    @brianwillson3693 1 second ago Given up at birth and adopted at 2 yrs old and again at age 8 yrs old in a different state.Then after 35 years me & my 2 little sisters who us 3 were adopted in 1973 .My 2 nieces kept our 86 year old mothers whereabouts hidden from us 3 kids to moms death .Then they did not make gifts of my mothers property and did not create a special needs trust for me like the attorney-in-fact was authorized to do .Here in Oklahoma City when your on SSI you can find "no legal representation" anywhere in Oklahoma City.

    I understand there are tax implications depending up on how people are listed, ie Grantor, Trustor, Trustee, etc. What is proper way to designate the trust in the documents? ???Family Trust, ???Grantor, ???Trustee and on and on. Does each type of listing create issues to the parties tax wise? All assuming the Trustee has to sign and execute documents.

    You attorney's over emphasize the issues from second marriage couples. Its simple if the Surviving spouse accepts the first deceased spouses testamentary gift then this locks the Surviving spouse in the same legal binding contractual obligation that the first deceased spouse was forced to fulfill. Time after Time after Time what would you say as being in this professional legal profession happenes very shortly after the first deceased spouse passes away. WOW IM EXTREMELY IMPRESSED. YOUR CORRECT: The surviving spouse before the ink can dry upon their deceased spouses death certificate they HOP SKIP AND JUMP right into the nearest Wills Estate and Trust law firm to do what WOW AGAIN IM EXTREMELY IMPRESSED The surviving spouse drafts up a new will revoking ALL of the Promises which were made to the Deceased Spouse that upon the Surviving spouses death that they will divide everything equally. NO WHAT HAPPENS IS FROM ALL OF THE CASE LAW THAT IS FILED UPON WHAT KIDS FROM THE BLENDED FAMILY ALWAYS GET DISINHERITED. SIR YOU DESERVE THE GOLD MEDAL OF THE YEAR EXACTLY ITS THE BIOLOGICAL LINEAL HEIR CHILDREN OF THE SURVIVING SPOUSE THAT GETS DISINHERITED. Case after Case after Case the Step Children always receive the combined estate assets and property and the Biological Lineal Heir Children of the Surviving Spouse end up with NOTHING . WOW how does that happen. GONG ON THE GONG SHOW. Challenge: Send me one fiked case law that shows that 1st the Surviving Spouse changed their will PRIOR to the death of the First deceased spouse 2nd That after the first deceased spouse passed away the surviving spouse goes and drafts a new will leaving the step children everything.     Thank you for this video...I haved learned so much! I need help with a situation that I am currently being faced with unfortunately. I am a healthy 58y/o who has fallen in love with a 69 y/o who has been recently dx with Parkinson's disease stage 1. He is very active and disciplined with his diet and is wanting for us to be married sooner rather than later. I own several homes and other properties and am concerned about my 3 children's inheritance as well as my potential loss of retirement funds for myself and also for my future husband. I am considering setting up a MAPT now before marriage. What would happen if I set one up now and 6 months down the road get married and if he were to become ill? 1. Would medicaid look and consider my mapt and look back period for His care? 2. Would I have to use my investments/401k, 403b for the spend down? We are all going to end up with some kind of diagnosis sooner or later but this is something that we do know about now and I feel like we should prepare for especially since we are aware of it. Please help me with any advise you can offer.....Thank you!

    On October 26,1982 i was in a severe auto pedestrian accident at age 17 years old a senior in high school in Oklahoma City.Taken to one hospital and later transferred to another hospital where i awoke out of a coma.My injuries were a closed head injury,pelvis,coccyx, displacement ,shattered left hip & femur,internal bleeding,dislocated left arm,coma... Many years later my 86 year old mother signed a Revocable Trust & in the General Durable Power of Attorney under 3.22 Power with Respect to Create Additional Trusts my mother authorized the attorney-in-fact to make gifts of her property & my mother authorized the attorney-in-fact to create an irrevocable trust and/or a special needs trust or trusts.My niece the attorney-in-fact sold my parents 2-1/2 homestead acreage of 62 years & going on 16 years there has no special needs trust ever created.Note after proofreading this trust last March 2023 is when i came across this information.Im on SSI and am the oldest son and the only person in my entire family who is disabled.However I cannot find or afford legal representation anywhere.Help please.

    I retired from law over 5 years ago. Most of this advice you can just Google and download the paperwork.. He just wants your money and gives very little advice. Save your money- after all the fees you're paying him/firm over $10k, save your money and go on a nice vacation instead.

