Thanks for the information. If the service period is 5 Year and 10 Months . No of years is considered as 5 or 6 ?.. I mean what will be the calculation for remaining 10 months after 5 years ?

I resigned from a Scheduled Govt bank after working there for more than 9 years. But the bank refused to pay me the gratuity, stating that, 10years are to be completed for becoming eligible for gratuity, as per the service regulation. I have filed a complaint in Labour office. As per the instruction from the labour office I appeared before the controlling authority. It is about to complete 2 years after I resigned from the bank. Still no gratuity is received.
