I have a self-directed IRA in both gold and silver overseas in a Switzerland private vault. When I go to sell my precious metals (PMs), what are my best options. If I sell back to the seller, I will only get spot price. Today premiums on PMs are high plus you have to pay sales tax. When I sell, I would like to get spot price + a portion of the premiums. Ultimately a private buyer would be best because your eliminating the middle man such as APMEX. Shipping cost and insurance back to the USA from Switzerland maybe cost prohibitive. Can you explain why an LLC is needed to be formed? can the Self Directed IRA on its own invest without the need to form another entity? I am just unclear on the need, reason or value provided by creating an additional entity? Is it that it is much easier to hold a bank account and maintain self control of the funds in it if it is an LLC rather than an Self Directed IRA holding a bank account? Is it solely to keep the banks from trying to create a fiduciary relationship with your self directed IRA bank account and limit what you can do with it? I have a SEP, Traditional, and a Roth. Together, there is enough to buy a home cash. I know/believe I can combine the SEP and Traditional (similar type accounts). I’m planning to roll over partial or full of my funds from my 401k (about $100k) to a self-direct IRA to start investing in RE. My question is the following... I need to pay $20,000 for the course. UBIT?? - From other things I've read, creating an LLC owned by a solok to hold real estate would trigger a UBIT tax. Is that correct? That was a big surprise and seems limiting. Is there a way to avoid it when using a passthrough entity (like LLC)? Would hate to give up liability protection for other assets of the SoloK.

Your SD IRA can not invest in any business owned/controlled by a prohibited person. So if you own the construction company, then NO. If you only own a portion, then MAYBE. There is a percentage of ownershion -- and I don't know that number -- that you would be allowed to own.

Hi Mark, I get the feeling that, in order to SUCCESSFULLY be investing my money in SDIRA, I need to be an expert investor as I will be the one who will be in absolute control on what types of investments to choose from, conversely from what happens with, for instance, a 401K where funds are invested by a third party. "Investing in what I know" does not seem like a viable option to me at the moment, as I am not an experienced or competent investor. Should I just stick to regular IRA (ROTH or non) then? I am very interested on your thoughts on this matter, please, as it seems that you are a massive advocate of this type of investment. Thanks so much!

The question is how do I pull money out of my business account from Quickbooks? Do I call this $26000 as self directed 401K “expense”, or do I call this an equity withdrawal from my Quickbooks? I am worries about the ubit taxes for self directed iras on leveraged real estate.. would love to hear your thoughts. I have consulting business so in could set up a solo 401k in theory but managing the paperwork isnt exciting to take on.
Couple quick thoughts. UBIT doesn't apply on leveraged debt when investing within a 401k (only within an IRA). Also, the paperwork isn't much more than you would take on with ANY rental property and LLC. There are also plenty of law firms and accounting firms that will teach and affordably give you support if and when you need it. Based off the way you phrased the question, I am going to say no. You cannot buy any real estate for personal use in a retirement account, this includes renting the property to family. So I can take my current Roth IRA that I have with Vanguard and make it a self directed Roth? I work for a shipping company and I have a 401k with the shipping company.
You can have BOTH a Roth and a 401k. They are different (I'm sure you know that...but just saying). So you keep the work 401k and self-direct the Roth separately. The next step is to 'transfer' your Roth from Vanguard to a self-directed trust account/custodian. Consider www.directedira.com. Also, you'll want the book: www.sdirahandbook.com. @@MarkJKohler because I can take after tax money out of my check each week and my roth is also with vanguard it makes it easy to roll that after tax money into my roth. Its a back door way of essentially putting more than the 6k each year into my roth. I do max out my 401K and Roth and max out the after tax $ i can take out of my check. If I moved my roth to a self directed account, I guess I would have to do a little more paperwork to roll the after tax money into the roth since it would no longer be with Vanguard right?

My employer has a great 401k. You’re fully vested at Year Two, and from Day One the employer contributes $1.25 for every $1 I contribute. I look at it as a great tax deferred raise.

I have a SEP, Traditional, and a Roth. Together, there is enough to buy a home cash. I know/believe I can combine the SEP and Traditional (similar type accounts). I am thinking I would need to form one LLC (which will own rental property)and have a Roth SDIRA be one member and a Trad SDIRA be the other in my circumstance. Is this correct? I’m planning to roll over partial or full of my funds from my 401k (about $100k) to a self-direct IRA to start investing in RE. My question is the following... I need to pay $20,000 for the course. Would it be any tax penalties\inplications If I roll over, let’s say 30k to a self- direct IRA and then take $20,000 to pay for the course?

UBIT?? - From other things I've read, creating an LLC owned by a solok to hold real estate would trigger a UBIT tax. Is that correct? That was a big surprise and seems limiting. Is there a way to avoid it when using a passthrough entity (like LLC)? Would hate to give up liability protection for other assets of the SoloK.

Your SD IRA can not invest in any business owned/controlled by a prohibited person. So if you own the construction company, then NO. If you only own a portion, then MAYBE. There is a percentage of ownershion -- and I don't know that number -- that you would be allowed to own.

Hi Mark, I get the feeling that, in order to SUCCESSFULLY be investing my money in SDIRA, I need to be an expert investor as I will be the one who will be in absolute control on what types of investments to choose from, conversely from what happens with, for instance, a 401K where funds are invested by a third party. "Investing in what I know" does not seem like a viable option to me at the moment, as I am not an experienced or competent investor. Should I just stick to regular IRA (ROTH or non) then? I am very interested on your thoughts on this matter, please, as it seems that you are a massive advocate of this type of investment. Thanks so much!

The question is how do I pull money out of my business account from Quickbooks? Do I call this $26000 as self directed 401K “expense”, or do I call this an equity withdrawal from my Quickbooks? I am worries about the ubit taxes for self directed iras on leveraged real estate.. would love to hear your thoughts. I have consulting business so in could set up a solo 401k in theory but managing the paperwork isnt exciting to take on.
Couple quick thoughts. UBIT doesn't apply on leveraged debt when investing within a 401k (only within an IRA). Also, the paperwork isn't much more than you would take on with ANY rental property and LLC. There are also plenty of law firms and accounting firms that will teach and affordably give you support if and when you need it. Your IRA can loan money to any "Non-Disqualified person". Unfortunately it could not loan you money.

Based off the way you phrased the question, I am going to say no. You cannot buy any real estate for personal use in a retirement account, this includes renting the property to family. So I can take my current Roth IRA that I have with Vanguard and make it a self directed Roth? I work for a shipping company and I have a 401k with the shipping company.
You can have BOTH a Roth and a 401k. They are different (I'm sure you know that...but just saying). So you keep the work 401k and self-direct the Roth separately. The next step is to 'transfer' your Roth from Vanguard to a self-directed trust account/custodian. Consider www.directedira.com. Also, you'll want the book: www.sdirahandbook.com. @@MarkJKohler because I can take after tax money out of my check each week and my roth is also with vanguard it makes it easy to roll that after tax money into my roth. Its a back door way of essentially putting more than the 6k each year into my roth. I do max out my 401K and Roth and max out the after tax $ i can take out of my check. If I moved my roth to a self directed account, I guess I would have to do a little more paperwork to roll the after tax money into the roth since it would no longer be with Vanguard right?
