    They say that wills become invalid once one marries, does this apply to trusts as well? So for example if I own a home, put it into a trust, then get married. If the marriage fails, would the ex get the share of the property?

      Actually, it's 45% if income is dischraged through a Trust. Instead, why not have the Trustees mandate it out to a bene who declares it at a lower rate OR pay the tax and re-coup it with a R185 form when a bene turns 18. Lots of options.

      It depends. Short Answer: Yes, however if you continue to live in the home then No (it'd be a GROB). Instead would it be a bad idea to speak with a professional Estate Planner to find the correct way to reduce your estate for IHT? (There's loads of legal ways to do this)

    Could you discuss how this impacts IHT? Yes, protecting from care fees, but doesn't this mean losing spousal exemption? Or would this be considered RNRB if passed to children via spouse?

      There is no lose of spousal exemption - the way we deliver frameworks retains the RNRB and all tax reliefs while protecting from all the modern threats including Care Fees.

    A great Q&A video, thanks. Future ones might be better if shorter, because many viewers skip videos longer than 20 minutes. I heard Mike say that anything that can be owned can be put into trust, but bullion cannot be put into trust. Many of us would feel better educated if we knew why.

      Loose gold and gems are VERY hard to denote specific ownership. Whereas a bullion account (and the contents therof) can be put into a Trust as this has an account number. Cars have VIN#'s, Planes have tail #'s, homes have HMLR. Does this make more sense?

    Surviving parent wants to gift the family home to his son. His son has always lived at the family home. No mortgage, no money changing hands, property value way below the inheritance tax threshold. No trust required, just change of name on the deeds??

      That is one strategy - and can work. There could be SDLT. Next Problem: What happens when the kids get a divorce? Will Mum and Dad become homeless? You bet. Better plan: Do what the wealthy have done for centuries, place the home into a Trust.

      The Local Authority pays out of the decades of taxes they've taken from famliies! (And if you protect your home then you can keep you options open if you want to supppliment the state care - eg Keep Control). The two basic rules of Estate planning : #1 Don't let the family lose the money. #2 Keep the family in control of their money.

    In my family my Dad died without signing his will and my 90 year old mother with cancer refused to set up an LPA because in her words, 'I've not got dementia!' The problem is the fear of death and others.

    You say in the video that a lifetime trust is exactly that in that it lasts 125 years with no additional payment. However on other channels I’ve watched they say that there is a trust payment every 10 years? Please clarify. Thank you

    Great episode - would love to see more long form content. Wouldn’t alphabet shares, especially with the growth going to a trust serious limit your choice of lenders? Lenders prefer vanilla circumstances. Also, if this becomes common practice, you can bet your bottom dollar the government will change the rules

    I’m not gifting my home to my kids, I’ve given them both deposits and furniture for there own homes. I’m selling my home and enjoying spending it on myself. A house is bricks and mortar, you can’t take it with you when you die. Enjoy your life before you die, I might go rent in Spain. 🤣🇬🇧

    This is extremely risky advice and people should be very careful going down this route. The potential downside to these trusts from a CGT and IHT perspective is very large, and people should research this carefully for themselves before being gulled into going down this route.

      Great Comment! As far as CGT goes on a main residence - not sure if you are aware there is no CGT (s223 or s225 relief). For IHT, there several strategies for reducing or eliminating IHT altogether. As commented: make sure your adviser knows what the heck they're doing! Mike

    Was always led to believe trusts help avoid paying iht. Maybe this used to be the case but not anymore. Dealt with two "specialists" now on these matters and still cannot understand the actual benefit of a trust other then some protection ie marriage, care home fees, probate. But you can put things in place to offset these things ie hire private care instead of placing you loved one into a home it would be much cheaper especially if they already have their own home. Marriage is not for everybody. Probate savings are swallowed up from ongoing trust fees over time. Am I only one missing the point here? Surely if you want to avoid iht simply move to another country that isn't so greedy and pay nothing. Job done

    If a property is gifted to the children and the half way through the 7-year period (say 2 years), if the parent needs to go to carehome, would the gift still stand? Or the gift is cancelled and the council takes charge of the property. I understand the gift becomes less effective if the parent passes away before 7-year period. Just wondering what happens if the parent goes carehome?

