Problem is her brother is pocketing all the money that's what it sounds like to me. Because if this real estate was bought from their Grandma it was probably bought 10 20 years ago so the values of increased along with rents at very minimum she should be receiving a check every month for at least $500
Anytime someone gets defensive about not opening the books to an owner means the other partner is stealing from the company. He most likely is pulling out equity from them. They are not all paid for. She's probably hearing her husband go on about her needing to "sort this s**t out with your brother" but he's not willing to get involved. So she's stuck between a rock (her brother) and a soft place (her husband). Look, she's called into the show because she's at a loss regarding what action to take. It's taken a decade and this is the furthest she's taken things. 'Option Two', getting her brother to buy her out is no-brainer. I suggest she date and write the following... "Brother mine, I love you. You say I don't trust you when I ask for information due to me. Well actions speak louder than words and your actions are shouting from the rooftops that you don't love me, that's blatantly obvious. This deeply saddens me. So I've made a decision I should have made some time ago and my actions over the next seven days will be dependent on your Yes or No answer to my following question... 'When we inevitably enter the courthouse to compel you to buy me out, ALL financial details of the business will be revealed (by law), so my question to you is this. 'Would court-driven investigations into the business reveal you've done something that could put you in jail - Yes or No?' - If no, then come and talk with me, I forgive you in advance for any mistakes you've made regarding the business. If your answer is yes, then get a lawyer and face the music, as I can no longer bear the unreasonable stress you've inflicted upon me, my husband and the kids." She was in real estate management, but knows nothing about real estate? Her grandmother wanted to gift her. But did she? And what was the terms of that? A decade and she nerve received one cent? Sounds like she is not telling the whole story.
I’m a notary closing agent and I would bet he has cash out refinanced every one of these properties and if they were paid for he probably went and got a HELOC or 2nd mortgage. He probably wasn’t collecting rent during COVID bc of moratoriums and has been living off the the stimulus packages that provided benefits to plenty of landlords. I have had multiple clients do 2 refinances in 2021 and one client did 3 refinances in like 9 mos. I would bet everything I have that he has pulled out all the equity and cash he could from this home and is living high off the hog. He probably got one of Granddaddy’s buddy’s to notarize a POA or put the property in a trust (via a title co) so that he doesn’t need all 7 ppl there during closing. Nothing would surprise me anymore🤷🏾♀️
This almost exact scenario happened in my extended family, turned out there was money OWING in the business. 10 years is a long time, enough for things to get sucked dry. I hope things turned out well for the caller. I would contemplate how much of a reputation the brother has for deceit and lying before committing 20 grand to a potentially fruitless endeavor
I would also suggest you never be alone with him. And make sure that you have protection with you at all times. Many many people have been murdered because they started questioning where the prophets of a business were going.
My guess is the brother has been using these properties as his personal piggy bank for 10 years. I bet he's been pulling out equity, and all of them are leveraged to the max.
This is crazy. He runs the partnership, but says their is no profit? How do they even do taxes without a quarterly statement of profit and losses? I think he is pocketing all the profts.
The brother has been waiting for option 3. He's playing the long game, that's exactly what he wants. I hope option 2 is what she does. Stick it to him.
She will do absolutely nothing. She couldn't even answer any simple questions - or as I say, "fundamental life" questions. This was like talking to a brick.
Geez lady, get a lawyer and Demand or sue your brother for transparent access to the financials and get your share. You may need a forensic accountant to really see where the money is. This is what lawyers are for. I bet the brother has been lining his pockets with the cousins and his sister’s share of the money. He may even have transferred some of the money to his wife in order for it to be untouchable. This is a tactic some people use but it definitely is within reach of the law. Being a doormat gets you walked on. This lady should go see a therapist and learn how to take what is her own. This Story disgusts me, but the cause of the problem rest squarely on the squirmy shoulders of the doormat.
In the brother’s mind he owns it all, and he has no intention of sharing the financials. She may as well go on and hire a lawyer because they will inevitably get there.
The problem with letting him continue to just "run" the business and NOT tell you anything....if he runs up a bunch of debt or breaks laws and her name is on the business as a part owner...then will she also be legally liable? Anything that he has to pay immediately...will he then want to divide that by all the cousins/siblings? Would she want to be responsible for those bad choices because her name is on it? eeks!