    Outstanding most detailed outline of MAPTs, how's and why's, and the real Trust one needs before poor health comes knocking at the door. Thank you!! This should be taught to the general public, maybe even starting in high school and college. Definitely at the community level. Medicare, Medicaid, and Probate laws keep people poor or cause too many family problems because of health care costs or money. That should not be something to worry about in life or death .

    Monthly funds from pensions; social security; interest; dividends; RMDs; and annuity payments exceed Long Term Care. Does Medicaid have a right to claw back these monies to pay for care?

      From what I understand, SS & Pensions are resources & not considered income. So they are not included in Trusts & will not be impacted for Medicaid. Interest, dividends & RMDs are considered income and will be used for your care.

    Yes, I have an ear revocable and my husband died in July 28 but now they’re staying in an accident that we put a claim on with her lawyer he saying it’s got to go to probate I didn’t think of irreversible trust had to go to probate what is the answer?

    I'm trying to figure out if a home can be protected from medicaid for my aunt. She had a horrible accident at home and has irreversible brain damage and needs to go to facility skilled nursing care. Dementia She only has her home and social security. It is so complicated to me. It's hard to know. I did get attorney/ conservator and the appointment will be in place Jan 5. She lived alone and no mortgage Her brother in law ( from her deseased husband) I feel should be able to get the house when she passes. Anyway, need her in 24/7 care now and she has no mental capacity to care for herself. The conservator/ guardian should be getting the medicaid for her care. I'm so nervous and stressed. We live in Alabama

    Being co-executor with another family member doesn't always turn out to be "two heads are better than one". Our family had co-exectors and one of them mistrusted lawyers were suspicous of IRS, taxes, ets. They fought every step needed in settling the estate, cost the estate thousands of dollars in lawyers' fees and extended time to settle.NEVER AGAIN on CO-EXECUTOR!

    Hi, Elder Law and Estate Planning is Extremely Complex and full of pitfalls. Thank You for your Extremely Informative Videos. You seem to be Brilliant Attorneys. I would like to see VIDEOS THAT ANSWER THE FOLLOWING QUESTIONS, and I would greatly appreciate it if you would please answer the following questions. My Private Attorney seems to be a Lazy Negligent Incompetent Attorney. I had no prior experience with Attorneys. I would like to know what constitutes a Good Attorney? Under what circumstances should you Fire your Attorney? What would YOU do if you had an Attorney such as mine? I have an Attorney who: 1)Is so DISORGANIZED that he CANNOT FIND the WRITTEN FACTS OF MY CASE even after dozens and dozens of hours of looking for the Document, such that now the Document is essentially lost. I remembered the Facts when the Document was written, but now I do not remember many of the Important Facts. And of course my lazy Attorney does NOT remember the Facts either. Isn’t an Attorney supposed to be Organized and Easily Find the Written Facts of his Client’s Case? 2)One of my Attorneys Took Notes and Wrote my initial Statement Of Facts regarding my Case, but after that Attorney left the Organization, my present Attorney Lazily REFUSED TO TAKE ANY NOTES about the remaining FACTS OF MY CASE. And when at my request my Attorney set up Appointments to hear me talk about the remaining FACTS OF MY CASE, my Attorney lazily REFUSED TO TAKE NOTES, saying that he would Remember everything I said; then later HE FORGOT MOST OF WHAT I HAD SAID. Also regarding the Appointments to hear the remaining Facts Of My Case, my Attorney arrived Late, took a Long Lunch, and Left Early to go Play Basketball, etc.; he was Extremely Well-Paid for all of that. Isn’t an Attorney supposed to Take Detailed Notes regarding the Facts of his Client’s Case? 3)I had a WILLING CRUCIAL WITNESS whom MY ATTORNEY REFUSED TO BOTHER TO INTERVIEW, and he even Refused to take her Contact Information. Isn’t an Attorney supposed to Interview and keep Contact Information regarding Crucial Witnesses? 4)It seems that my Attorney engaged in IMPROPER BILLING. At times my Attorney charged Exorbitant Amounts Of Money to Represent me, while NOT actually doing anything on my Case. What should be done regarding an Attorney who Improperly Bills? 5)Generally my Attorney DOES NOT COMMUNICATE with me. Generally my Attorney says he does NOT read my Mail, read my Email, nor listen to my Voice Mail. What should be done regarding an Attorney who Refuses to Communicate with his Client?

      My husband and I had it in revocable trust we had a car accident in January 2021 and my husband passed away July 28 now my lawyer is telling us that we have to set up an estate and go through probate for me to claim my husband’s president insurance man could you give me an answer on this please
