When it came for redevelopment I filed the case and won in lower court.I got handsome money for out of court settlement

In most of agreement UDS is not mentioned, that's why builder go on adding new towers subsequently reducing value of our UDS in land.

All the land, area covered by the society including the Terrace area belongs to the owners via the society. And the area is to be distributed equally amongst all the owners as per their alloted share.

What happens in Housing Board flats where the land is is leased by the housing board to the flat owner who is considered a tenant in the conveyance deed of the flat?
What is the criteria off deciding the eligibility for redevelopment off the entire society and what does the flat owner get when such flat on a leased land is redeveloped?
A plot is under Government lease for 30 years and renewable next 30 years. One 100 year old house is in possession of persons who pay Corporation tax but lease is in the name of different persons who do not live there. Can the occupant of house claim ownership of the leasehold land/plot?
Sir what about builder floor? Means now a days builder built three independent floors and sold them to three independent individuals. Lateron builder also sold roof of second floor to one of them mostly top floor owner in a separate registry. Equal share of all the combined space including stairs parking and open space on ground other then buildup area mentioned in registry of top roof. Then what is the UDS authorise for the second floor owner who also owns food of the flats. Please reply

Flat owner at lower floor paid more amount than owner at higher floor level for equal built up area but as per your concept both have same share in land.why?Why not extra weightage is given for higher investor.
Location matter these are advantages and benefits will builders takes as extra profit...but after demolition no one hear you share will be equal
In high rise apartments with more than 10 floors, you have to pay premium for taking higher floors.

भारत मे हर फ्लॅट के agreement में "" फ्लॅट, अपार्टमेंट, गाला, कमर्शिअल प्लेस कॉस्ट is including land cost "" ऐशा दो तीन बार लिखना चाहिए. ऐशा नियम, कायदा करना चाहिए.

In MH there are two things
Once the entire project is sold out and is certified by Local Authorities to be completed
Builder has to transfer the land and building to the organisation of flat owners in the building
This organisation may be a Co-operative Society or Pvt Ltd company or Apartment Condominium..
Once this transfer is complete both land and building is owned by that organisation and flat owners are the shareholders of that organisation with certain occupancy rights about their flats and rights to enjoy all the privileges of the project..
Is UDS concept applicable in redevelopment.?
When share capital of each member is same that means each members share in land/FSI is EQUAL irrespective of his flat area... Is it right?

jaise 2000 sq. ft me ek building hai aur usme 10 flat hain......par 5 flat hi sold hai matlab 5 flat owner hai baaki 5 khaali hai unsold...to har owner ke hisse me 400 sq. ft. aayega ya 200 sq. ft.????......................accha samajh gaya aisa thodi hoga ki 1 flat hi sold hai to pura 2000 sq. ft. usi ka ho jaayega

If any land owner hands over his land to builder and the builder while selling does not mentions the UDS in the sale deed to the purchasers of apartments, pl inform what the law says in such a situation.

Bhai sahab mujhe to ye samjh nahi aa raha hai ki kisi building ka build-up area society ke total surface area se greater kaise hoga. Example ke liye ki total jo falts bane hai unka area 125k sqft and total society area is just 100k sqft....

What will happen if the builder mortgages the land title deed to the bank and keeps on taking multiple loans on the same land where owners are currently staying? The society is yet not handed over by the builder and owners of the society made their own welfare association to run daily expenses.