I don’t like the structure or lack of structure to family companies. I used to work for one. They prefer their own family and in some cases they can take advantage of family members and if you’re not family they treat you like family. It is better to have a business relationship with your coworkers and boss.
He probably has a gambling, or a drug problem. She needs to get a lawyer and get her money from this business including past dividends with accrued interest and everything else that goes with it.
I'd hire a lawyer immediately and ask to see 10 years of books and get what I was owed. A brother who was screwing you for 10 years is not worth hanging onto. He and everybody else is making money from this, and she deserves to get what she is owed.
Are you kidding me? The six of you are just standing by letting your brother run the show and you don’t have any say on what’s going on and you don’t know how much money is being made or spent? Positively ridiculous you’re 30 years old have you ever heard of an attorney?
When you are conditioned in your family to submit and don't try to ask questions, you sense you should have rights but question yourself. Piling on insults doesn't help her. Similar thing happened to me as a teen. As I grew and understood what happened I was infuriated but I was told the statute of limitations expired...too bad for me and my kids. Not so sure!
She needs a buyout. A CPA firm can value the business and the judge can uphold the decision for the buyout. All is well and done. Get a CPA firm that is an expert in valuing companies and they will get it done. -From a local accountant who is working to get his CPA
I was just going to say the same. Unless it's a C corp, which I doubt, she certainly must have been receiving a K1 each year for her share of the annual activity. Find out who prepares the return and get a copy of the return. She's an owner, she can get copies if she wants.
She seems like the entitled one here. She doesn’t want to do an ounce of work for the business because she think she’s “too good for” but she wants to be paid half of the profits? She’s insane and so are you
He is getting something from it and keeping the others in the dark. I bet he's skimming money from the properties (somehow) and there's enough for him but not everyone. A lawsuit should get his attention.
Another example of why not to mix finances with family members. It’s just not worth the potential headaches and possible destruction of the relationships.
Perhaps it just illuminates character traits and fractures within the family that were already present. Ideally, you should be able to trust your family MORE that outside partnerships. How sad is that?
Years ago, my father and his two brothers inherited the family business. My father immediately asked to be bought out and walked away. A few years later, both this brothers were so in debt one of them had a breakdown and the other lost his home. It was a valuable lesson to me and my siblings.
Imagine a Brother that owes you 10 years of backed compensation and taken food out of your mouth. I'm surprised that Dave doesn't mention that. Brother is a horrible entitled brat. Scorched earth is the only possible way for your brother to start on a path to accountability and humility.
You're right. The whole "you might lose your brother" thing is crazy because if he's been cutting her out of the money for 10 years then the brother was already lost to begin with. I'd lawyer up and get the cut. The guy clearly has no morals and doesn't care about his own family. He will only give it up if he is forced to.
I would hold a family meeting without the brother. Women have always been easy to exploit because they typically value relationships and family over money. They tend to be more passive and peace at any price. There is NO WAY SHE SHOULD walk away from this “found money” That suggestion was disrespectful for her grandmother’s wishes and this woman’s long term financial wellbeing. It also reinforces these stereotypes about women and money and REWARDS THE BULLY!
As the Owner of Premier Property Management, I have another, & better, option. Hire an Independent Property Management Firm. You will ALL receive a Monthly Profit & Loss Statement along with an equal Dividend Check. End of Conflict. End of family concerns. End of story. Just because someone inherits a family business, doesn’t mean they have the expertise to run it. All 7 Cousins should have received Monthly P & L’s along with Dividend Checks for the past 10 years. We’re talking MILLIONS of Dollars that her brother stole. The final question is: Has none of the other 5 cousins been questioning/wondering either?? She needs to contact cousins & talk to them.
She's not able to asked a straight question how can anyone give a straight answer. He's managing the properties she's doing nothing and looking to just be handed money.
