If someone has HIV and wants to sleep with someone, they are legally required to inform that person beforehand. By not disclosing that detail, the transperson is potentially endangering that other person's psyche. Although the details of this case are morally wrong and we can all agree you should fully disclose to the person you’re having sex with; there’s no way of telling that conversation didn’t actually happen; besides the word of someone who’s going to trial for murder (this would give their DA the angle to prove that he has motive to lie; even if he did agree to have sex with a transgender; to avoid prison time)
So what I’m saying is it’ll be hard to prove rape and extremely easy to prove manslaughter. Because you voluntarily agreed to have sex, and you admitted to shooting this person and you can’t just shoot people cause you were tricked, deceived or embrassed.

If someone has HIV and wants to sleep with someone, they are legally required to inform that person beforehand. While being trans isn't in any way an STD, it is still something that many people are not comfortable with and could cause certain individuals to immediately be disinterested. By not disclosing that detail, the transperson is potentially endangering that other person's psyche. Rape requires force, threat of force, or someone incapacitated or under the age of consent, i.e. incapable of giving consent. Being incapable of giving consent is different than consent under false pretenses. Some states have laws on the books that criminalize sexual conduct resultant from deception and others simply call it puffery of seduction. You also have to consider the nature and type of fraud. It is incorrect to simply label this as rape. Doing so sets a undesirable precedent.
