insurance that I couldn't even buy if I'd wanted to because I WASN'T IN A FLOOD ZONE. Letters, phone calls, even had my attorney talk to them. Nothing. Eventually I was talking to my State Farm agent about it, and he told me "I deal with this all the time. I never lose." Believe it or not, a few weeks later I got a check from BoA for some twelve grand that they had "mistakenly" overcharged me. I don't know what he did, but I'm eternally grateful.

      Use a small credit union or or at least nothing bigger than a regional bank. These " mega, to big to fail" banks will screw you for pennies. You are not their prioritie you a nuisance to them.

    If I was on the jury, the fact they were able to take 35k atleast twice ( - 35k )out of the account makes me side with the family. BOA is toying with these people.

    Mistakes by Banks happen everywhere. Way back in 1980s, I once wrote a check to buy an ice cream making machine. I wrote the check to the company that was selling it to the owner of an arcade. There where trust issues. I figured the only person who could cash the check was the man I made it out to. Two Months later I was doing my books and lo and behold I found the check in my mail. (in those days you got the check physically from the bank for your own records) You guessed it! The jerk at the arcade had signed the back of the check and the BANK CASHED IT and gave the cash to the arcade owner !! (several counts of Felony Theft etc..) I ended up owning an arcade I really did not want. The Bank had to pay me for my time, lost income, attorney fees etc...
    Years later I sued my Utility Company and won. As soon as the Judge pounded down the gavel I gave him a paper to sign. It stated that the Bank (yep, same Bank) was ordered to pay me on demand when presented with the Judges Order. I walked from the courthouse to the Bank. Took less than 5 minutes. I presented the Judge's order. The Bank manager asked me to sit down and relax while he got the money ready. After 20 minutes I asked were my money was and I was told just a few more minutes. While the Branch Manager was stalling me, he told the assistant manager to get the attorney for my utility company on the phone. The attorney was told that the Branch Manager could only stall for another 15 minutes and would then have to pay me. (thousands of dollars) Lo and behold the attorney I had just defeated in court not more than 20 minutes ago ran over to the court house and filed an appeal. Then the Branch Manager came into the lobby and told me an appeal had been filed and he would not be paying me. I asked him if he realized what he was forcing me to do. He said there was nothing I could do about it. I walked over to the Judge's office and ,luckily, saw him immediately. I told him what had happened and he called the Sheriff and told him to go arrest the attorney and the Branch Manager and to have them in front of his bench in no more than 30 minutes.
    In all my years as a police Officer, I had never seen a Judge so angry. He was actually yelling at these two defendants. He screamed that their story of "coincidence" in the speed of the filing of the appeal was pure fabrication. He stated that they had insulted him both professionally and as friends. (the plot thickens) I guess everybody knows everybody in that County. I was asked if I wanted to press charges and I told the Judge there was three things I wanted.
    1. Whatever the Judged wanted to do with them. "Obviously Your Honor is an honest man" I will sign whatever you want.
    2. I want my money today.
    3. I them turned to the Branch Manager and said somewhat loudly " That sirrah (google it) is what I can do about it!

      I used to work for a bank that was acquired by BofA. After the acquisition the workplace environment got so bad that many of us left for other jobs. To this day I call it BoinkAmerica.

      @@Milesco As much as I want to argue with you, You're correct in describing the distinction between the two systems of law. I'd heard it before, but had forgotten about it. That probably one of the reasons for such popular animosity towards corporate lawyers.

      @@Milesco i believe some states have some exceptions to that rule but only on certain types of cases and there is a limit to the amount of fees that can be reclaimed.

      @@Milesco The American Rule is not really a rule but a strong guideline that sets the default expectation of legal outcomes, there is no law or precedent that cements it and Judges and Jury's can and do set it aside. In 2017 Oklahoma went so far as to remove it completely.

      @@Milesco Judges and Jurys do discard that rule, it's a rule not a law and overruling it is at the discretion of the Judge. Doing so unreasonably could provide grounds for an appeal though as a higher court could find that the Judge was in error. On top of that virtually every State has some allowance for fee shifting, which is what most of us mean when we thing about paying legal fees.