      The 7 Year Taper Relief is about IHT planning, not Care Fees planning. If Care is a concern, we recommend settling a Trust as far in advance of Care as possible. Time is the secret ingredient. For Tax planning the first 3 years offer 0% relief, after 36 months the taper starts. It ends after 84 months (7 years).

    I have been contemplating a trust for my child but I can’t get my head round the face that there must be a caveat…why aren’t everyone creating trusts if it was so easy. I’m horrible at admin does it require a lot of accounting work on a yearly basis?

      Two Q's in one; here we go: 1) 53% of adults in the UK will die without even a basic will - people don't use trusts because they don't want to learn/know/talk about this stuff(?) 2) There should be ZERO annual fees or additinal costs if you place your family home into a family home protection trust, and you and your partner (and adult chidlren are the trustees). How was that? Mike

    How old can your children be when adding them into the trust ?

      18 to act as Trustees. They can be added as beneficiaries at any age - but would only receive the benefit at the age of 18.

    ive been on disability for 10yrs, now 42. Nan is likely to pass within ten years. There is hope, but no guarantee i can work someday. So chatGPT suggested i set up a discretionary trustfund (for myself) with the portion of the inheritance that will end with me, if im still disabled when she passes, so i can protect it from income tax and protect my disability benefit, and grow it via investing with view to buying a home. I found this to be a good intro video, thank you

    I am a single parent to two adult children. If I leave my home in a discretionary trust, I was shocked to learn they’ll still have to pay 40% IHT on the amount above £335k and the £175k allowances. I thought trusts eliminated the beneficiaries, in this case my children, paying taxes?

      Trusts CAN help protect assets above £500k from IHT - BUT you will need some tax planning in addition to the trusts. We do this everyday of the week (did two more today). Speak with a professional estate planner or give us a call. Mike

    If I put my house into a trust today (to avoid IHT) would I be able to sell it in the future if I wanted to move home?

    Sadly, this comes too late for me. My mum had a fall in mid-April this year, spent 3 1/2 months in hospital and is now permanently bed-bound and living with me. It wasn't practical to let her return to her home because she would have been alone for long periods each day and night with no-one around - she had to be rushed back into hospital a week later in the early hours of the morning because she couldn't breathe, so would probably have died. She thought she'd done the right thing back in the 1990s, when she made a will, but the solicitors never mentioned putting the house into trust and she wouldn't have known, she just thought that making a will would mean everything she left would come to me. Now she has 2 carers coming in four times a day, but will need to go into a care home before much longer because I can't do alone what it takes two trained people to do, and I feel she needs more care than I can provide in between those visits, especially at night. Of course, the local county council were rubbing their hands together thinking they could put her into a home and put a charge on the house, something she doesn't want and neither do I, so we have cut them out of the picture and she will be completely self-funded. We will have to sell her bungalow and invest the money to make sure we can cover the costs (we have financial and health LPAs) and I just have to hope there will be something left. She is 88 and both her parents died in their 90th year so, if she follows suit, with the care home I've picked out the annual cost of around £65,000 (at the moment!) should leave me with something, but I shouldn't have to think that the sooner my mum dies the better it will be for me. It might be the truth, but it's not right and it makes me very uncomfortable to know that. It shouldn't be necessary. She worked all her life and because of that she gets no help until it's nearly all gone. I look at her now and I know that could be me in 20 years' time. It won't be, I'll make sure of that one way or another.

    What if one starts a property company and make the children as directors and shareholders of A and B Shares. Would that be as good as Trusts and less expensive?

      This can work. Taxes on businesses change every budget. Taxes on trusts change once a generation or so. Trusts normally win out over time, and are less expensive in the main.

    In the UK, inheritances are usually not considered matrimonial property by the Court. So it doesn't happen 'all the time'. This is scaremongering. Also CGT is chargeable on trust assets once sold by beneficiaries.