I don't think we're getting the full story here by any means. What would the brother say if he was to be interviewed I wonder? What do the other six cousins know or think about this? Are ALL of them in the dark? Seems unlikely. And the business kicks off zero cash to each cousin and yet nobody has taken action to get answers? I suppose it's possible, but definitely weird. At a minimum, I suspect that the brother syphons off as much cash from the business for himself as he can. And if he's doing all the work, he may feel justified in doing so. At worst, he could be refinancing the properties as they have gone up in value and using the money as a slush fund to provide a lavish lifestyle for himself. That would definitely explain his reluctance to provide any details about the business to the other partners.
There is so much missing information here. Is the brother resentful she hasn't contributed any effort to the business? Is she noticing the business profitable and waking up to it deciding she wants a cut all of a sudden? Is she on title on this LLC? What's her motivation all of a sudden? What is the business? What about the other partners? I just think the information she gave us was too vague to villanize anyone
There’s three sides to a coin. Heads, tails and the side edge. The truth usually lies somewhere on the middle. I heard the brother has his own business aside from the properties, the sister has no clue about business and the grandmother is still alive. How does anyone on the outside know if the brother wasn’t entrusted to manage the properties until death and the rents go to sustain granny until her passing? No mention of a living trust or anything. I learned long ago, If it’s not in writing, it doesn’t mean Sugar, Honey, or Ice Tea.
Don't do business with family. Ever. There are just so many ways for it to go wrong. This is a perfect example. People who you think are rationale and sane lose all sense when it comes to this.
She never got tax papers on this over 10 years?? She is part owner, so any profit- she would have to claim that income. Sounds like your brother is screwing her over!
This gift turned into a curse. It's a bad idea to give a whole business (or any other asset that isn't easily divided) to several people and expect them to share it nicely. Should have kept the business to herself, or sold it and split the money.
It could have worked: the properties could have generated a profit to be distributed. Of course, the moment it became clear that this wasn't happening, the stakeholders should have stepped in and taken action.
@@fnordiumendures138 a small business with as many as 7+ equal owners, who didn't create or join the business based on their own initiative, had no chance of working well in the long run.

Don't LLCs have to file an annual report with the Secretary of State's office? I don't know if that's public information, but as an owner she's certainly entitled to see what was filed.
I'd contact all of the other 6, say I want out therefore am interested in dissolving the LLC. If they want to keep the business then they will need to show her the books in order to buy her out. If they try to hold her off she gets to see the books anyway via the court. Make it about business, not emotion. Some of the others may feel the same way and are just waiting for someone to take the lead. If brother turns out to be a bad dude then brother's a bad dude.

She needs to understand why she has never received dividends on her part. Maybe they were reinvested into other properties which is fine but that changes her payout.
Should've asked her if she's talked to the cousins to see where they stand. If any of them feel the same way she does, they could stick together and go after the brother.

Bullies need to be put in their place. You let them get away with whatever they have you cornered with, they surely find more people to traumatize.
You don't do these confrontations on family trips or at Christmas. You go to his office during business hours WITH your attorney and get the books.
And after you ask politely a few times, you have your lawyer express and uphold her legal rights.
Get an attorney, bring a claim against the brother..(He’s done with you anyway). Make him an offer during the initial conference, demand discovery of EVERYTHING, get a professionals auditor, and take what is yours. If you don’t want it, give it to charity.
I really dislike bullies…
She was in real estate management, but knows nothing about real estate?
The brother is definitely stealing money from the business if he doesn't want to share the expense statements.
Correct
It will take at least two years but forensic accountants can cost as much as 40k… That’s not including the cost of your lawyer
families are horrible....generally
The cause of the problem rests squarely on the shoulders of the brother. He seems to be a bully with ethical lapses.
She's owned this business for years and hasn't received anything. Either the business is terrible, or the brother is stealing it.
Why should she “see any money” if she’s not even putting any effort, time, WORK or knowledge into the business? That makes no sense.
@@charlesg7926she should at least have tax documents whether she made money or not.
In the brother’s mind he owns it all, and he has no intention of sharing the financials. She may as well go on and hire a lawyer because they will inevitably get there.
Dave is giving good advice. But I wouldn't trust the brother on the value of the company without having an audit done by an independent CPA firm.
Bonehead move on Grandma's part. Best of intentions I'm sure. Just sell the business and put it in a trust fund for them or a similar concept.
I really hope I can sometime run into Dave in public and say, “Aren’t you the dad of Rachel Cruze? She gives out financial advice on the radio.”