      Also 2012 Sierra Club Vs County of San Diego, the County lost and the Judge ruled that they had to pay over a million of Sierra's legal fees. And Virginia Supreme Court just kinda side stepped the rule, depending on the situation.

      @@lo1bo2 Glad it's working out you so far, I joined Navy Federal a few years ago. I had a problem that was my fault , they fixed it within 24 hours. Just seems like Credit Unions are more inclined to SERVICE any issues more so than the Banks mentioned above.

      One of my relatives tried to work with Bank Of America in Tennessee for 2 years just to open a new account with new holders. By the way BofA is their bank they have money in already.
      Finally they went to another bank and a new account was formed in a couple of days.

      Been with one since the late 80s, the place has changed names but the service is about the same , and by that I mean freaking excellent.
      Matter of fact, I might hit em up for a car loan in the next few months as I'm tired of driving junk and it's about time I grew up and got something decent.

    Weird part is if the bank made the mistake, they would have "corrected" the error in 3 minutes, not 3 years. When BofA was based in SF, the headquarters building has a huge black granite chunk in front of the building. It's called the Banker's Heart.

      Same experience with a "Totally Free" account from WaMu. The free account came with a $5/mo savings account which drained the checking account before my first checkbook could be ordered.

      Steve did a story a week or so ago about a woman who spent the money. The bank gets plenty of time to fix their f/u and if you give them money... Their going to make money on it before returning it, guaranteed.

    The only thing I heard from this was never use your phone to deposit a check into your account. One slip of the finger, and you're done. 😂

      For small checks, the app is fine.
      Just go step by step and pay attention.
      For a large check such this , I'm going to the bank to physically band it to a teller and get a paper receipt as well as an electronic receipt
      Trust no one

    I really appreciate cases involving BoA and similar banks deciding that their duty to customers and customer welfare is low or no priority. They always seem genuinely surprised when they are sued and lose, sometimes ignoring judicial orders as well. "Deaf ears" is the best character description of their operations.

    Many years ago I was managing a convenience store. One morning my regional supervisor showed up demanding to know why I stole nearly $12,000 dollars.
    After a few minutes of "what the heck are you talking about?" questions, I finally got to the facts that a deposit was logged in the company's system, but not showing in the deposits at the bank.
    The supervisor showed me the bank's report of all commercial deposits made that day (with account numbers blacked out) and I immediately saw a deposit taken at that window that matched the "missing" deposit" TO THE PENNY that was listed as "account number mismatch".

    The commercial teller has mis-keyed one digit of the account number, but the bank manager swore to my company that the deposit was missing, and the company sent my supervisor out with the mission of getting me arrested.
    Three minutes at the commercial teller with my copy for the receipt of the deposit, and all was fixed. Well, all but my trust in the bank and my company, that is.

      The CFPB would have ass rammed them 6 years ago hard, but 4 years(2017) ago trump practically dissolved most of the CFPB and appointed a friend to the head of it that sat on his thumb 5 days a week earning high 6 figures, so they prob did but were ignored 3 years ago.

    Some time ago, the store manager took a deposit to the bank, lots of cash.
    We all saw it go into the bag, and the bag was sealed. All five of us went to the bank, and gave the drive-in teller the bag, through the window.
    Later, we get word from the store owner that the deposit was short.
    It had happened before, and that why all of us went to the bank.
    After statements from all of us, some tellers were fired, and right quick.

      Twenty-five years ago, someone put a cardboard box under a nighttime a deposit drop box at a local bank. Put a sign on the door saying out of order please leave in box below. When someone smart finally called the police, they found quite a few deposit bags in the box.

      BoA will take the money in fees. Taking money from kids accounts for inactivity is common in most banks. Gives the CEO a nice bonus.

      @@Milesco punitive damages are reasonable here but myself i would put it in the 500k range because now whatever money for their son that had been in the account is also missing. remember the last thing the lawyer mentioned is the account now has a -35k balance. so the sons money is gone now too.

