What if my parents have a revocable trust? Same clock and same protection?
I found out information I get on TH-cam give me contradicting information. I don't know which one is correct. You said there are asset limits , but some people said there is no financial question asked as long as you are over 70% disabled proof rating and work related.

I'm the only child and I have power of attorney with my dad. He has moderate dementia and has been refusing to go to an assisted living facility because he can't take his 8 cats that he can't even properly care for because of the amount of waste they produce. He's been getting lost and almost drove into a parade recently. His driving privileges are going to get revoked soon, according to the police LT I spoke with. Any ideas what is the best option for care? PS: He lives in NY, I live in FL.

Generally, guardians have control over the every-day decisions and care of a minor. Conservators have similar control over an adult, but they're typically limited to financial decisions. Hi. Is Nevada a state with a long arm? I'm worried because I just found this out that they can take the house. I had cancer 6 years ago and I'm sure the bill is high. I put my adult son with disabilities as joint tenant in October 2018, but it sounds like they can still put a lien on half the house. Any advice would be appreciated.

I got my husband SMC R2 approved recently as a clear and unmistakable error 1.Highlight the criteria for aid and attendance… 2.Highlight doctor’s note,medical record (outside from VA) and VA Medical history list match the code of federal regulations. www.ecfr.gov/current/title-38/chapter-I/part-3/subpart-A/subject-group-ECFR6477ad08d327384/section-3.352 VA Form 21-4138 Statement in support of a claim VA Form 21-10210 Law/witness statement (If needed) VA medical history list can find--- On my healthVet page, go to -Health record -Blue button medical report -VA blue button report - Select date range - @ VA Electronic Health record History and wellness reminders -Select VA note For 33 years I contacted about 10 VBA staff members, Nobody knows basic criteria for the higher level aid and attendance allowance.(SMC R2) The VA provides many benefits to the veterans compared to before. Unfortunately they don't spend the money on training the staff.
"No nursing home" is a right of older persons. "They could fall and die" This is their choice to live alone and possibly die. They can and do FALL in nursing homes. Nursing homes provide no privacy for someone who wants to be alone. NO VISITORS from other nursing home residents. You can't lock your door. Rules that I would not agree to. Covid vaccine - NO! Aids giving baths NO! If I don't want to eat something or eat only pie, it's my right. Elderly persons should not be forced to do anything. RESPECT THEM and Let them spend their last days as they choose.

I live in South Carolina my mom died and left her estate to her grandkids, my dad and me. My dad is in charge of the estate and he has stolen 60+ thousand from me through Fraud connected to the estate. I can’t find a lawyer that I can afford because of this so I’m trying to go at it alone. I I petition the court to get him removed as the executor what’s my next steps can you please help?
I have text of him admitting to this And every thing he has done. And I have other proof.
I am a case manager at a hospital. You have no idea how many times we have to VERY firmly tell family members and doctors THEY HAVE THE RIGHT TO REFUSE AS LONG AS THEY CAN MAKE THEIR OWN DECISIONS. If they are having issues of dementia that makes them dangerous- we tell them to get a conservatorship if they can. So many Dr's think everyone lives in a 4,000 sqft house with employees and under estimate what people can do. We've rescued MANY people from Dr driven "easy solution." Almost every week of the year. And some kids either want uninhibited access to the patients assets or for their OWN comfort want their parent "placed" even though they don't need to be. We have to stand for the patient. Difficult at home, messy, disrepair doesn't make it acceptable to try to force someone against their will. People live different lives and have different standards. Some people think the sky is falling if they don't have seasonal furniture changes, or dust on the table. People can live as they choose. BUT that being the norm- there is the occasional person who can NOT go home AND refuse to be placed. Confused combative etc. with no chance to turn it around. Those, if family is available are suggested to conserve and family cares for them in the meantime until completed in court. File for emergency conservatorship. I had to do that only about 2 weeks into my job (and only this time for me) get a public guardian to get a conservatorship for a patient. Took a while, about a month but she was safely placed. The unfortunate part for placement is you never know the reality of the facility. Regardless of their shining pictures. Some places are wonderful, some terrible. But here in rural N. Calif many go far away and we hope it's a good spot. Though most go home and sometimes at our insistence that the family can not override an alert, oriented capable patient.
Yeah especially when the elder has a lot of money. When lots of money is up for grabs everyone wants a piece of that pie and suddenly they insist that grandma has dementia.

Don't you have to be basically broke before Medicaid will pay for a nursing home? Something like you can keep the house, one vehicle, and not much cash? If you have any assets they must be liquidated before Medicaid kicks in?
No. You are allowed that stuff to get Medicaid but they don't tell you they are coming for your house after you die.

From what I understand the home will also be attached at the end of life for all Medicaid costs.
My 82 year old mother has COPD, congestive heart failure, and can barely walk. She also has personality disorder, tried to commit suicide twice years ago, been divorced 4 times, has thrown fits in numerous Dr’s offices, and is a hoarder. You can barely walk through her house and the smell terrible. She rarely bathes and the last time I was there to deliver her groceries she had dried feces running all down her legs. I called DHHR to do a well check but she cracked open the door to speak to them but refused to let them enter. She is very narcissistic to the point where I’ve recently had to go no contact due to my BP going up and getting panic attacks when I even have to talk to her. I’ve been advised by my Dr to distance myself from her for my own health. ( He is well aware of how she acts as he used to be her Dr.) I’ve spoken to her current Dr. who is also well aware of her actions and told me she isn’t far from failing a Medicare evaluation, but now he’s moving away. She has no one else to take her to Dr appointments or get her groceries and medication, as I’m an only child as is she. I have been told by social workers,DHHR, and Drs that there’s nothing I can do about her living situation as long as she pays her own bills. I fear her dying in that house and no one finding her for a long time, as she will never go to a nursing home and never give me power of attorney. I’m at wits end! I can’t afford a court battle. I keep thinking she will fall soon and break a hip and have no other choice but to go. Is this all I can do? Thank you!
How are higher income earners "paying more for the deficit" ? Isn't it just that those in the upper classes would now become subject to the 6.2% tax on their income in the same way those who make less than them already are?

Great question. Typically yes so long as your lender approves. Also Garn St. Germain Act allows homeowner with a mortgage to put their property in a revocable trust and maybe irrevocable trust so long as you maintain a beneficial interest in property.
If you still have a mortgage, can you have an irrevocable trust?
What about a rental property that is being inherited to a special needs person? Does the rental income coming from the renter to the child effect there Medicaid and SSI benefits if the property is placed in a SNT? As well if a parent is putting the property for a special needs child in the trust would that be considered a third party trust and the parent no longer owns the property?

Wait until you see the paperwork. I filed a claim for my mom who is 100. Almost a year since I started the process. If she doesn't get benefit soon, she will have to leave her assisted living facility. Maybe they figure she will die first. Get all your papers together before you actually need any help.
You need to go to the regional office or call. It should not wait that long. You also can see claim information under benefit on the VA web.
Her Age Factor is supposed to expedite the process for her. Don't spend time waiting on the VA, etc. Go, or call her Senator's office ASAP, to explain the issues here. They will be able to help you. Best wishes, you are a goid daughter.