...and make him extremely proud of his legacy...?...
I would not walk away from $500k.
You sell it and put it all in dividend stock s
I doubt there is 500k. She walked away from 50k 10 years ago. The brother has probably been using this as a big piggy bank.
Get a lawyer and demand an audit.
Not to mention how rude the brother is to his own grandmother by sweeping her requests and concerns under the rug as well.
What are the rest of the family members saying? Are they as passive as she is? Are they in the know and involved in the buisness?
Agree with Ken. She needs to get what g ma give them.
There should be some 1099’s or K-1s coming to the caller each year…very suspicious
I was just going to say the same. Unless it's a C corp, which I doubt, she certainly must have been receiving a K1 each year for her share of the annual activity. Find out who prepares the return and get a copy of the return. She's an owner, she can get copies if she wants.
It's a shame family (her brother) treats each other this way, but it seems to happen all the time.
He's probably taking an income for himself out of it and the rest of the partners doesn't know anything
@@webfreakz, that's what I think too. I bet he hates that she's poking around and asking questions.
Lady who inherited real estate from grandmother-if brother is doing something nefarious, isn’t she liable as a partner? She needs to get out.
I really can’t think of any reason why he wouldn’t be sharing the financials other than he’s doing something shady. I’m sorry
Another example of why not to mix finances with family members. It’s just not worth the potential headaches and possible destruction of the relationships.
Probably an example of why to not _give_ people things rather than have them work for it.
@@someonethirsty1957 I agree, that too.

He’s a genius.
I’d be curious if the other siblings and cousins are feeling the same
I would hold a family meeting without the brother.
Get with other family behind his back and make a power play. Force him out and hire management company.
Oh man Ive heard some wild stories about management companies.
@@jeanlaubenthal698 I know many with rentals that use them for around 14% of rent.
Brother is probably hiding something from her and taking her share for himself. That's what it sounds like.
She could appoint an independent auditor to go through the company accounts
She may have 10 years of tax obligations.
She received no income.
@@kirpdeb that she knows of it could be being reinvested into an account that she knows nothing about that. Somebody else has access to.
Wow...I want a follow up on this one
Oooooweeeee!!!You can say that again!!
It sounds honorable to walk away and tell the brother it's his, but then he is rewarded for his deviousness.
Fraudulent Deceitfulness
Exactly and it completely disrespects her grandmother’s intentions, it was her plan for her money.
She's not honoring or respecting herself if she lets her brother get away with it.
She never got tax papers on this over 10 years?? She is part owner, so any profit- she would have to claim that income. Sounds like your brother is screwing her over!
She should had a lawyer involved from day one. She should asked to be sent paperwork’s and financial report quarterly
Ohhh i wanna hear the update on this situation so bad
She was gifted real estate business with seven cousins, but brother runs it. Fire him, he doesn't own it.

What about the other cousins? I'd have a talk with them and then approach the brother.
I wish we could hear updates on all this stories .
You should’ve fought for it harder back in the day in my opinion. Have him buy you out and/or force a buy out.
He's been keeping the money. It's that simple. No way these haven't made cash.
I hate how he cuts people off mid sentence. Have some respect for the people that are asking you for help.
Well, in this case it was kind of warranted. The core issue is that she can't think, act or communicate. Dave sensed that and put it on display.
Have some respect for stupid people?
I see your point, he's blunt indeed. Keep in mind though, he's running a radio show here. Nobody wants to listen to her explaining her story at a snail's pace, with "uhh" and "Uhm" sprinkled throughout the rambling. Gotta get to the point or people tune out, understandably so.
@@mikehawk9099 very true
She needs to understand why she has never received dividends on her part. Maybe they were reinvested into other properties which is fine but that changes her payout.

I don't know what the whole story is, but that wasn't all of it.
Should've asked her if she's talked to the cousins to see where they stand. If any of them feel the same way she does, they could stick together and go after the brother.
Jeez. My folks have 17 rent houses and 5 kids. This is terrifying 😂
Huh!?!? If these are income producing properties, whose been reporting income to IRS & paying taxes on the income?
What about any responsibility for any possible business mispractice that may have happened whilst she was legally a partner.