    Years ago my Dad got ill and I had to return home. He passed away. Later that week I took Mom to the pharmacy to get her pills and she bought a few other items. Even tho my parents had outstandingly great credit, (car dealer said it was the best he'd ever seen) her debit card was declined. She was shocked. Some digging showed the Bank had frozen her account! All of my parents accounts. My parents each had a personal account and also had a joint one, along with an investment account that was literally days from maturity. They had planned to buy a car with the bond. The Bank sold it without mom's knowledge or consent, telling her it was standard operating procedures. She considered it abuse of the elderly and sued them. She asked for her money back, lawyers fees and a small, reasonable amount of damages, adding a bit more to the damages for each month the suit dragged on. Drag on it did. Years. They offered mom a settlement but it was miniscule. Insulting. Finally after 6 years of court procedures, mom died. The Bank won.

      It was Bank of America's mistake. They gave money to someone that it didnt belong to.
      If someone writes a check to me, it would be the responsibility of the party cashing out that check to ensure that the person asking for the money is the person named on the check.

    Bank of America is the probably the most greedy on Earth. I recall doing a job for a company and they paid me with a check drawn from a Bank of America account. I went to Bank of America to cash the check and they charge $40 to cash a check drawn from an account in their own damn bank.

    Years ago, I had a mortgage with BOA and was supposed to be fee free accounts. They started charging me fees for other accounts. Had to fight regularly to have fees removed. I refinanced mortgage with another institution and the manager was dumbfounded why I closed accounts. 2 reasons: high interest on the mortgage and high bank fees. This went on around 2008-2009.

    I have clients making checks out to me all the time, and I have to be very careful to insist that they make the check out to me with my name very properly made out. I've had the back reject the check or refuse the deposit if the client mispelled or inaccurately wrote my name on the check. This is a clerical error on the Bank's part, I don't see how this has gone on for three years! Crazy!

    So another story (Lehto did awhile back) was a about a person that spend money that was accidently deposited in her account. She know it was not her money, and she spent it. And she got in trouble because her choice. Here, money was accidentally deposited in the wrong account, and the bank tell tells them your SOL.

    I had one experience with B of A . I'm a Vet and the VA had a program for vets to buy a home , the kicker was it would be financed with Bank of America , it was like a repo sale . What a terrible experience . The loan officer was very inexperienced and it took over 3 months to jump through all the hoops and get the loan to closing. They have got to be the worst bank on the planet.

    Told my best friend to get a lawyer when he was hit in a car accident. But he would not, and the insurance company jerked him around for so long, the hospital threatened to sue my friend for his medical bills. Big companies like banks and insurance companies do not care about you, and will take every advantage they can. If you feel done wrong, get a free consultation with a lawyer.
    And if you are EVER in a car accident, and you are not at fault, the first call should be a personal injury attorney. Otherwise the insurance companies WILL screw you.

    So, they deposited $35,000 into their son's account. So the balance was $35,080. But then the account dropped to a NEGATIVE $35,000 which means they are now out *_$70,000._* They better make sure that their son's account is corrected in addition to getting their $35,000 back plus Legal Fees and Damages.

    Once I mistakenly under reported my cash money deposit into a bank ATM. I reported the mistake right after the deposit to the bank. It took me one month to get the proper balance.
    While at another bank in the same city my friend's mother recieved three counterfeit 100 dollar bills. The bank refused to admit the error and replace the bills with authentic 100 dollar bills.
    By the way, banks make boatloads of cash on penalties. I remember in a Wells Fargo meeting and one of the regional managers said wells profits 97,000.00 dollars a minute because of penalties.

