He has been receiving help for years, but too many things trigger him to get scared easily, especially loud noises or people accidentally scaring him.

So many prosecutors care more about their record of won cases than whether the crimes could happen again in the future. THIS one, though... This is bad. I'm glad the judge stepped up where the prosecutor couldnt, but the idea that this guy could do what he did, have obviously no remorse and no desire to make sure his issues were dealt with, and face ZERO jail time? PTSD, ADHD, are diagnosed way too easily. Therapists will diagnose PTSD for being in a minor fender bender. It really has diminished what was originally called "shell shock" from the horrors of combat. It's now a crutch like screaming, "I can't breathe". Really bothers the hell out of me.
Agreed. They have also added bipolar to the list of conditions they all have. That’s along with the dying mother/father/kid only they can care for, and the famous broken limbs and breathing problems.
I think the prosecutor realized his mistake after hearing the victim statements. Prosecutors are a real problem in our system. Most of the time they only go to trial for cases they believe they are certain to win.They focus too much on their conviction rate. It's something to watch for in court cases shown online.

Movies and tv portray gun violence so casually, but this is the reality: grown men with extensive training and support experiencing lifelong traumatic effects from one nonlethal encounter. It isn’t the kind of thing a sane person can brush off. I wish more people understood that before being allowed to touch a firearm

But this fact does not negate what this defendant did to these specific individuals on that specific day that caused danger and trauma that was criminal. The 2 types of injustice are both true and both unjust and wrong. One does not cancel the other out. One does not justify the other. These individuals (the victims) were the victims of this specific incident. I feel that sweeping generalizations are being used to excuse this very specific incident.

Human beings that don‘t belong in a confinement where they are 24 hours a day with people that habe done violent, heinous and unspeakable things… This guy was pushed from place to place since he was a child. He‘s had, fortunately, a loving family who adopted him and addressed his mental health. Even The judge nor everybody else but himself know what went wrong when he left the family to study without success, got from job to job and finally was accepted by the marines, where he wasnt successful, couldn‘t fight for his land, and was honorably discharged. But somewhere in this years he stopped taking care of his mental health. Was it because they told him he couldn‘t serve for his country while taking the pills he so desperately needed? Finally the judge did give a damn about the history of his life. All what she cared was what the 3 people said how life changing this was. She heard their statements, and I guess we all knew what will happen! This woman has little to no empathy, she has can‘t put herself in another’s persons shoes… A good judge looks the things from a neutral perspective. Victims exaggerate the real impact on their lives. That is why there are states where victim can give their statements after sentencing, because judges are humans and a good eloquent speaker can overwhelm and confuse people with emotions so much that it becomes impossible for a judge not to have this in mind when he/she is looking for the right sentence! This man should have got probation and a really good metal health assessment with further in- or outpatient treatment. But now the taxpayer pays hundreds of dollars a day for 3 years and nobody is getting something out of this. The victims are not suddenly on the point in life before it happened, the defendant doesn‘t get a real trearment for 3 years, and because of his mental health it‘s very likely that learns from his new buddy’s how to become a career criminal… Well done judge!
Literally an alcoholic with clear mental issues who pointed a gun that seemingly was an attempt to kill end his own life at times and he was talked to like the butcher of a small European town during Nazi occupation. So much respect was lost for her. I hope all EMS workers heal and so does this man in spite of what I just watched.

I think if they’re going to sentence at the top of the plea deal or outside of the plea deal,it becomes even more important, but they are required to ask each question, just like law enforcement has to go over Miranda warning.
You must not be familiar with how the court system works. It's how the process goes. She has to make sure everything is understood by the defendant, as well as making sure every little piece of information is preserved on the record ACCURATELY for eternity.

