"Assault" on a federal agent???

  • That's right; this is what your fucked up government considers an assault on a federal agent. A few minutes after I pulled away, I was stopped and detained on the side of the road. I demanded my vehicle be towed (at my expense) back to the checkpoint where they wanted to take me but a CBP agent got in my car and drove it back. When they returned me to the checkpoint I was arrested for High Speed Flight from a Checkpoint (A Federal Felony) and within minutes of an illegal search of my vehicle (and without my presence) I was told they found drugs in my car. Conveniently, an equal amount of .01 lbs of marijuana, cocaine, LSD, & mushrooms of each (none of which were actually in my car or I have ever done). Of course they wanted to seize my car, claiming it was ‘used in the commission of a crime’ as well as taking possession of my five (5) legally owned and properly stored firearms. After spending a week in jail in El Paso, Texas that charge was DISMISSED, because I didn't ‘exceed the posted speed limit’, the main criteria for that charge. And because they couldn't get me with the felony charge, as I was waiting to get released, they threw a new charge at me, “Assault on a Federal Agent”, although this time it was a Misdemeanor. I spent a total of 18 days in jail before being released on bond, had a trial, and was found GUILTY. After the trial my defense team asked the jury why they voted that way. They said, “We felt like he should have answered the question like we all have to”. THIS is the problem with uninformed people who don’t know their rights! Like the right NOT to answer questions. I was sentenced to 8 MONTHS in jail, currently still out on bond pending an appeal. I feel pretty strongly that an appeal will go though as the judge refused on two occasions to properly list the charge on the jury instructions, as well as a few other issues. During this whole time, and to this day, ATF has seized my firearms claiming they are keeping them under ‘civil forfeiture’ because “drugs were found in the car”. I've yet to be convicted, let alone charged with ANY drug crime!