    Ugh. BofAm strikes again. When our daughter began college in Boston we opened an account with a debit card. If she tried to use the card without enough funds the transaction would refuse to go through. Then sometime in her second or third year she went holiday shopping, all seemed good until she got hit with 8 or 9 $35 overdraft charges in one day. Why didn't the transactions get refused? Nobody at BofAm could explain that, and no, there wasn't a way to revert back to the old way. They were earning almost $300 in overdraft fees!
    In another case she did a balance inquiry that showed $20 in the account. I deposited $50 cash, she did another inquiry 30 minutes later and the ATM showed $70 available. She took out $30. Next day she does a balance inquiry to find out she got whacked for a $35 overdraft fee. The explanation was that the cash I deposited wasn't actually processed until the nightly 'batch' processing was done. Nobody could explain why the balance inquiry minutes before the withdrawal showed $70 available when it hadn't been 'batch' processed yet. Something about 2 systems, an on-line system, and a batch system. In both cases I documented it all and wrote to 'The Controller of the Currency' in Washington DC.

    I had a horrible experience with BofA. Very similar to this couple - we were told on the phone that all would be well, but we could not get BofA to stop taking monthly payments (large, as in $10K) for an account that we closed, and that had a POSITIVE ie. CREDIT balance. Catch-22: you can ONLY cancel a automatic payment schedule from the on-line account login, but once the account is closed, you can't log in! 4 months in a row, they took $10k from our (other) bank account - it cost me $1000's in over-draft fees. As a result, I will NEVER do ANY business with BofA. Even when someone wanted to buy our house, wen they said their financing was coming form BofA, we refused the offer. I am not surprised t see this behavior from them.

    If i had to guess, that bank is in trouble if they're going before a jury. Especially since they have agreed that the money should be transferred. Normal people dont like the idea that their own bank could do that to them and they will put the screws to the bank just to try and teach them a lesson and discourage generally shitty behavior.       They probably bought the car with a loan. When you buy a car with a loan, the dealership gets paid in full for the car and your relationship with them is over unless, as in this case, you sell the car back to the dealership.

      I would never buy a 35k dollar car but that's because it's outside of my own personal budget. This family seems to be bringing in a good amount of money comparatively. We cant really spectate about how responsible this purchase was for this particular family.

    The best way to avoid problems like this is to NEVER do business with Bank of America. They are one of the worst banks. After all the BofA horror stories over the years, I cannot understand why anyone would use BofA. I had a boyfriend who was in his 70s. He was supposed to get a BofA account with waiver of the monthly account fee because he was a senior. But he was often on the phone with BofA because sometimes they charged the fee anyway. Don't put up with this crap. Dump Bank of America!

    Years ago I had frustrating problems with Bank of America. I really tried to communicate and resolve the issue - and was met with a heartless indifference. No one at the bank seemed capable of making the call to rectify the issue. It was then that I realized it was a systemic issue, and so I closed all my accounts and moved them elsewhere. They have sent me many letters wanting my business back.

    Years ago, my wife had a "Bank of America" account. She was a home distributor for a adult toy company. One of her customers wrote a personal check (no surprise back then), She had spent the money from the event (multiple customers) to purchase products. The bank allowed her to use the money before the check cleared. Then the check bounced, and what did the bank do (not tell my wife anything), they closed her account and flagged it as a fraudulent account. She had trouble getting another account (at any bank) when she found out. When she took care of that "fraudulent" account, they were confused as to why it was closed and flagged, and said that, that should not have happened.

      there can be more than one reason that would cause an issue with this type of thing. I used to work at a credit union and trust accounts are super squirrely to service. The fact that it's been 3 years, however rather than like, 2 weeks, is crazy to me.

      while i share your hopes thinking this family would get billions is fantastical though a million plus may not be unreasonable. this is going to depend on the entirety of damages awarded. punitive damages will follow mostly what the judge says the law states on the matter but juries tend to have much wider discretion on punitive damage.

    BoA should have to pay their legal fees, return the 35,000 and another 10k or so for the interest they could have made if the money had been in the stock market.
    The parents made a mistake, but mistakes happen. They attempted to correct it rapidly and the bank simply didn't take it seriously and should have.

    My sister and my daughter both had mortgages assumed by stank of America. In both cases they refused to accept the last payment to their former mortgage holder. Receipts had no affect on the idiots. Both eventually paid off the mortgages and never were credited. Both just gave up.