@@rachel8622 first of all, claiming he didn’t seek treatment for any medical condition let alone one as complex as PTSD is so bizarre and far off, as to use that against him with the countless factors that okay into seeking, obtaining, etc. treatment for any mental health issue should never be held against anyone let alone criminally. On top of that, he’s an alcoholic. Another disease that is the most common and self destructive way the vast majority of those suffering g from mental health issues self-medicate besides itself alone being a disease. Lastly, six years of abuse? Or six years of suffering from a multiple diseases with no criminal record previous nor in the year plus since. As a matter of fact he did the biggest and hardest part of addressing his issues which was being sober. That’s a DAILY struggle that countless succumb to in the most tragic ways and he was doing it. I also don’t know how, maybe without saying the exact words she wanted, he didn’t. He literally said he was so ashamed that he asked the court to KILL HIM. His actions, while a long way to go, and words which admitting those things internally most don’t get to but not what she wanted to hear was massive. Again, this judge is compassionate and I love her but this incident and clearly because it involved multiple gov departments pushing for charges again and every single one they could find multiple times was so apparent it was so disappointing and just wow. Not that he shouldn’t have gotten punished or anything but to call him, a vet, a weapon and so dangerous to everyone was just appalling to me.

That’s ridiculous, a firefighter should now carry an air tank , carry a hose and a gun . Maybe when shots fired should wait for area to be cleared by police. I commend the veteran/ marine with ptsd for getting help and the taken a public service job . Pray he can get back on track . I was a critical care nurse and cared for many Vietnam veterans who were exposed to agent orange and severe trauma. I usually took care of them with complications of alcohol abuse, trauma from accidents or attempted suicide. So sad to see veterans suffer from trying to preserve the rights and liberties for all of us.

@@rachel8622 first of all, claiming he didn’t seek treatment for any medical condition let alone one as complex as PTSD is so bizarre and far off, as to use that against him with the countless factors that okay into seeking, obtaining, etc. treatment for any mental health issue should never be held against anyone let alone criminally. On top of that, he’s an alcoholic. Another disease that is the most common and self destructive way the vast majority of those suffering g from mental health issues self-medicate besides itself alone being a disease. Lastly, six years of abuse? Or six years of suffering from a multiple diseases with no criminal record previous nor in the year plus since. As a matter of fact he did the biggest and hardest part of addressing his issues which was being sober. That’s a DAILY struggle that countless succumb to in the most tragic ways and he was doing it. I also don’t know how, maybe without saying the exact words she wanted, he didn’t. He literally said he was so ashamed that he asked the court to KILL HIM. His actions, while a long way to go, and words which admitting those things internally most don’t get to but not what she wanted to hear was massive. Again, this judge is compassionate and I love her but this incident and clearly because it involved multiple gov departments pushing for charges again and every single one they could find multiple times was so apparent it was so disappointing and just wow. Not that he shouldn’t have gotten punished or anything but to call him, a vet, a weapon and so dangerous to everyone was just appalling to me.
We are in the minority but I 100% agree with you. A few cringe statements from the judge and yet most everybody follows along. The judge comes across as unempathetic and prejudiced. A shame.

That’s ridiculous, a firefighter should now carry an air tank , carry a hose and a gun . Maybe when shots fired should wait for area to be cleared by police. I commend the veteran/ marine with ptsd for getting help and the taken a public service job . Pray he can get back on track . I was a critical care nurse and cared for many Vietnam veterans who were exposed to agent orange and severe trauma. I usually took care of them with complications of alcohol abuse, trauma from accidents or attempted suicide. So sad to see veterans suffer from trying to preserve the rights and liberties for all of us.

Not sure what special country you are from but here it's scary to have a gun on you regardless of situation, regardless of warranted or not, regardless of who aims it, regardless of skin color. People are individuals. Some are terrible, some are great. Whether they are police, politicians, doctors, gardeners, parents. Its time to stop with the profiling people based on race, jobs, gender, etc..except when it's serves our point of view. And thats what you did. Its hypocritical and ugly.

@@Lomojo31 imho OP is race baiting. I'm black and idk how anyone could hear this case and come back w/such a cold, nasty, unrelated comment. The officers, the firemen, the first responders, could have been of any color...they tried to help some1 in distress and ended up at gunpoint. They risk their lives daily, but almost dying on the spot is 100x different.

It's stilly to believe since some cops pointed guns@ POC, all cops are bad and none of them have a right to be safe/NOT have a gun pointed @them. SOOOO since some black person did something bad, then all blacks are criminals and deserve to be treated the same, right??? where's the logic? treat ppl by what they do, as another commenter said, they are individuals.
